- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. Solicitation No. DTRT5716Q80070 is issued as a Request for Quotation (RFQ). This solicitation is being conducted under FAR Part 12, Acquisition of Commercial Items and FAR Part 13, Simplified Acquisition Procedures. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-87-2, effective April 6, 2016. The NAICS Code is 221115; the Small Business size standard is 250 employees. This procurement is a 100% small business set-aside for Basic Ordering Agreement (BOA) holders under BOA SP0600-15-R-0416. If your firm does not currently hold a BOA with DLA Energy, immediately refer to RFP SP0600-15-R-0416 and contact the individuals listed on the SF1449, Block 7a and 7b. The U.S. Department of Transportation, John A. Volpe National Transportation Systems Center (Volpe Center), Cambridge, MA, has a requirement for Renewable Energy Certificates (REC's) under Defense Logistics Agency (DLA) BOA SP0600-15-R-0416, Section B, SUPPLIES TO BE FURNISHED and Section C, STATEMENT OF WORK/SPECIFICATIONS. REQUIREMENTS/SPECIFICATIONS The Government intends to award a firm fixed price purchase order as a result of this Combined Synopsis/Solicitation. This notice is expected to result in a single award, subject to receipt of an acceptable proposal. The Offeror's proposal shall be prepared in accordance with the below information. The Offeror's price quotation shall include a firm fixed price for CLIN 0100 identified below. CLIN 0100 - BOA SP0600-15-R-0416 CLIN 0003 Renewable Energy Credits Quantity 90,000 MWh X Price Per MWh tiny_mce_marker_________________ = tiny_mce_marker______________________ RECs must meet the following specifications: • Vintage (Period of Generation): To meet FY16/17 goal, with preference for RECs generated between 1 April 2016-1 June 2016 • Quantity: The Department of Transportation/Volpe Center requests at a minimum 90,000 MWh of RECs • Delivery Period: No later than 15 August 2016. Delivery Location and Method: Payment method is by purchase order. RECs should be submitted electronically to Kevin.Partowazam@faa.gov and in hard copy to: Federal Aviation Administration; Office of Environment and Energy; ATTN: Kevin Partowazam; 800 Independence Ave, SW #900W; Washington, DC 20024 Invoice materials should be submitted electronically to: volpeinvoices@faa.gov (citing the purchase order number). NOTICE TO OFFERORS FAR 52.212-1, Instructions to Offerors-Commercial Items applies to this acquisition and is incorporated by reference. All Offerors must include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certification-Commercial Items (the complete provision is provided in Attachment 2). An Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certifications electronically using the System for Award Management (SAM) accessible via http://www.Sam.gov. If the Offeror has not completed the annual representations and certifications electronically in SAM, the Offeror shall complete only paragraphs (c) through (o) of this provision. All Contractors must be registered in SAM in order to receive an award from a DOT Agency. The Government intends to award one (1) purchase order on a firm-fixed price basis as a result of this solicitation. This RFQ is expected to result in a single purchase order award, subject to receipt of an acceptable proposal. FAR Clauses and Provisions 52.212-4, Contract Terms and Conditions-Commercial Items, 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, 52.232-40, Providing Accelerated Payments to Small Business Subcontractors, 52.203-98, Prohibition on Contracting with Entities that Require Certain Internal Confidentiality Agreements-Representation (DEVIATION 2015-02) and 52.203-99, Prohibition on Contracting with Entities that Require Certain Internal Confidentiality Agreements (DEVIATION 2015-02) are hereby incorporated by reference. Additional clauses cited in 52.212-5 that apply to this acquisition are: 52-209-6, 52.219-6, 52.222-3, 52.222-19, 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.222-50, 52.223-15, 52.223-18, 52.225-1, 52.225-13, 52.232-33 and 52.232-40. This combined synopsis/solicitation hereby incorporates all Federal Acquisition Regulation (FAR) provisions and clauses contained herein and all BOA SP0600-15-R-0416 terms and conditions. It is anticipated that an award resulting from this combined synopsis/solicitation will be made on or about June 1, 2016. The following FAR provision is incorporated by full text: FAR 52.203-98 PROHIBITION ON CONTRACTING WITH ENTITIES THAT REQUIRE CERTAIN INTERNAL CONFIDENTIALITY AGREEMENTS-REPRESENTATION (DEVIATION FEB 2015) (a) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Resolution Appropriations Act, 2015 (Pub. L. 113-235), Government agencies are not permitted to use funds appropriated (or otherwise made available) under that or any other Act for contracts with an entity that requires employees or subcontractors of such entity seeking to report fraud, waste, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information. (b) The prohibition in paragraph (a) of this provision does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information. (c) Representation. By submission of its offer, the Offeror represents that it does not require employees or subcontractors of such entity seeking to report fraud, waste, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.
