- This notice announces the intent by the U.S. Army Medical Research Acquisition Activity (USAMRAA) in support of U.S. Army Medical Materiel Agency (USAMMA) to purchase medical equipment parts on a brand name only basis, as prescribed in FAR 13.106-1(b)(1)(i). Specifically, the government will purchase the following items manufactured by Philips Healthcare either directly from the manufacturer or from one of its authorized distributors/resellers: Part#: 451220102564; Description: Bucky housing; Qty: 2 Part#: 453567135961; Description: Phantom, brilliance CT; Qty: 1 Part#: 455012003801; Description: Detector Module; Qty: 6 These items are needed at a USAMMA depot at Tracy, CA which repairs and replaces Medical equipment used by deployed forces in theater. Medical equipment repair parts are available only from the manufacturer of the equipment or from a firm that has been licensed by the manufacturer to produce authorized parts. This conclusion is based on Army Regulations and market research. Army Regulation (AR) 40-61, Medical Logistics Policies, prohibits modifications or alterations of Army medical equipment without the manufacturer's consent. Section 6-17 provides that even "minor alterations without the manufacturer's consent may negate any further manufacturer product liability." AR 40-61 lists four circumstances under which Army medical maintenance personnel may modify medical equipment: modification work order, quality assurance alteration, minor alteration, and component modernization. All require manufacturer involvement or consent. The North American Industry Classification System (NAICS) for this requirement is 339112 and the size standard is 1,000 employees. This announcement fulfills the synopsis requirements under FAR 5.102(a)(6) and 5.203(a). USAMRAA intends to publish a solicitation no sooner than 15 days after publishing this synopsis. This Special Notice of Intent is not a request for competitive quotes. Information received in response to this notice will be considered solely for the purpose of determining whether a competitive procurement is in the best interest of the Government. If no written responses are received by the date listed below, which reflects fifteen (15) days after the publication of this notice, the solicitation will be issued as brand name only.
