- In accordance with FAR 5.203(b)(d) and 6.302-1 the National Park Service intends to award a purchase order on the basis of other than full and open competition for Olympic National Park, to renew an annual software License and Support Agreement (LSA) for twelve POS cash registers (Datasym Elixr Duo Touch Screen and associated modems), including associated equipment (modems), for a period of one base year with the option to exercise up to four option years. This notice of intent is not a request for competitive quotations. No solicitation document exists at this time. The North American Industry Classification System (NAICS) code is 423420 and the small business size standard is 200 employees. In accordance with FAR 5.207(c)(16)(ii), all responsible sources may submit a capability statement, proposal, or quotation within fifteen (15) calendar days after date of publication of this synopsis which will be considered by the agency. JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION for SIMPLIFIED ACQUISITIONS OVER $3,000 AND UP TO $150,000 (See FAR 13.106-1) Date: 5/16/16 Purchase Request Number: 0040277675 1. NATURE AND/OR DESCRIPTION OF THE ITEM/SERVICE BEING PROCURED AND ITS INTENDED USE (INCLUDE THE ANTICIPATED COST): National Park Service, Olympic National Park intends to award a non-competitive purchase order to Advantage Solutions, LLC in the amount of $7,812 for the renewal of the License and Support Agreement (LSA) for twelve Point of Sale (POS) cash registers (Datasym Elixr Duo Touch Screen), including associated equipment (modems). The contract will be for one base year plus the option to exercise up to four option years. Firm-fixed prices have been determined for each year, as follows: (a) Base Year (July 1, 2016 - June 30, 2017) $7,812, (b) Option Year One (July 1, 2017 - June 30, 2018) $8,064, (c) Option Year Two (July 1, 2018 - June 30, 2019) $8,316, (d) Option Year Three (July 1, 2019 - June 30, 2020) $8,568, and (e) Option Year Four (July 1, 2010 - June 30, 2021) $8,820. The total five-year aggregate price is $41,580. From the base year to option year one, the price increases by 3%. This is a firm-fixed percentage applied to each option year. The lump prices for each year include the following services: Advantage Software License, Back Office Programming and Support, Server Programming and Support, and POS System and Programming and Support. 2.1 SOLE SOURCE JUSTIFICATION RATIONALE. Only one responsible source, authorized as follows: (a) 41 U.S.C. 253(c)(1): Only one responsible source and no other supplies or services will satisfy agency requirements, (b) FAR Part 11.105: The Brand Name products are essential to the Government's requirements, and market research indicates other companies' similar products do not meet and cannot be modified to meet the agency's needs, and (c) FAR 6.302-1: The use of the name brand products are essential to the Government's requirements, thereby precluding consideration of a product manufactured by another company. 2.2 EXPLAIN (DESCRIPTION OF THE PRODUCT'S UNIQUE QUALIFICATIONS OR THE UNIQUE NATURE OF THE ACQUISITION): Olympic National Park's current POS equipment is the Datasym Elixir Duo Touch Screen cash registers that were upgraded in 2015 (P15PX00859 awarded in the amount of $53,892.21 vs. estimate of $80,000 or more to have purchased and installed brand new POS cash registers and totally different system with its own software and back-office support, training, etc.). At that time it was in the Government's best interest to pursue upgrading existing equipment vs. replacing it. The Olympic National Park fee program needs to continue maintaining its existing POS software programs (Comm2000 and Advantage). The Advantage Solutions' Comm2000 and Advantage software was created and licensed by Advantage Solutions, not sold to any other company or manufacturer, and was designed specifically for the NPS fee program; used for depositing, tracking, auditing, numerous report preparations and retrieval, all which increase program accountability that allows effective management of the funds. Award of a new LSA to Advantage Solutions ensures that the POS system and equipment will remain operational for up to five years. 3. MARKET RESEARCH. PLEASE EXPLAIN THE RESULTS OR WHY ONE WAS NOT PERFORMED. STATE WHETHER ANY OTHER OFFERS WERE RECEIVED OR ANYONE EXPRESSED INTEREST: While there are other Datasym authorized dealers that sell the Datasym Elixr Duo Touch Screen cash registers, at this time there are no other POS software providers who have developed a system for sales of National Park Passes with the ability to track the sales and provide back office remittance and deposit software specific to the needs of National Parks. The Washington Fee Office is allowing parks that have recently or currently upgraded POS equipment to continue use of that equipment. Because OLYM upgraded its POS equipment in 2015, this contract ensures continued use and support of that equipment for up to five years. The NPS Washington National Fee Program has been and is currently developing a nation-wide standard for hardware and software point of sales equipment that's planned to be implemented over the next few years (no set timeframe has been given). They've advised parks that if the park spent funds on recent upgrades to their cash registers and modems, to continue with the annual software license and support renewals to keep the equipment functioning. They are not pressuring parks to replace their existing equipment because they know the expense involved in doing so, and it's not feasible or efficient to do so until the existing equipment is in actual need of replacement at which time there is hope of a national contract being available for parks to utilize. Therefore, the decision to only purchase the LSA for the existing POS software was determined to be in the Government's best interest and the most economical option. 4. IF THIS IS A DETERMINATION FOR SOLE SOURCE, THE CONTRACTING OFFICER CERTIFIES: (a) Only one source is available, or urgent and compelling circumstances exist.
