- INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A PURCHASE ORDER WITHOUT PROVIDING FOR FULL AND OPEN COMPETITION (INCLUDING BRAND-NAME). The National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA) on behalf of The National Institute of Dental and Craniofacial Reseach (NIDCR) intends to negotiate and award a Purchase Order without providing for full and open competition (Including brand-name) to Carl Zeiss for an Axioscan Z1 Slidescanner Disk Array. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 334112, Computer Storage Device Manufacturing, Small Business Size 1250 employees. REGULATORY AUTHORITY The resultant Purchase Order will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-88 effective 16 MAY 2016. This acquisition is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold ($150,000). STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. FAR Subpart 6.302-1-Only one responsible source and no other supplies or services will satisfy agency requirements 41 U.S.C. 253(c)(1), provides the authority to sole source. DESCRIPTION OF REQUIREMENT Background: The National Institute of Health (NIH) is the nation's leading medical research agency and the primary Federal agency conducting, supporting and making medical discoveries that improve people's health and save lives. The mission of the National Institute of Dental and Craniofacial Research (NIDCR) is to improve dental, oral, and craniofacial health through research, research training, and the dissemination of health information. The NIDCR seeks to procure a Disk Array for analysis of microscope slide specimens from tissues and cells. The system selected for this purpose must have a substantial throughput rate to accommodate multiple users and the high number of individual samples that go into the analysis of tissue disorders associated with spontaneous or induced gene mutations. The NIDCR previously acquired a Zeiss Axioscan Z1 Scanner for microscope slide imaging. This device has a very high output in terms of image number, which in theory enables multiple users to utilize the device. Currently, however, the scanner is serviced by a sole workstation, which hosts the scanner control/image-acquisition software, the digitized images generated by the scanner and the image processing and histomorhometric measurement/evaluation software. This generates a bottleneck in the throughput volume as only one investigator can use the system at a time. The NIDCR seeks to acquire a slide scanner disk array (computer and disk storage for acquired images), which will enable image data storage and simultaneous data access and image processing evaluation by multiple investigators simultaneously. This new acquisition will greatly enhance the performance of the Slide Scanner and enable remote access to image data for all NIDCR investigators from their desk computers via the NIDCR intranet. Purpose and Objectives: The purpose of the acquisition is to obtain a device (here defined as a Slidescanner Disk Array) for storage, multipoint access and processing of digitized images generated by the NIDCR Axioscan Z1 slidescanner. This device will greatly enhance the image acquisition and processing throughput by enabling use of a single device simultaneously by multiple NIDCR investigators. The acquisition of this device has been necessitated by the high demand for the Axioscan Z1, which was previously purchased by the NIDCR. Period of Performance: Delivery: Four (4) to six (6) weeks after receipt of order Performance Location: National Institutes of Health, NIDCR 30 Convent Drive Building 30 Bethesda, MD 20892 Project Description: 1) The contractor shall provide brand name or equivalent: a. Product code: 4103240015000000; Description: Disk space 11 TB for Server Zeiss: Quantity: 1 d. Product code: 4101351004200000; Description: ZEN 2 desk Hardware License Key: Quantity: 1 2) Contractor Requirements: a. The products must be compatible with the Carl Zeiss Axioscan Z1 Scanner and Workstation CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION Only one source is available: The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10-Market Research, specifically the review and evaluation of the responses to the sources sought notice (NHLBI-CSB-DE-2016-139-KEW) published in the FedBizOpps on 5/16/16. The results of the market research concluded that Carl Zeiss is the only vendor capable of providing the required disk array. The NIDCR currently owns a Zeiss Axioscan Z1 slide scanner and workstation; the disk array, made by Zeiss, is compatible and built to meet the specifications of the currently owned slide scanner. The Zeiss hardware and software is proprietary in nature and requires Zeiss technicians to install the equipment to avoid possible warranty voiding. No other disk arrays are compatible with the current slide scanner and Carl Zeiss does not authorize 3rd party vendors to provide their product. CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by June 8th, 2016 9:00 AM EST and must reference number NHLBI-CSB-DE-2016-154-KEW.
