Description
Contractor Questions and Government Answers Price Sheet (Amendment 01) (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulations (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) This solicitation number (192116VNE25000007) is issued as a request for quotation (RFQ). The resultant contract will be a firm-fixed price contract. (iii) This solicitation document (RFQ) and incorporated provisions and clauses those in effect through Federal Acquisition Circular 2005-87-2. (iv) This proposed acquisition is 100 percent set-aside for small businesses. This acquisition is open to all small businesses and is issued under NAICS code 561621, Security System Services (Except Locksmiths). The size standard is $20,500,000. (v) The following list of contract line item number(s), units of measure, quantities, item number, needed by the Department of Homeland Security (DHS), Immigration and Customs Enforcement (ICE) Agency, Homeland Security Investigations, SAC Newark. LINE 0001 12 months of security system maintenance in accordance with attached statement of work. Base Period (one year after award, estimated July 1, 2016 to June 30, 2017); Unit of Measure (UM): Month (MO); LINE 1001: 12 months of security system maintenance in accordance with attached statement of work. Option Period 1 (July 1, 2017 to June 30, 2018), UM: MO; LINE 2001: 12 months of security system maintenance in accordance with attached statement of work. Option Period 2 (July 1, 2018 to June 30, 2019), UM: MO; LINE 3001: 12 months (MT MO) in accordance with attached statement of work. Option Period 3 (July 1, 2019 to June 30, 2020), UM: MO; LINE 4001: 12 months (MT) in accordance with attached statement of work description. Option Period 4 (July 1, 2020 to June 30, 2021), UM: MO; LINE 5001: 1 month (MT MO) in accordance with attached statement of work description. Option Period 5 (July 1, 2021 to December 31, 2021); In accordance with FAR 52.217-8 -- Option to Extend Services; UM: M0 (vi) DHS/ICE/SAC Newark has a requirement for security system maintenance in accordance with the attached statement work. (vii) Date(s) and place(s) of delivery and acceptance and FOB point: The proposed order will consist of a base year with, four twelve-month option periods. The FOB point is F.O.B. DESTINATION (NOV 1991) in accordance with FAR 52.247-34. (viii) FAR clause 52.212-1, Instructions to Offerors-Commercial Items (April 2014) applies to this acquisition. To be considered for award quotes must be submitted on the attached price sheet with prices provided for all contract line item number (CLINS). Also, contractors must have an active DUNS. Provide your company's DUNS along with your quote. (ix) The FAR provision 52.212-2, Evaluation-Commercial Items (OCT 2014), does not apply to this RFQ. The Government will award a contract resulting from this solicitation in accordance with FAR 13. Award to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government based on the price and award will be made on all-or-none" basis. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (x) All offerors shall complete provision at 52.212-3, Offeror Representations and Certifications-Commercial Items (MAR 2015), electronically via the System for Award Management (SAM) online at http: www.sam.gov or if an Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (p) of provision 52.212.3 and submit a copy of with the offer. (xi) FAR clause 52.212-4, Contract Terms and Conditions-Commercial Items (DEC) 2014), applies to this acquisition. (xii) A statement that the clause at 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items (DEC 2014), applies to this acquisition and the clause are applicable to the acquisition include: (a); (b); (4); (8); (14); (22); (25); (26); (27); (28); (30); (33); (40); (42) Alternate II; (44); (c) (6); (e) (xi) (52.222-50) (xiii) Additional contract requirement(s) or terms and conditions: 52.217-8 -- Option to Extend Services (Nov 1999): The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within one day before contract expiration. (End of Clause) 52.217-9 -- Option to Extend the Term of the Contract (Mar 2000): (a) The Government may extend the term of this contract by written notice to the Contractor within one day; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least seven days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed sixty six months/five years and six months. (End of Clause) 52.247-34 F.O.B. DESTINATION (NOV 1991): (a) The term "f.o.b. destination," as used in this clause, means-(1) Free of expense to the Government, on board the carrier's conveyance, at a specified delivery point where the consignee's facility (plant, warehouse, store, lot, or other location to which shipment can be made) is located; and (2) Supplies shall be delivered to the destination consignee's wharf (if destination is a port city and supplies are for export), warehouse unloading platform, or receiving dock, at the expense of the Contractor. The Government shall not be liable for any delivery, storage, demurrage, accessorial, or other charges involved before the actual delivery (or "constructive placement" as defined in carrier tariffs) of the supplies to the destination, unless such charges are caused by an act or order of the Government acting in its contractual capacity. If rail carrier is used, supplies shall be delivered to the specified unloading platform of the consignee. If motor carrier (including "piggyback") is used, supplies shall be delivered to truck tailgate at the unloading platform of the consignee, except when the supplies delivered meet the requirements of Item 568 of the National Motor Freight Classification for "heavy or bulky freight." When supplies meeting the requirements of the referenced Item 568 are delivered, unloading (including movement to the tailgate) shall be performed by the consignee, with assistance from the truck driver, if requested. If the contractor uses rail carrier or freight forwarded for less than carload shipments, the contractor shall ensure that the carrier will furnish tailgate delivery, when required, if transfer to truck is required to complete delivery to consignee. (b) The Contractor shall- (1)(i) Pack and mark the shipment to comply with contract specifications; or (ii) In the absence of specifications, prepare the shipment in conformance with carrier requirements; (2) Prepare and distribute commercial bills of lading; (3) Deliver the shipment in good order and condition to the point of delivery specified in the contract; (4) Be responsible for any loss of and/or damage to the goods occurring before receipt of the shipment by the consignee at the delivery point specified in the contract; (5) Furnish a delivery schedule and designate the mode of delivering carrier; and (6) Pay and bear all charges to the specified point of delivery. (End of provision) (xiv) The Defense Priorities and Allocations System (DPAS) and assigned rating, are not applicable to this acquisition. 52.237-1-Site Visit (APR 1984) Offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award. (End of Provision) A site visit will be conducted Thursday, June 9, 2016, at 10:00 AM, Eastern Time. In order to attend the site visit all vendors interested in attending are required to contact the Mrs. Lois Gavakis, Primary Point-of-Contact, by email (Lois.Y.Gavakis@ice.dhs.gov) to obtain instructions for attending the site visit one (1) day prior to the site visit. Vendors are required to provide a list of all attendees to the Primary Point-of-Contact. A list of questions submitted with answers will be uploaded to www.fbo.gov under combined synopsis/solicitation number 192116VNE25000007. (xv) The date, time and place offers are due: no later than Monday, June 20, 2016 10:00 AM Central Time (CT). All questions shall be submitted by email as indicated above no later than Tuesday, June 14, 2016, 10:00 AM CT.
