- THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS PREPARED IN ACCORDANCE WITH THE FORMAT IN FAR SUBPART 12.6, AS SUPPLEMENTED WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. In accordance with FAR 19.5 this action is reserved exclusively for small business concerns. The U.S. Dept. of Commerce, NOAA, National Ocean Service, National Centers for Coastal Ocean Service, Center for Coastal Fisheries and Habitat Research, 101 Pivers Island Road, Beaufort, NC 28516 has a requirement for Underwater drop cameras and other accessories. All requirements are to be provided in accordance with the provided Statement of Need. This acquisition has been issued as an RFQ reference (EE133C-16-RQ-0513) and will be awarded as a firm fixed price order under simplified acquisition procedures. All responsible sources may submit a quote in accordance with the paragraph above. This is a solicitation for supply/services prepared in accordance with the format in FAR Subpart 13.0, as supplemented with additional information included in this notice. The quotations will be evaluated on an all or none basis. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-87. The Federal Supply Code (FSC) is 6760. The associated North American Industrial Classification System (NAICS) code for this procurement is 334220 with a small business size standard of 1,250 employees. FAR 52.212-1 Instructions to Offerors-Commercial Items applies. Evaluation will be in accordance with FAR 52.212-2 Evaluation-Commercial Items. Award will be made to the responsible, responsive offeror whose offer will result in the acquisition of Sartek Industries Underwater drop video camera and accessories. A Brand Name award, lowest technically acceptable price and who can best meets the requirements listed. FAR 52.212-4, Contract Terms and Conditions-Commercial Items and 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items (MAR 2016) applies and the following additional FAR clauses cited in the clause at paragraph (a) are applicable to this acquisition, as such consider the following clauses checked, (1) and (3), paragraph (b) are applicable to this acquisition, as such consider the following clauses checked, (1), (2), (14 i), (26), (32), (40), (41), (44), and (50). The following addenda or additional terms and conditions apply; None. No Defense Priorities and Allocations System (DPAS) rating is assigned. Assurance by Corporations Regarding an Unpaid Delinquent Tax Liability or a Felony Conviction Under Any Federal Law (Class Deviation) (March 2012) (1) In accordance with Sections 543 and 544 of Public Law 112-55 Commerce, Justice, Science, and Related Agencies Appropriations Act 2012, Title V (General Provisions) none of the funds made available by that Act may be used to enter into a contract with any corporation that- (a) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, unless the agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government. (b) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, unless the agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government. (2) By accepting this award or order, in writing or by performance, the offeror/contractor assures that - (a) The offeror/contractor is not a corporation convicted of a felony criminal violation under a Federal law within the preceding 24 months. (b) The offeror/contractor is not a corporation that has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreements with the authority responsible for collecting the tax liability. (2) By accepting this award or order, in writing or by performance, the offeror/contractor assures that - (a) The offeror/contractor is not a corporation convicted of a felony criminal violation under a Federal law within the preceding 24 months. (b) The offeror/contractor is not a corporation that has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability. (End of Provision) 52.203-98, Prohibition on Contracting with Entities that Require Certain Internal Confidentiality Agreements-Representation (DEVIATION 2015-02) PROHIBITION ON CONTRACTING WITH ENTITIES THAT REQUIRE CERTAIN INTERNAL CONFIDENTIALITY AGREEMENTS-REPRESENTATION (FEB 2015) (a) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Resolution Appropriations Act, 2015 (Pub. L. 113-235), Government agencies are not permitted to use funds appropriated (or otherwise made available) under that or any other Act for contracts with an entity that requires employees or subcontractors of such entity seeking to report fraud, waste, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information. (b) The prohibition in paragraph (a) of this provision does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information. (c) Representation. By submission of its offer, the Offeror represents that it does not require employees or subcontractors of such entity seeking to report fraud, waste, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information. (c) The prohibition in paragraph (a) of this clause does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information. (d) (1) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Resolution Appropriations Act, 2015 (Pub. L. 113-235), use of funds appropriated (or otherwise made available) under that or any other Act may be prohibited, if the Government determines that the Contractor is not in compliance with the provisions of this clause. (2) The Government may seek any available remedies in the event the Contractor fails to comply with the provisions of this clause. (End of clause) The Government intends to award a Brand Name product, lowest price and technically acceptable, firm fixed-price contract on an all or none basis. Authorization for this request is 41 USC 253C (1) and 41 USC 253C (2). To be eligible for award, offerors must be registered in the System for Award Management (SAM) to be considered for an award of a federal contract. Statement of Need for Brand Name Products DOC, NOAA, Center for Coastal Fisheries and Habitat Research has a need for (2) two underwater video cameras that relay a video signal to the surface where it will be recorded on a DVR. P/N: SDC-CSS: Underwater color drop video camera in a stainless steel housing with 700+ LOR, high sensitivity with bulkhead connector and built-in illumination. (2 ea) P/N: Miscellaneous hardware and connectors / add bulkhead connector to SDC-CSS upgrade (2 sets) P/N: SC4C-600: SC4C-600' Surface tether, 4 conductor plus coax, Kevlar cord, reel, surface interface box, wet connect, power supply (2 ea) P/N: SC-OB : Cable overbrading (SC4C-600) (2 ea) P/N: SBS-TR: Bottom Survey 3' tripod frame with camera mount (1ea) P/N: EBLI1200V: 1200 Lumen light 3 C cell video diffuser with adjustable mount for tripod. The cameras will have to withstand the very rigorous conditions of Alaska waters with depths of over 500 ft. and high currents generated by a tidal range of over 20 ft. The camera must meet the following conditions: a camera housing that can withstand pressures of up to 1000 ft. of pressure; a cable with a break strength of at least 2000 pounds; and the cable must have an overbrade of polypropylene (or similar) to withstand the abrasion of the crab pot puller that will be used to lower and raise it. All of the above mentioned requirements must be met. IT Security Requirements The Assessment and Authorization (A&A) requirements of Clause 48 CFR 1352.239-72 do not apply, and a Security Accreditation Package is not required. The contractor will only supply hardware and/or software and/or product license and will not require the use of any contractor owned equipment. The contractor will not have remote access to any government owned equipment. The contractor includes the necessary product support and supporting documentation for the hardware and/or software that allows the sanitization (following NIST Special Publications 800-88 Guidelines for Media Sanitization, http://nvlpubs.nist.gov/nistpubs/SpecialPublications/NIST.SP.800-88r1.pdf) of the hardware and/or software upon the disposal of the product. The contractor must provide sufficient document demonstrating the software being provided complies with Office of Management and Budget Memorandum M-07-18 entitled Ensuring New Acquisitions Include Common Security Configurations and the FAR 39.101(d) regulations involving NIST common security configuration checklists including Federal Desktop Core Configuration (FDCC) or United States Government Configuration Baseline (USGCB) initiative. More information is available at National Checklist Program (NCP), (http://checklists.nist.gov), is the U.S. government repository of publicly available security checklists (or benchmarks) that provide detailed low level guidance on setting the security configuration of operating systems and applications. The contractor must provide sufficient documentation which demonstrates the acquiring information technology has implemented common security configurations. Common security configurations are available from the National Institute of Standards and Technology's website at http://checklists.nist.gov. The contractor must ensure that the product being purchased complies with the Homeland Security Presidential Directive 12 (HSPD-12) requirements from FAR 4.1302 stating: (a) In order to comply with FIPS PUB 201, agencies must purchase only approved personal identity verification products and services. (b) Agencies may acquire the approved products and services from the GSA, Federal Supply Schedule 70, Special Item Number (SIN) 132-62, HSPD-12 Product and Service Components, in accordance with ordering procedures outlined in FAR Subpart 8.4. The contractor must ensure that the product being purchased complies with Internet Protocol Version 6 (IPv6) requirements from FAR part 11.002 requirements which state that unless the agency Chief Information Officer waives the requirement, when acquiring information technology using Internet Protocol, the requirements documents must include reference to the appropriate technical capabilities defined in the USGv6 Profile (NIST Special Publication (SP) 500-267- http://www.nist.gov/itl/antd/usgv6.cfm) and the corresponding declarations of conformance defined in the USGv6 Test Program (http://www-x.antd.nist.gov/usgv6/index.html). To meet this requirement each DOC acquisition of IP protocol technology must express requirements for IPv6 capabilities in terms of the USGv6 Profile (i.e., using the USGV6 Capabilities Check List) and vendors must be required to document their product's support of the requested capabilities through the USGv6 test program (reference http://www.antd.nist.gov/usgv6/) using the USGv6 Suppliers Declaration of Conformity. The contractor must provide sufficient document demonstrating the software being provided meets the following: • The standard installation, operation, maintenance, update and/or patching of software shall not alter the configuration settings from the approved FDCC/ USGCB/other secure configuration. • Applications designed for normal end users shall run in the standard user context without elevated system administration privileges. The contractor must provide all supporting documentation or a reference to obtain the necessary material which describes the security capabilities, the design and development processes and the testing and evaluation procedures used by the product or services being provided for this acquisition. The contractor must provide all supporting documentation or a reference to obtain the necessary material which describes all product or service updates and enhancements as they are implemented. The product or service supporting documentation could be the user and system administrator guides, which is documents the functional properties of the security controls employed to permit the analysis and testing of the security controls.
