- THIS ACQUISITION IS FOR NATIVE OWNED SMALL BUSINESS SET ASIDE UNDER THE BUY INDIAN ACT (25 U.S.C.) The offeror represents as part of its offer that it [ ] does [ ] does not meet the definition of Indian economic enterprise as defined in 14.80.201. This is a combined synopsis/solicitation for commercial items prepared in accordance with FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; a written solicitation will not be issued. Solicitation No. A16PS00732 herein cited will be procured under FAR Part 12, Acquisition of Commercial Items. Solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-86. This acquisition is set aside for Native Owned Small Business, NAICS Code 541380. DESCRIPTION: The contractor shall provide services consisting of furnishing all labor, materials, equipment and supervision, transportation and incidentals necessary when providing analytical services for drinking water sample collections from well heads, taps and other drinking water collection points under the aegis of the Safe Drinking Water Act (SDWA) 40 CFR 143, etc. The BIA owns or operates fifty seven (57) water systems which must be sample in accordance with the schedules provided by the regulatory agencies of the United States Environmental Protection Agency (USEPA) and the Navajo Nation Environmental Protection Agency (NNEPA). SCOPE OF WORK Analytical Service Contract Safe Drinking Water Monitoring Protocol Base Calendar Year 2016 (May 23, 2016-December 31, 2016) Option Years: (January 2017 ¿ December 2018) The BIA requires the services of a contractor to provide analytical services for Drinking Water Sample collections from well heads, taps and other drinking water collection points under the aegis of the Safe Drinking Water Act (SDWA), 40 CFR 143, et. The BIA owns or operates fifty-seven (57) water systems which must be sampled in accordance with the schedules provided by the regulatory agencies of the Unites States Environmental Protection Agency (USEPA) and the Navajo Nation Environmental Protection Agency (NNEPA). Samples are collected from various schools and administrative centers located throughout the Navajo Indian Reservation in the states of Arizona, New Mexico and Utah. The purpose of this contract is to obtain analytical services for routine and special sampling of the BIA small community drinking water systems within the Navajo Nation. Both regulatory agencies (USEPA and NNEPA) provide a calendar year schedule of required sample collections and their analytical protocol in accordance with the Safe Drinking Water Act (SDWA) and the Navajo Nation Drinking Water Code. BIA as the owner/operator must comply with the requirement of the schedules produced by NNEPA and USEPA. BIA as a regulated drinking water provider is responsible for the collection of the drinking water samples and shipment of samples to a certified laboratory for analyses and reporting the results of the analyses to the regulatory agencies and any exceedence to the users as required under the consumer confidence reporting regulations. Contract Requirements: The BIA shall identify each sampling protocol in accordance with the USEPA and NNEPA schedules. The contractor (laboratory) must provide analytical services to support the BIA Public Drinking Water systems and specialized program requirements. Each year the system schedule changes and fluctuates in accordance with the USEPA and NNEPA regulatory requirements, protocol changes and sampling schedules. The contractor shall be expected to conduct all parameters of the USEPA/NNEPA SDWA analytical support services requirements in accordance with the SW 846 protocol and NNEPA Drinking Water Code. From time-to-time, emergencies can occur which may require special analytical protocol and may cause analytical service to deviate from the existing schedule. Despite these anomalies or deviations, the contracted laboratory shall be expected to continue to provide analytical service in accordance with the terms of the contract and with no interruption of services. Contractors must bid on the entire schedule by agency as listed. It is MANDATORY to physically have the laboratory within 150-mile radius of Gallup, New Mexico. PRE SUBMITTALS: 1.The certification requirement, under the solicitation is the laboratory must be certified by a State, under the USEPA Contract Lab Program, or have proof of USEPA affiliation in accordance with the USEPA Performance Evaluation Test Program. A copy of the certification must be submitted with the bid proposal. Laboratory Certification: At minimum, the laboratory will be certified by a State. It is preferred that the laboratory currently participates in the USEPA Performance Evaluation Test Program and has some proof of performance. A copy of all certifications will be submitted with the bid proposal. ALL CERTIFICATIONS MUST BE CURRENT AND IN PLACE. 2.The Certified Laboratory must be physically located within a 150-mile radius of Gallup, New Mexico and have the capabilities to conduct the analyses on site to minimize any holding time exceedences and meet the analyte processing time. A signed statement from the contractor stating the laboratory meet this distance and capability requirement is required. 3.The Contracted Laboratory is required to be located within the 150 miles radius of Gallup, NM, as the origin. This requirement is necessary to allow for holding times and delivery of samples to meet both USEPA and NNEPA standards and Emergency Response requirements to maintain compliance with the Safe Drinking Water Act (SDWA). 4.BIA, as the owner/operator of 57 small community drinking water systems, is responsible for assuring safe drinking water which meets the regulatory standards to users of the systems. This includes 24-hour Consumer Confidence notification to system users for exceedence of any SDWA standard. Therefore, in the event of a release or emergency response, it will be necessary for the protection of the students, employees, and other users, to provide 24-hour notification to users on an expedited protocol. This will mean the receipt of samples on a same day basis and possible delivery by staff within the working day; to exceed this distance will prevent BIA from meeting these requirements. Task I: SAMPLING SCHEDULE: 1.Contracted Laboratory must be able to provide analytical support services for the BIA-Owned Drinking Water Systems and specialized program requirements in accordance with the attached schedule. No deviations from the schedule or protocols may be made without approval of BIA or the regulatory agencies. Any deviations which cause non-conformance to the sampling schedule will become the responsibility of the contractor to bear the cost for retesting and analyses of the samples. 2.Each year the system schedule changes and fluctuates in accordance with the USEPA and NNEPA schedules and according to regulatory changes and requirements. Schedules are not the same for all locations and contractor must be review each schedule for each location to ensure proper analyses is done for each location. 3.BIA will require all analyses utilize the analytical protocols identified in the USEPA and NNEPA schedules (40 CFR 141 et.al.). These schedules are developed by the primacy agencies and must be used. Task II: SAMPLE HANDLING AND TRANSPORT: BIA shall collect all water samples for analyses under the terms of the contract. 1.Annual Schedule for Sampling: Each year the system schedule changes and fluctuates in accordance with the USEPA and NNEPA schedules and according to regulatory changes and requirements. BIA must meet these schedules and shall collect all water samples for analyses with the contract laboratory. The schedule will be followed unless there is an emergency response which requires specialized sampling. BIA will also be responsible for proper collection and transport of these samples. 2.Shipping of Samples from field to laboratory: If shipping is to be performed, the laboratory shall establish a means and include the cost of shipping by commercial carrier that satisfies 49 CFR 173.4 regulatory requirements and a shipping protocol to ensure holding times are not exceeded. The contactor shall pay for all shipping cost required for the water samples sent to the laboratory as required by the contract. The cost of shipping must be included in the bid schedule. 3.Receipt of Samples: BIA personnel will either hand deliver or ship the samples to the contracted laboratory from a commercial carrier shipper as agreed upon by the contractor. If the samples are to be shipped via a commercial courier, a drop point will be established where a courier will take custody of the samples and ensure delivery to the lab from the nearest commercial/shipper. It shall be the responsibility of the lab to establish protocols to ensure holding times are not violated. Should the holding times be exceeded, the contracted laboratory shall bear all associated shipping costs caused by the exceedence for the replacement samples. 4.BIA Collection and Transport: The samples shall be collected by BIA personnel and depending on the distance from Gallup to the laboratory and holding times. There may be times where BIA will hand deliver or shipped from a shipping center/courier to the laboratory. If BIA determines that transport by BIA staff shall be the preferred method, BIA shall ensure that no sampling holding times are exceeded, sample bottles are received in good condition and the proper chain of custody is provided. 5.Provision of Acids/Fixing Agents: Concentrated reagents can no longer be shipped without special hazmat licenses. The contractor will be required to arrange for the delivery of any treated sample bottles by the contractor to BIA. In the event that BIA requires a special pickup of sample containers or it is determined that expeditious handling of sample containers is in the best interest of the government. BIA may arrange to pick up the sample containers. Arrangement will be made at that time between the Contractor/Laboratory and BIA through mutual agreement. 6.Supplies, Materials and Forms: The Contracted Laboratory shall provide analytical request forms, sampling containers/appropriate labels to include acids/fixing agents, meet sample preservation (holding time) requirements, and sampling protocol in accordance with SDWA requirements. BIA will make an official request for the required materials to allow for the collection of the samples as determined by the collection schedule. BIA will determine the time and requirement for this request. Task III: SAMPLING SCHEDULES AND PROTOCOLS: Navajo Nation Primary Drinking Water Regulations These regulations are adopted pursuant to the Navajo Nation Safe Drinking Water Act (NNSDWA), 22 N.N.C. § 2501 et.seq.; the establish primary drinking water regulations and related regulations applicable to as amended public water systems pursuant to § § 1401, 1412-13, 1445 and 1451 of the Public Health Service Act, as amended by the Safe Drinking Water Act, 42 U.S.C. § § 300f, 300g-1, 300g-2, 300g-3, 300g-4, 300g-6, 300j-6, 300j-4, 300j-9 and 300j-11. 7.The Contracted Laboratory shall be expected to conduct all parameters of the USEPA/NNEPA SDWA protocol in accordance with the schedule requirements and the SW 846 and refer to http://www.navajopublicwater.org/02NNPDWR20 on their protocol. From time to time, emergencies can occur which may require special analytical protocol and may cause analytical service to deviate from the existing schedule. The Contracted Laboratory shall continue to provide analytical service in accordance with the existing contract with no interruption in services. 8.The contracted laboratory shall perform regulated/unregulated Inorganic (IOC) analyses on Bureau-operated water systems as required under the ¿Safe Drinking Water Act ¿ (SWDA) enforced by the United States Environmental Protection Agency (USEPA) and Navajo Nation Environmental Protection Agency (NNEPA). Locations are shown on the attached analyses sheets. The required IOC parameters are identified individually or by group. A. Secondary Drinking Water Group ¿Source water samples; Includes: Calcium, Magnesium, Potassium, Sodium, Iron, Manganese, Calcium Hardness, Total Alkalinity, Bicarbonate, Carbonate, Chloride, Sulfate, Color, Conductivity, Odor, pH, Surfactants, Total Dissolved Solids [TDS] and Turbidity. B. SDWA Group (Heavy Metals): Source water sampling Antimony, Arsenic, Barium, Beryllium, Cadmium, Chromium, Cyanide (free), Mercury, Nickel, Selenium, and Thallium. Other required parameters; Sodium, Fluoride. C. OTHER: SDWA Lead/Copper analyses. Samples will be collected by water system operators according to an approved site sampling plan. D. Water Quality Parameters: At taps and entry point; pH, Alkalinity, Orthophosphates, Silica, Calcium, Conductivity and Water Temperature 9.The laboratory shall perform regulated/unregulated Volatile Organic Chemical (VOC-I) and the full Semi-volatile Organic Chemicals (Pesticides & Synthetic Organic Compounds/PCBs) and Dioxin analyses from source water samples collected from Bureau-operator wells. The contracted laboratory shall be required to refer to the following listed website to review contaminates which that are required to be analyzed. Locations of the water systems are shown on the attached analyses sheets: http://www.navajopublicwater.org/02NNPDWR20 10.Other water samples to be collected at the furthest point downstream from the chlorination point during May through September for Disinfectant By-Products (Total Trihalomethanes & Haloacetic Acids) Chemical analyses. Locations are shown on the attached analyses sheets. 11.The laboratory shall perform Radiochemical analyses on source water samples collected from Bureau-operator wells. The locations are shown on the attached analyses sheets. The following SDWA Radiochemical analysis requested are as follows: A.Gross alpha/beta B.Combined Radium 226 & 228 C.Uranium by ICP/MC & Uranium 234/238 (U-02-RC) Gross Alpha Calculation Required on reports such as; Uranium5.960 µg/l(0.67) Uranium ¿lpha (calculated)3.993 pCi/l Uranium ¿lpha (measured)N/A pCi/l Gross ¿ (measure)10.745 pCi/l Gross ¿ (corrected)6.76 pCi/l Task IV. REPORTS: General Reporting: The original report and an electronic file in (Adobe Acrobat) shall be provided to the BIA, Navajo Regional Office, Division of Environmental and Safety Management (DESM) only. All final reports will be certified by the Laboratory Manager. Laboratory QA, QC and calibration reports shall be kept at the laboratory until such time as the reports are requested by the primacy agencies. A.Reports of Analytical Results: 1.Individual laboratory reports shall be provided to show Lab. No., date received, facility name, public water system identification number (PWSID#), sampling location, sample collection date and time, and collector ¿s name. For example: Dilcon Boarding School, PWSID# NN0436006, Dilcon Well #4 and #5, Combined Source. 2.Analytical results shall indicate: The element (Arsenic), Results (0.0190), Units (mg/l), MCLs; Data Qualifier Codes and Definitions; and other comments thought appropriate by the Laboratory Manager. Task V. OTHER REQUIREMENTS: Project Initiation: The successful bidder shall contact the COR/Technical representative within 72 hours of award to arrange a technical meeting. At this first meeting, the contracted laboratory will present the Laboratory Health and Safety Plan (HASP) for the project; the organizational and team structure chart; work plan; a work schedule to accomplish the work within the time specified, contractor plan for contingencies and the contract laboratory Quality Assurance/Quality Control Plan. A.Invoicing: The invoices shall be submitted for each location with information summarized. The invoice shall include the Contract Number, dates samples collected, lab numbers, sample type with cost, location names and total number of samples. The contractor shall be required to accept the Federal Government Charge Card to allow for payment as established under the Government Charge Card requirements. B.It also required including any State Gross Receipt Taxes if any, in the bid schedule. C.The contract is advertised with renewal options for a five-year period of performance. However, annual contract performance will be used to determine if the contract will be awarded for each successive year. Under these conditions, the contract may be extended to meet requirements for each schedule as issued on a calendar year basis by USEPA and NNEPA. D.Communication and Contact: The contracted laboratory shall supply the sampler with a system of communication ensuring contact with a person knowledgeable of BIA samples twenty-four hours a day, all seven days of the week (24/7). Attached are the Blank Monitoring Schedule for Base and Option years for vendors to submit their cost estimate.
