- (i) This is a combined synopsis/solicitation for the delivery of assorted breads prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. A firm-fixed price Requirements Contract is anticipated. (ii) The solicitation number is VA247-16-Q-0598 and is issued as a request for quotation (RFQ). This estimate is not a representation to an offeror or contractor that the estimated quantity will be required or ordered, or that conditions affecting requirements will be stable or normal. The Government has obtained the estimate from records of previous requirements and consumption, or by other means, and has based the estimate on the most current information available. The Government does not guarantee a minimum quantity and will only pay for actual quantities ordered. F.1.0. GENERAL: F.1.1. The purpose of this solicitation is to establish a firm fixed price requirements contract for the offeror to furnish fresh bread and roll for the VA Medical Center facilities located in Alabama. In strict accordance with all terms, conditions, and provisions of this solicitation the deliveries and needed quantities are authorized by the Contracting Officer's Representative (COR) per location and will be paid for by Government Purchase Cards. The contractor shall contact the Contracting Officer on all matters pertaining to administration. Only the contracting Officer is authorized to make commitments to issue changes which will affect the price, quantity, quality, or delivery terms of this contract. F.2.0. ALTERNATE ITEMS, PACKAGING, AND PACKING: F.2.1. Offerors may propose alternate items, packaging, or packing. Offerors shall clearly indicate, in their offer, the quantity, packaging size, unit or other different features upon which the offer is submitted. Evaluation of the alternate item will be made against a common denominator (weight in ounces). Offerors are reminded that the alternate item must meet all the requirements of the Government specifications. F.2.2. Availability of requirements documents cited in the solicitation: a) The GSA Index of Federal Specifications (FED), Standards and Commercial Item Descriptions (CID), FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to: GSA Federal Supply Service Specifications Section, Suite 8100 470 LEnfant Plaza, SW Washington, DC 20407 Telephone (202) 619-8925 Facsimile (202) 619-8978 b) If the General Services Administration, Department of Agriculture, or Department of Veterans Affairs issued this solicitation, a single copy of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained free of charge by submitting a request to the addressee in paragraph F2.2.(a) of this provision. Additional copies will be issued for a fee. F.3.0. PRODUCT QUALITY AND FRESHNESS: F.3.1. Product conformance. The fresh or frozen bread provided shall meet the salient characteristics of the CID cited, conform to the producer's own specifications, standards, and quality assurance practices, and be the same fresh or frozen bread offered for sale in the commercial market. The Government reserves the right to require proof of such conformance. F.3.2. Quality Assurance. When required, the Federal Grain Inspection Service (FGIS), U.S. Department of Agriculture, shall determine the quality assurance of the fresh or frozen bread according to the requirements of the CID or applicable standards or specifications. The fresh or frozen bread shall be examined or analyzed in accordance with applicable provisions in this CID, solicitation, contract, or purchase order, and, when applicable, the United States Standards for Condition of Food container in effect on the date of the offer. F.3.3. Age requirement. Fresh bread shall be delivered less than 24 hours old upon arrival at the receiving point. Failure to comply with this provision will be considered grounds for default of contract. F.3.4. All products furnished under this contract shall be processed and packed under sanitary conditions in strict accordance with guidelines provided by the U.S. Food and Drug Administration and the U.S. Department of Agriculture, using the best commercial practices that are standard for the industry. All containers shall be clean, sound, and securely covered or sealed to provide adequate protection from dirt, filth, or contamination. All ingredients shall be clean, sound, wholesome, and free from evidence of rodent or insect infestation. Failure to comply with this provision will be considered grounds for default of contract. F.3.5. Ingredients for fresh or frozen bread shall consist of flour, water, salt, yeast, emulsifiers or stabilizers, and other ingredients appropriate for the type of bread specified in the schedule of items. The fresh or frozen bread shall include mold inhibitors of proper levels as allowed by the Federal Food, Drug, and Cosmetic Act. F.3.6. Enriched flour. When the bread is enriched, the wheat flour used for the bread shall conform to the U.S. Standards of Identity for Enriched Flour (21 CFR 137.165) and shall be milled from a variety of hard and/or soft wheat. F.3.7. Appearance and color. The fresh or frozen bread shall have a uniformly brown crust characteristic of the product. The fresh or frozen bread shall have a typical volume, characteristic grain, and be evenly baked without evidence of foreign odors or flavors, burnt, scorched, stale, rancid, or moldy. The delivered fresh or frozen bread shall not be crushed or damaged. F.3.8. Unless otherwise specified in the item specification or solicitation, marking shall be in accordance with best commercial practice. F.3.9. Any commercial or additional labeling, as specified, which complies with the U.S. Food, Drug, and Cosmetic Act, and regulations promulgated thereunder, is acceptable. F.3.10. Products manufactured to metric dimensions will be considered on an equal basis with those manufactured using inch-pound units, providing they fall within the tolerances specified using conversion tables contained in the latest revision of Federal Standard No. 376. If a product is manufactured to metric dimensions and those dimensions exceed the tolerances specified in the inch-pound units, a request should be made to the Contracting Officer to determine if the product is acceptable. The COTR, in accordance with the Contracting Officer, will accept or reject the product. F.3.11. Additional packaging, packing, and/or marking requirements can be found in the Addendum to 52.212-4, Terms and Conditions-Commercial Items. F.4.0. DELIVERIES OR PERFORMANCE: F.4.1 The Contracting Officer shall authorize CORs to place delivery orders for bread and roll products listed in the schedule of pricing. F.4.2. Deliveries shall be made between 8:00 a.m. and 10:00 a.m., local time, on Monday, Tuesday, Thursday, Friday, and Saturday, as requested by the COR, excluding Sundays and designated Federal Holidays. F.4.3 Delivery shall be made within the premises at the following locations, as requested in each order: Birmingham VA Medical Center 700 19th Street South Birmingham, AL 35233 Tuscaloosa VA Medical Center 3701 Loop Road East Tuscaloosa, AL 35404 F.4.4. Federal Holidays are as follows and include any other days specifically declared by the President of the United States to be a national holiday: New Year's DayMartin Luther King's Birthday Presidents' DayMemorial Day Independence DayLabor Day Columbus DayVeterans' Day ThanksgivingChristmas F.5.0. INSPECTION OF PLANTS: F.5.1. All products furnished under the awarded contract shall be processed at plants that have been inspected by the Federal Government. Approved inspection reports of another VA Facility or other Federal Government agency will be accepted as satisfactory evidence that the facilities/plants meets these requirements, provided that the inspection was made not more than six (6) months prior to the proposed contract period (See Addendum to 52.212-3 for representations and certifications. The Contracting Officer or his/her designee reserves the right to make pre-award, on-site survey and inspection of the plant, personnel, equipment and processes of the offeror. If the plant of the apparent low offeror does not meet specification or is not acceptable, the offer will be rejected. F.5.2. INSPECTION OF PLANTS: An inspection may be made of the premises and employees of bidder, prior to making award, and conditions found will be considered in awarding the contract. Inspection may also be made at any time during the life of the contract and, if it is found that the contractor is not complying with specifications, deliveries will be rejected and the products covered by this contract will be procured in the open market. Any excess cost occasioned by this action will be charged against the contractors account. F.6.0 ORDERS F.6.1. Orders shall be placed no less than 2 work days prior to required delivery date, upon delivery at the receiving located, items ordered shall be less than 24 hours of age. Orders shall not be placed more than 11 days prior to required delivery date. F.7.0 SECURITY F.7.1 All contractors/vendors must report to SECURITY to be checked in and badged before entering the Facility and must return to same location to be checked out and return badge upon completion of their day. The badge must be worn at all times while working at the facility. F.7.2 The Contractor will be responsible for ensuring compliance by its employees with the security regulations of the Veteran's Administration where work is performed under this Contract. Contracted employees will have to self-register at https://www.tms.va.gov/learning/user/SelfRegistrationUserSelection.do. Once registered, enroll in class va10176 VA Privacy and Information Security Awareness and Rules of Behavior. Contractors must provide signed certifications of completion to the Contracting Officer Representative (COR) during each year of the contract life. F.7.3 No unauthorized Photography or Video on medical center premises. Per VA Regulations 1.218(b) (23) Use of recording devices of any kind to record patients or employees is strictly prohibited. (vii) Period of Performance is 1 base year from effective date plus 4 (1 -year) priced optional periods. Offerors may submit up to 3 references showing performance that is similar in size and scope to those of this solicitation. Included in the reference must be the contract/reference number, organization name, point of contact name, point of contact phone number, point of contact email, description/list of baked good provided & period of performance. (x) Offerors are advised to include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications -- Commercial Items, with its offer if has not been completed on SAM.gov. (xi) The clause at 52.212-4, Contract Terms and Conditions -- Commercial Items, applies to this acquisition and the following clauses are added as addenda: 52.203-99 PROHIBITION ON CONTRACTING WITH ENTITIES THAT REQUIRE CERTAIN INTERNAL CONFIDENTIALITY AGREEMENTS (DEVIATION) (FEB 2015) (a) The Contractor shall not require employees or contractors seeking to report fraud, waste, or abuse to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information. (b) The contractor shall notify employees that the prohibitions and restrictions of any internal confidentiality agreements covered by this clause are no longer in effect. (c) The prohibition in paragraph (a) of this clause does not contravene requirements applicable to Standard Form 312, Form 4414, or any other form issued by a Federal department or agency governing the nondisclosure of classified information. (d)(1) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Resolution Appropriations Act, 2015 (Pub. L. 113-235), use of funds appropriated (or otherwise made available) under that or any other Act may be prohibited, if the Government determines that the Contractor is not in compliance with the provisions of this clause. (2) The Government may seek any available remedies in the event the contractor fails to comply with the provisions of this clause. (End of Clause) 52.216-18 ORDERING (OCT 1995) (a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from effective date of the contract through the end of the effective period. (b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control. (c) If mailed, a delivery order or task order is considered "issued" when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule. (End of Clause) 52.216-19 ORDER LIMITATIONS (OCT 1995) (a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than 1 unit of issue (ie: loaf, package, etc.), the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract. (b) Maximum order. The Contractor is not obligated to honor- (1) Any order for a single item in excess of $3,000; (2) Any single order for a combination of items in excess of $3,000; or (3) A series of orders from the same ordering office within one (1) days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section. (c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section. (d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within one (1) days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source. (End of Clause) 52.216-21 -- REQUIREMENTS (OCT 1995) (a) This is a requirements contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies or services specified in the Schedule are estimates only and are not purchased by this contract. Except as this contract may otherwise provide, if the Government's requirements do not result in orders in the quantities described as "estimated'' or "maximum" in the Schedule, that fact shall not constitute the basis for an equitable price adjustment. (b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. Subject to any limitations in the Order Limitations clause or elsewhere in this contract, the Contractor shall furnish to the Government all supplies or services specified in the Schedule and called for by orders issued in accordance with the Ordering clause. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations. (c) Except as this contract otherwise provides, the Government shall order from the Contractor all the supplies or services specified in the Schedule that are required to be purchased by the Government activity or activities specified in the Schedule. (d) The Government is not required to purchase from the Contractor requirements in excess of any limit on total orders under this contract. (e) If the Government urgently requires delivery of any quantity of an item before the earliest date that delivery may be specified under this contract, and if the Contractor will not accept an order providing for the accelerated delivery, the Government may acquire the urgently required goods or services from another source. (f) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after 30 JUN 2021. (End of Clause) 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within 7 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 14 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.
