Description
LIMITED SOURCE JUSTIFICATION This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies. (1) Agency and Contracting Activity. The requiring agency for this action is U.S. Department of Homeland Security, U.S. Customs and Border Protection (CBP) through its Procurement Directorate. (2) Nature and/or description of the action being approved. This justification restricts award of an order under FAR 8.405-6(a), Limiting Sources, to Pitney Bowes, Inc., 8245 Boone Blvd, Suite 470, Vienna, VA 22182-3828. Pitney Bowes is the only authorized distributor of the required upgrades. CBP has a requirement to upgrade and maintain proprietary software and services for mail meters, maintenance and supplies manufactured by Pitney Bowes, Incorporated for CBP officers and agents. CBP National Mail Management Program (NMMP) intends to issue a new task order on a sole source basis for twelve months with two 12 month option years pursuant to FAR Subpart 8.405-6(a) per GSA Schedule #GS-25F-0010M. (3) Description of Supplies/Services. CBP intends to maintain mailing systems equipment suitable for processing, tracking, and accounting mail types and postage usage. Each of our mailing system includes a computer, base unit, a 70lb interface scale, weigh on the weigh (WOW), a postage meter head and an IMpb label printer; meter heads are to be rented/leased from the United States Post Office. The requirement is to provide upgrades and support for Send Suite software at an initial cost of $617,318.96. The system software requires upgrades to allow integration of information from USPS and CBP systems. The manufacturer is the only one that provides this upgrade and the required technical support for a smooth transition. Quantity per year (Includes Base and Options): Note: Attachment 1 to this justification is the Independent Government Estimate which is based on current GSA pricing which is used in the price estimate below. Period Time Price Total Base Year 12 months $617,318.96 Option Period 1 12 months $96,000 Option Period 2 12 months $96,000 Total $809,318.96 (4) Identification of the justification and the rationale. Pursuant to FAR Subpart 8.405-6 (a) (1)(i)(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. (5) Determination by the ordering activity Contracting Officer that the anticipated order represents the best value consistent with 8.404(d). USCBP currently owns 140 Pitney Bowes mail metering machines nationwide. These machines were competitively purchased through a single acquisition at a cost of over $1,116,000.00. Completing regular scheduled preventive maintenance services throughout the terms of the original maintenance contract extended the serviceability of these machines an additional three (3) years. At this time, upgrading the existing meters is both practical and economical. While the postage meters can be leased from various companies, what is unique is that Pitney Bowes can service the Pitney Bowes machines and provide the required software updates to these machines. The meter reading software is proprietary to the manufacturer. Pitney Bowes is the only companies that can perform the required maintenance and up keep of the Pitney Bowes equipment. Upgrading to these units to their latest version of software saves approximate $842,380.00 vs procuring newer postal meters at a cost over $1.4 million, based on current GSA pricing. Even if a significant 25% discount were offered on the new procurement, reducing the estimated cost savings by $400,000, the cost savings would still be around $442,380.00. Also, the upgrade of the software package will enable CBP to be compliant with GSA schedule 48 as well as reducing individual learning curves if new machines were purchased. (6) A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted. Market research was conducted and there are eight vendors on the GSA schedule. Meetings were held with both Pitney Bowes and Neopost, to determine what business decisions were in the best interest of the government. Neopost only supports their software packages, and Pitney Bowes supports only their software packages. On the following page the chart compares purchasing new mail meter equipment and software to the cost of sole sourcing the upgrades to the software packages. Pitney Bowes has furnished, installed and maintained the Send Suite Software throughout the nation which has supported CBP in its ongoing mission and roles. Currently, Pitney Bowes is the only manufacture that provides this upgrade and the required support for their system. As stated earlier, the pricing for only updating the equipment is more cost effective to the Government. (7) Any other facts supporting the justification. GSA determines that the price is fair and reasonable. The contract specialist has also reviewed similar type of software packages and determined that the price is fair and reasonable. (8) A statement of actions, if any, the agency may take to remove or overcome any barriers that preclude the agency from meeting the requirements of 8.405-1 and 8.405-2 before any subsequent acquisition for the supplies or services is made. This justification and approval will be posted in Federal business opportunities website Fedbiz.gov in accordance with FAR 5.301. (9) REQUISITION/PROGRAM OFFICE CERTIFICATION I certify that the foregoing justification is accurate, meets the Government's minimum needs and contains complete information necessary to support the action described in this document and the authority cited. The guidance in HSAM Subchapter 3006.3 and HSAM Appendix G have been followed. signatures are available upon request
