Description
SOURCES SOUGHT SYNOPSIS The Contracting Officer at the U.S. Embassy in Baghdad, Iraq, is issuing this sources sought synopsis as a means of conducting market research to identify U.S. small business concerns. This would include any small businesses that have an interest, the resources and capability to competitively deliver a wide variety of items in a broad class of supplies and perform services such as construction, alteration and repair of buildings, structures, other real property, among other items and services required in support of the U.S. Mission in Iraq. FOB Destination/Place of Performance: Republic of Iraq THERE IS NO SOLICITATION AT THIS TIME. This request for capability information does not constitute a request for proposals. Submission of any information in response to this market survey is purely voluntary. The US government assumes no financial responsibility for any costs incurred. The result of this market research will contribute to determining methods of procurement. It is anticipated that any resulting awards will be firm-fixed-price per unit type contracts that place upon the contractor maximum risk and full responsibility for all costs and resulting profit or loss. The anticipated acquisitions include the following: Waste/Sewage Treatment/Removal/Disposal Services Facility/Residential Renovation/Make Ready/Painting/Construction Services General Maintenance Services - Elevator, Generator, Housing Appliances, Vehicles Gardening/Landscaping Services Janitorial Services Packing/Crating/Shipping/Transportation/Shipment Security Expediting Services Telecommunication/Telephone Wiring/Cell Phone Supply/Services Internet/Circuitry Bandwidth Lease Services Vehicle Lease Services Vehicle Insurance Services Miscellaneous residential/office furniture/appliances, textile products, office supplies in broad class, heavy lift vehicles including specialized trucks/equipment In order to assess set-aside possibilities under the above referenced NAICS code and size standard, interested parties shall identify their company (and specific, associated NAICS code(s) they fall under) as one or more of the following: 1.small business; 2.8(a) business; 3.HUB Zone small business; 4.small disadvantaged business; 5.woman-owned small business; 6.economically disadvantaged women-owned small business; or 7.service-disabled, veteran-owned small business. To demonstrate your organizations potential capacity to perform these required services, please provide the following information: 1) Organization name, address, email address, web site address, telephone number, and size and type of ownership of the organization, established business license permits and authorizations to do business in Republic of Iraq; 2) Capability statements shall address and provide with appropriate documentation supporting availability of the necessary organization, experience, operational resources, logistics assets, accounting and operational controls, and technical skills, quality assurance measures, and safety programs applicable to materials to be produced/supplied or services to be performed by the prospective contractor and subcontractors. If significant subcontracting or teaming is anticipated in order to deliver technical capability, organizations shall address the administrative and management structure of such arrangements. If subcontracting, or teaming arrangement is contemplated, then a statement of compliance with FAR clause 52.219-14, Limitations on Subcontracting (NOV 2011), is required. Prospective prime contractors are responsible for determining the capability of their prospective subcontractors. Determinations of prospective subcontractor capability may affect the Government's determination of the prospective prime contractor's capability. A prospective contractor may be required to provide written evidence of a proposed subcontractor's capability; and 3) Capacity statement shall provide capability compliance with special marketplace conditions in Iraq that mandate the following: a)All business entities working in Republic of Iraq shall be registered by the Ministry of Trade of Republic of Iraq. The Ministry of Trade is the institution of the Government of Iraq to grant tax registration, business license permits authorizing all business concerns to do business in Republic of Iraq. b)Transportation/Shipping activities in Republic of Iraq mandate possession of tax clearance issued by the Ministry of Finance - General Tax Authority. Transportation of goods requires possession of approvals from Prime Minister National Operational Center (PMNOC). c)Baghdad International Zone (IZ) - special access permits including possession of IZ badges are required to enter Baghdad International Zone. There is a variety of badges authorizing access to the IZ depending on the nature of a contract awarded by U.S. Government. Business concerns interested in doing business with the U.S. Government shall be capable of having access permit to furnish contracted deliveries or implement service performance within the IZ. To obtain badges for the IZ, one may contact the Badging Office's POC, Mr. Abdullah - Office Deputy Director, at telephone: +964- 0771 222 5456. IZ badges are subject to payment of fees. Furthermore, interested business concerns are required to investigate special business conditions, including security concerns, around and within Baghdad International Zone. d)Interested businesses shall provide a statement of knowledge for the employment of local or third country nationals (TCN) to be used for their projects in Iraq. Be advised that TCN employees are subject to residence and recruitment permits required by the Government of Iraq (GOI). Any business concern planning to use TCN employees shall be familiar with GOI's regulations with regard to sponsorship mandatory rules; and are required to apply to the Ministry of Labor and Social Affairs. Also, companies must have "established financial investment" in Iraq in order to sponsor their TCN personnel, and shall take full responsibility of TCN employees including all legal matters, all insurances, health/life, tax/revenues, security, residence/ recruitment/ permit/ and registration fees. Full reference to employment/recruitment process is provided in New Labor Law of Iraq; Also, business concern shall regard the following references: -Article 12, of the Iraqi Investment Law ("the Law") No. 13 of 2006; -Article 6 of Instructions No. 18 of 1987; -Article 3 of New Labor Law; e)Workers' compensation laws that cover local nationals and third country nationals do not exist in Iraq. Therefore, Defense Base Act (DBA) insurances will be required in accordance with FAR clauses 52.228-3 and 52.228-4. 4) All business concerns will be required to have a DUNS number and be registered in SAM/CCR through the following sites: DUNS - www.dnb.com and SAM/CCR - www.sam.gov. The government will evaluate market response to ascertain potential market capacity and small business concerns' demonstrated understanding to meet the government minimum requirements outlined above. Based on the responses to this sources sought synopsis, there may be requirements for set asides in support of U.S. Embassy Baghdad. Others may be competed utilizing the procedures of full and open competition. Telephone inquiries will not be accepted or acknowledged, and no feedback or evaluations will be provided to companies regarding their submissions. Submission Instructions: Interested parties who consider themselves qualified to perform the above-listed services are invited to submit a response to this Sources Sought Notice by June 30, 2016.
