Description
THIS IS A NOTICE OF INTENT ONLY AND NOT A REQUEST FOR COMPETITIVE PROPOSAL. The U.S Army Corps of Engineers intends to award a sole source contract to the following: Datamaxx Applied Technologies Inc SoleSource Justification OneSource/BrandName 1. Intended use of the supply of service The equipment and services procured will be used in support of a security and contractor screening and visitor access control program in support of Presidential Directive HSPD-12 and (HSPD-12, HQDA EXORD 033-15, DTM 09-12) provided by DoD headquarters.. System is in compliance with Criminal Justice Information Services (CJIS) standards and use of District's existingOriginating Agency Identifier (ORI), which connect to the FBI's National Crime Information Center (NCIC) III database. 2. The critical or unique characteristics of the supply or service which aremandatory for the intended use. The solution procured has several unique characteristics thatmake it unique in the industry. A) - the solution incorporates several patented technologies and processes which are key components to the solution and cannot be procured from any other vendor including the components of GREENLIGHT for visitor screening, I Review Now for background screening, and Omnixx for visitor screening and background checks. B) - the solution is the only cloud based solution offered by a contractor that is singularly licensed to offer the patented technology. Furthermore, the chosen provider is the only contractor that offers the solution in a hosted model within an NCIC/Nlets audited data center that provides connectivity to governmental law enforcement data networks at the national, state and local levels. HSPD-12 vetting system guests, visitors, and contractors who require access to the District's Stand Alone Facilities (SAF's). 3. Reason why only the selected "one source" or "brand name" can furnish the requirements to the exclusion of all other sources. Per FAR reference 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements. The chosen contractor due to their unique position as the patent holder, or as the only licensee of the patented products/processes incorporated as part of the integrated solution. 4. Is this a follow-on or upgrade to a previous purchase? If yes, provide the purchase order number. No. 5. Describe effortsmade to determine if other sources capable of satisfying the government'srequirementsexist: The Chief of Security and Law Enforcement for the District Headquarters researched and analyzed other solutions in use by industry and DoD installations. None of the systems evaluated are offered via a secure cloud services model from a NCIC/Nlets audited data center in a commercial of the shelf (COTS) enterprise solution encompassing all of the components required by USACE. None of the systems evaluated include any of the patented products or processes offered by the chosen solution such as GREENLIGHT, IReviewNow, and Omnixx, which are allmandatory components of the solution required to fulfill USACE securitymandates. None of the solutions offered combine the required solutions and services in an integrated single COTS solution and service offering. Researched companies such as Veristream; Proxyclick; Sine; Envoy, and others. None of these COTS solutions have the cloud based or secure patented products needed to meet the HSPD12 requirements denoted withinDOD policy. 6. Basis for determination of a fair and reasonable price: This acquisition is being procured for the first time here in the Los Angeles District, therefore procurement history is not a factor for determining fair and reasonable, however a determination of a fair and reasonable price was based on a Market Research Analysis prepared along with Commercial Service of contractors who have the capabilities to meet specific requirements documented in the SOO.
