Senior Regional Criminal Justice Program Coordinator Bamako, Mali Issuance Date: 06/16/2016 Closing Date: 07/18/2016 SOLICITATION NUMBER: PSC-16-043-INL SUBJECT A solicitation for a Personal Services Contractor (PSC), Department of State (DOS), Bureau for International Narcotics and Law Enforcement Affairs (INL) The United States Government (USG), represented by the DOS, seeks applications from US citizens interested in providing PSC services as described in this solicitation. PRE-AWARD ETHICAL RESPONSIBILITIES OF PSC (JUN 2011) This solicitation may result in the award of one or more personal services contracts as defined in FAR 2.101. Prior to contract award, all offerors or quotes must advise the cognizant Contracting Officer if they have a personal conflict of interest, such as a financial conflict, that would prevent them from either meeting the requirements of the clause entitled, "Post-Award Ethical Responsibilities of Personal Services Contractors," or otherwise objectively performing their contractual duties upon contract award. HOW TO APPLY Offerors proposal shall be in accordance with the requirements stated in this solicitation at the place and time specified. A proposal will be determined non-responsive and ineligible for consideration unless all required documents and information are included in the submission. PERIOD OF PERFORMANCE: One year from date of award, with four optional years 8. PLACE OF PERFORMANCE: Bamako, Mali 9. JOB DESCRIPTION: See below A. GENERAL STATEMENT OF THE PURPOSE OF THIS CONTRACT The Bureau of International Narcotics and Law Enforcement Affairs (INL) is part of the Under Secretariat for Civilian Security, Democracy, and Human Rights (J) within the U.S. Department of State (DOS). INL's mission is to minimize the impact of international crime and illegal drugs on the United States and its citizens through effective foreign assistance and global cooperation. INL's Office of Africa and the Middle East Programs (INL/AME) develops and manages criminal justice sector reform programs and contributes to policy formation on civilian security issues in both Africa and the Middle East. INL/AME personnel and INL personnel in-country administer U.S. government assistance under the Trans-Sahara Counterterrorism Partnership (TSCTP) to enhance the criminal justice sectors of Mali and other countries in the Sahel and INL's contribution to the Security Governance Initiative, is a new United States Presidential initiative announced by President Barack Obama at the U.S. Africa Leaders' Summit in August 2014 to enhance partner nation security institutions and processes. For the purpose of TSCTP, the Sahel is defined as Senegal, Mali, Mauritania, Burkina Faso, Niger, Nigeria, Chad, and Cameroon. TSCTP is a multi-faceted, multi-year U.S. strategy aimed at disrupting terrorist organizations by strengthening regional counterterrorism capabilities, and enhancing and institutionalizing cooperation among the region's security forces. INL's programs assist TSCTP-eligible states in the Sahel develop law enforcement capacities to confront the challenges posed by terrorist organizations, particularly al-Qaeda in the Islamic Maghreb (AQIM) and Boko Haram in Nigeria. SGI aims to help partner nations more effectively manage and address security threats that undermine common interests including social and economic progress, stability, good governance, and transnational crime, such as violent extremism and illicit trafficking. Together with SGI partner countries, INL will develop and implement joint country action plans based on consultations that identify common goals and objectives. The purpose of this personal service contract is to provide a Senior Regional Criminal Justice Program Coordinator (SRCJPC) at the U.S. Embassy Bamako. The SRCJPC will have a regional role and assist INL with oversight and management of foreign assistance programs in the Sahel amounting to approximately $14 million in FY 2011-2014 funds and potentially additional funding in future years. The SRCJPC will be responsible for: • Managing new and ongoing INL programs in Mali and other TSCTP countries in order to implement policy set by INL/Washington, the SGI Program Office and the SGI Joint Country Action Plan in Mali, and by the Country Teams of the respective embassies. • Advising and briefing U.S. Embassy Bamako, other embassies (as appropriate), and INL on criminal justice sector developments in the region, including providing periodic front channel reporting on justice sector issues. • Liaising with U.S. Embassy colleagues (including the SGI coordinator at post), program implementers, other donors and international community representatives, and host government officials with regard to civilian security programs including SGI consultations, planning, and implementation. • Ensuring INL programs advance U.S. objectives and policies, including on key areas of the strategic goals outlined in the Embassy's Integrated Country Strategy and INL, TSCTP, and SGI strategies. • Providing internal control and accountability for the delivery of equipment, training, and other assistance through TSCTP, SGI, and other INL programs in TSCTP countries. • Briefing U.S. embassy officials and other U.S. government officials on programming and progress. B. DUTIES AND RESPONSIBILITIES Substantive 1. Develops and manages effective INL programs in line with INL policy and priorities. 2. Advises respective U.S. embassies and INL/AME on local and regional developments in the criminal justice sector in subject areas including, but not limited to, anticorruption, law enforcement, justice sector, and rule of law. Identify potential areas of development for future programs that will fulfill INL's goals and objectives. Ensure that the U.S. Government is fully informed on the capabilities, capacity, performance, and opportunities with regard to all elements of the host governments' criminal justice sectors, including through periodic front channel reporting. 3. Advises respective embassies and INL/AME on the performance of host government agencies and implementing partners operating in conjunction with INL assets and resources. Evaluate progress towards results and recommend program improvements. 4. Engages with host government officials, including on key areas of the strategic goals outlined in the Embassy's Integrated Country Strategy and INL, TSCTP, and SGI strategies, to help them determine how best to develop their institutions so as to contribute to a more just society related to both TSCTP and SGI initiatives. Generates support for and actively advance U.S. policy objectives with key stakeholders, including host government officials, civil society, the media, and other influential leaders in the private sector. 5. Maintains necessary professional relationships with implementers, host government agencies, international organizations and commissions, civil society actors, and other important partners in the fight against transnational crime and drug trafficking. Act as liaison between these entities and other components of the U.S. Mission(s). 6. Liaises with and assists implementers, as well as potential implementers, to develop results-oriented proposals to advance SGI, TSCTP, and other INL priorities while ensuring that no commitments of USG funds are made prior to the proposal evaluation process. 7. Assists in the preparation of such reporting as the annual budget request for International Narcotics Control and Law Enforcement (INCLE) funds and the Mission Resource Requests. Coordinate annual reporting requirements for INL (e.g., the INCSR parts I and II, the End-Use Monitoring Report, etc.). Prepare program documentation and procurement requirements for assistance projects. Help prepare and ensure quality of regular reporting, and create monthly status reports for INL/AME. 8. Briefs Department, Congressional, and other international dignitaries orally and in writing on INL programs in host countries. Prepare documents for presentation to the U.S. Congress, or audit entities. Develop appropriate itineraries and accommodations for official travelers, as necessary. 9. Drafts terms of reference for personnel involved in SGI law-enforcement related assessments and program implementation, and works with implementing agencies to draft scopes of work for SGI-related assistance as required. 10. Assists in preparations for SGI technical assistance visits, including liaising between funding and implementing agency, Embassy Country Team, Partner Country personnel, and the SGI Program Office Managerial 1. Establishes and maintains appropriate internal management control systems. Ensure that INL programs are not subject to waste, fraud, or mismanagement. Help manage and monitor the use of all U.S.-provided commodities. 2. Provides analysis and guidance in project budget preparation as well as program planning. 3. Conducts or commissions field surveys, evaluations, and special studies, as directed. 4. Maintains security awareness and properly handle classified and controlled items and information. 5. Supervises locally employed staff if/when INL and post determine such additional staff is necessary. Provide guidance to Resident Legal Advisor and Senior Law Enforcement Advisor positions in Mali. B.-1 TRAININGS & DISTANCE LEARNING COURSES 1. Completes the Contracting Officer Representative (PA296) distance-learning (DL) course through the Foreign Service Institute (FSI) within 120 of arriving at Post. 2. Completes the Introduction to Working in an Embassy (PN113) distance-learning (DL) course through the Foreign Service Institute (FSI) within the first six (6) months of arriving at Post. 3. Completes the mandatory Foreign Affairs Counter-Threat (FACT) Course (OT610) prior to deployment to Post. C. RELATIONSHIPS The SRCJPC reports to the Political/Economic Section Chief and sends reports simultaneously to the Political/Economic Section Chief, the DCM, and the INL/AME Mali program officer(s) in Washington, DC. The SRCJPC advises Chief of Mission and DCM on criminal just sector issues including recommending diplomatic and programming engagement to meet U.S. policy objectives and periodic front channel reporting. The SRCJPC is a member of country team. The SRCJPC coordinates with other components of Embassy Bamako, including POL, RSO, DOJ, OSC, USAID, and others. The CJPC liaises with actors in the region working to strengthen criminal justice institutions. These actors include U.S. government officials, host government contacts, civil society organizations, academic institutions, other donors and international organizations or commissions. Specific activities will frequently originate from these liaison activities. The SRCJPC consults with INL/AME on how to design and manage effective programs. The SRCJPC exercises independent judgment to develop new and improved methods to analyze and review INL programs throughout the TSCTP region, noting new and unforeseen gaps and opportunities as circumstances evolve. The SRCJPC provides supervision and coordination for INL programs in the TSCTP region, including the senior law enforcement advisor and resident legal advisor in Bamako. The SRCJPC exercises a significant degree of judgment and independent action in developing and coordinating priorities related to the Malian and regional criminal justice sectors. The SRCJPC's rater is the Political/Economic Section Chief, with input from INL/AME. The Contracting Officer's Representative (COR) is delegated the authority to act for the Contracting Officer in matters concerning technical clarification, inspection and, after concurrence by the Contracting Officer, acceptance of Contractor performance under the contract, including preparation of receiving reports, and the authorization of progress payments when appropriate. The COR will coordinate all work with the Contractor and review Contractor's performance at significant stages of its development. In no instance, however, shall the COR be authorized to alter or modify the specifications or the contract terms and the conditions or waive the government's requirement, price, delivery, or other terms and conditions. Such changes must be authorized, in writing, to the Contracting Officer. D. DELIVERABLES Deliverables are required under this PSC and shall include; monthly status reports, monthly evaluation of contractor performance, special reports when required and "Completion of assignment report," which shall be a compressive review of the projects in which the contractor was involved. Each report shall include and overall justice sector policy update and accomplishments, critique, and recommendations for the various projects. The completions of assignment reports are due no later than fifteen (15) days prior to the expiration of this contract. The Personal Service Contractor shall submit two (2) copies of each report as required to the following; 1. The Political/Economic Section Chief and; 2. INL/Program Officer Per FAR Part 4, the above referenced documents shall be incorporated and copies stored in the PSC's hard file under Section V.; Tab E - Receiving Reports. The Contractor shall prepare and submit two copies of each technical report required by the schedule of this contract (e.g., progress reports, final reports, etc.), to the Embassy INL Section and to the Program Officer, Bureau of International Narcotics and Law Enforcement Affairs (INL), Department of State Washington, DC. The title page of all reports forwarded pursuant to this paragraph shall include a descriptive title, the author's name(s), contract number, project number, and title, contractor's name, name of the State Department project office, and the publication or issuance date of the report. When preparing reports, the Contractor shall refrain from using elaborate artwork, multicolor printing, and expensive paper/binding, unless it is specifically authorized in the Contract Schedule. Wherever possible, pages should be printed on both sides using single spaced type. E. MINIMUM REQUIREMENTS 1. U.S. citizenship, able to obtain and maintain DOS Secret security and medical clearances. 2. Demonstrated Three (3) years of experience working with the U.S. government in a foreign affairs role, an international organization, or a large international non-governmental organization. 3. Demonstrated Five (5) years of experience in program design, program management, monitoring and evaluation on international development programs. At least two (2) years of this experience should directly relate to governance or the criminal justice system (law enforcement, judicial reform/access to justice, corrections). 4. Demonstrated three (3) years of professional experience in a developing country, preferably in West Africa. 5. Graduated from an accredited institution (preferably in the areas of law, business management, international development, international affairs, political science, public administration, or a related field) or equivalent in practical experience. 6. Demonstrated experience in drafting complex, analytical briefing papers, memoranda, letters, and reports for senior officials or equivalent. 7. Demonstrated experience in working with international development programs, including drafting related reports/documents, annual budgets, and strategic plan submissions. 8. Superior negotiation, interpersonal and managerial skills. 9. Excellent oral and written English communication skills. 10. Oral and written French proficiency at a professional working level. 11. Demonstrated experience in planning, strategizing, implementing and reporting on projects, including familiarity with basic requirements and mechanisms for contract management and procurement. 12. Working-level proficiency in Microsoft Office Suite. F. PREFERRED KNOWLEDGE AND SKILLS 1. Substantive knowledge of and experience within African of rule of law or law enforcement programs. Experience in civil code systems is highly valued. 2. Previous experience managing U.S. government assistance programs and working with a U.S. Embassy or USAID Mission. 3. Previous experience in West Africa. G. TRAVEL REQUIREMENTS The SRCJPC resides in Bamako and travel and work primarily in three to five TSCTP countries, as circumstances dictate and allow. H. PRE-DEPLOYMENT REQUIREMENTS If applicable - Consultations with the INL Program Office may be required. I. EVALUATION FACTORS Factor 1: Program Management (30 Points) Demonstrated experience in program management, especially in international governance, rule of law, and/or criminal justice sector programs to include experience involving analytical, planning, management, advisory, operational, or evaluative duties as well as multi-donor and interagency coordination. Experience with U.S. government budget cycles and programming, particularly in Embassies overseas, is an important part of this factor. Factor 2: Interpersonal Relations (20 Points) Demonstrated experience in conducting meetings and discussions that justify, defend, negotiate, overcome resistance or settle highly significant or controversial issues; to include experience coordinating and/or integrating the work of participating groups with conflicting or undefined priorities, requiring accomplishment of major compromises in the project goals, techniques and methodologies prior to substantial progress. Factor 3: International Experience (20 Points) Demonstrated experience managing programs in foreign, post-conflict environments; to include ability to live, work, and travel in difficult conditions with limited support, manage programs in a complex and fluid environment, interact successfully across culture, and show good judgment in challenging security situations. Experience working with the U.S. government, particularly in Embassies overseas, is an important part of this factor. Factor 4: Written Communication (15 Points) Demonstrated independent experience in preparing and writing reports, audits, memoranda, etc., in English and French, in a subject area related to the duties of the position; to include reports and decision papers requiring independent analysis and having a significant impact in the program area on an international level. Factor 5: Past Performance (15 Points) Evaluation of applicant's ability to perform under the same or similar contracts. (In conducting the evaluation, the Government reserves the right to utilize all evaluation information available at the time of evaluation, whether provided by the applicant or obtained from other sources.) COMPENSATION (BASE PAY) For award, INL will negotiate for this contract based on the market value as outlined above and overall experience relevant to the solicitation requirements.
