- Draft MSPIC SOW MSPIC Sources Sought Notice The Centers for Medicare & Medicaid Services (CMS), Office of Financial Management, Financial Services Group, Division of Medicare Secondary Payer Program Operations, has responsibility under the Medicare Secondary Payer (MSP) provisions of the Social Security Act Section 1862(b) [42 U.S.C. 1395(y)(b)] to protect Medicare's interests by ensuring that Medicare correctly pays and recovers payments when conditional or incorrect payments have been made. In addition to stipulating that Medicare pays claims only as primary when appropriate, the MSP provisions, in part, prohibit Medicare from making payment where payment has been made, or can reasonably be expected to be made, by liability insurance (including self-insurance), no-fault insurance, or a workers' compensation plan or policy. Further, CMS's Division of Medicare Secondary Payer Program Operations has the responsibility for managing the national Coordination of Benefits Agreement (COBA) Medicare crossover process, which results in the annual transfer of over 800 million adjudicated Medicare Fee-For-Service Part A and B claims to supplemental insurance and other benefit programs that pay after Medicare. The Medicare Secondary Payer Integration Contractor (MSPIC) is one of several contractors contracting with CMS as part of the Coordination of Benefits and Recovery (COB&R) program. This work is currently being performed by way of a task order awarded pursuant to the General Services Administration's (GSA) Mission and Business Integrated Services (MOBIS) schedule contract. The other COB&R program contractors with which the MSPIC regularly interacts include the Benefits Coordination & Recovery Center (BCRC), the Commercial Repayment Center (CRC), the Medicare Secondary Payer Systems Contractor (MSPSC), and the Workers' Compensation Review Contractor (WCRC).
