- SOW This is a pre-solicitation and a notice of intent to sole source for commercial items prepared in accordance with FAR Parts 12 and 13.5. It is the intent of the National Institutes of Health (NIH), National Library of Medicine (NLM) under the authority of FAR 6.302-1 to procure for the Office of Research Information Systems (ORIS) the use of software license subscription, support services and maintenance from Elsevier software currently in use by the Research, Condition, and Disease Categorization (RCDC) System and additional use as warranted by the NIH community and in concert with other government agencies. The North American Industry Classification System Code is 541511 and the business size standard is $27.5 million. This is not a 100% small business set-aside. The Contractor shall provide software license subscription and maintenance services for the RCDC System. TASKS The Contractor shall: • 2.1 - Provide RCDC with a software license subscription, support services and maintenance for the Fingerprint Engine software • 2.2 - Provide a subscription to the Elsevier Fingerprint Engine software license for use by RCDC and NIH in concert with other government agencies. • 2.3 - Provide software maintenance services as follows on an as needed basis: o 2.3.1 Error Correction - The contractor shall exercise commercially reasonable efforts to correct any error reported by RCDC in the previous sequential release, previous sequential version or the then current release or version and in accordance with the priority level assigned by the software manufacturer to such errors as follows: o 2.3.2 Level 1 Errors - The contractor shall commence an investigation of a Level 1 Error within four (4) hours written notice by RCDC or other federal designated staff and initiate the development of Error Corrections immediately thereafter. The contractor shall promptly commence the following procedures: Assign contractor engineers to correct the Error; Notify eRA management that such Errors have been reported and steps that are being taken to correct such Error(s); Provide RCDC with periodic reports on the status of the corrections; and Initiate work to provide RCDC with a Fix or, if agreed upon by RCDC, a Workaround. o 2.3.3 Level 2 Errors - The contractor shall commence an investigation of a Level 2 Error within forty-eight (48) hours of notice by RCDC and initiate the development of Error Corrections immediately thereafter. The contractor shall exercise commercially reasonable efforts to provide an error correction to RCDC. The contractor shall exercise commercially reasonable efforts to include the error correction for the error in the next software release. o 2.3.4 Level 3 Errors - The contractor shall commence an investigation of a Level 3 Error within fifteen (15) days of notice by RCDC and initiate the development of Error Corrections immediately thereafter. The contractor shall exercise commercially reasonable efforts to provide an Error Correction to RCDC. The contractor shall exercise commercially reasonable efforts to include the Error correction for the Error in the next Software Release. • 2.4 - Telephone Support. The contractor shall provide technical support telephone assistance to RCDC's designated technical support personnel during normal business hours concerning the installation and use of the Previous Sequential Release, Previous Sequential Version or the then current Release or Version in accordance with the Documentation relating thereto. • 2.5 Maintenance Unrelated to the Software - If contractor determines that a problem reported by RCDC may not be due to an Error in the Software, the contractor shall notify RCDC in writing. • 2.6 - The Contractor shall provide additional telephone support during normal business hours. This additional support shall cover technical issues of the Elsevier FingerPrint Engine software that are outside of the error correction support identified in Section 2.0. • 2.7 - Regular meetings shall be held with the COR and contractor staff to ensure adequate progress is being made. These meetings may be in-person or may use teleconferencing or web-based approaches. SOLE SOURCE JUSTIFICATION Each year NIH has a statutory requirement to report how much it spends on various diseases, conditions, and other research areas. This information is presented in various budget documents, as well as on the NIH Office of Budget web site and in response to ad hoc requests from within the Executive Branch, Congress, constituent groups, and others. The RCDC enterprise information system has been designed to use the Elsevier text mining tool (proprietary software) to classify each document by a technique known as fingerprinting, which extracts from the text a set of concepts using a domain-specific taxonomy. By comparing a grant's fingerprint to all the disease fingerprints, the most appropriate disease code for the document can be identified. Elsevier provides licensing for the use of their software and technical support and maintenance of the licensed product. The RCDC system provides the data to fulfill this requirement and the RCDC enterprise system cannot function without the Elsevier software. Elsevier is the only company that provides licensing and support of the text mining software. This is not a Request for Quotation (RFQ), nor is a RFQ available; however, all responsive sources may submit a capability statement in a timely manner which will be considered by NLM. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Firms interested in responding to this notice must be able to provide the referenced service as specified above. Responses must be in writing and must be received electronically at the Government infrastructure by 3:00 PM EST on June 28, 2016. Capability Statements must include pricing information and should reference NIH-LM-2016800 - Elsevier Fingerprint Engine Software License Subscription and Maintenance Services for the Research, Condition, and Disease Categorization (RCDC) System and should be submitted to briscoee@mail.nih.gov.
