- Federal Emergency Management Agency (FEMA)/ Federal Insurance and Mitigation Administration (FIMA) intends to execute a Justification & Approval for Sole Source and Limited Competition (J&A) to commission the Mitigation Saves 2.0: An Independent Study on Savings Associated with Public and Private Mitigation. FIMA intends to exercise its authority provided by Homeland Security Acquisition Manual (HSAM) 3036.212-70 and contract with National Institute of Building Sciences (NIBS) for the completion of the Study. Per HSAM 3036.212-70(b), "Section 809(g)(3) of Public Law 93-383 expressly authorizes agencies and departments to contract with NIBS. In this regard, the exception to full and open competition at FAR 6.302-5 may be used, if the contracting officer determines this to be an appropriate exception, to award such contracts." The proposed J&A will be executed under the authority contained in Federal Acquisition Regulation (FAR) 6.302-5. This authority provides for an exception to competition "A statute expressly authorizes or requires that the acquisition be made through another agency or from a specified source." The proposed approval of this J&A under the aforementioned authority will allow FIMA to fulfill its mission to reduce the Nation's Vulnerability to the impacts of disasters by providing critical insight to assist in decision-making for future hazard mitigation activities. FIMA requires the NIBS to update its original study of 2005 by analyzing again the FEMA grant data, including data from hazards that have occurred since then and consider future conditions information along with updated methodologies based on lessons learned over the past 11 years. Additionally, the new study will quantify the benefits of above-code design for construction that exceeds the minimum requirements of the International Building Code, creating a more comprehensive understanding of the benefits obtained by society for undertaking hazard mitigation. These results will serve to advance FEMA's strategic mission to reduce the loss of life and property that can occur in disasters. This notice does not obligate the Government to award a contract; nor does it restrict the Government's ultimate approach. The point of contact for this requirement is Contracting Officer, Marianne McCallum. This is not a request for proposals. However, the Government may consider all expressions of interest received within fifteen (15) calendar days after date of publication of this notice. A determination not to compete this proposed contract modification based upon responses to this notice, if any, is solely within the discretion of the Government. Information or responses received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Therefore, any responses to this notice must demonstrate clear and convincing evidence that competition would be advantageous to FEMA and would not hinder FEMA/FIMA objectives.
