Description
LIMITED-SOURCES JUSTIFICATION 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724 2. Description of Action: The proposed action is for a firm-fixed-price task order, issued on a sole source basis to Fedmine, LLC (Fedmine), 13708 Ginkgo Terrace, Rockville, Maryland 20850 under its contract number GS-35F-0267X on the General Services Administration (GSA) Federal Supply Schedule (FSS) 70, Special Item Number (SIN) 132-52. 3. Description of the Supplies or Services: The proposed action is for 50 Fedmine FD GovPro software licenses for a commercial-off-the-shelf market research data analytics package, maintenance and technical support, and unlimited data downloads for report data for VA, Office of Small and Disadvantaged Business Utilization (OSDBU). This product provides consolidated reporting based on multiple years of data from multiple sources, including the Federal Procurement Data System-Next Generation (FPDS-NG), Federal Business Opportunities (FBO), Grants.gov, and the Government Accountability Office's (GAO's) protest database. The period of performance shall be June 27, 2016 through June 26, 2017. 4. Authority Cited: This acquisition is conducted under the authority of the Multiple-Award Schedule Program. The specific authority providing for a limited source award is Federal Acquisition Regulation (FAR) Part 8.405-6(a)(1)(i)(B), "Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized." 5. Rationale Supporting Use of Authority Cited Above: Fedmine, through utilization of a proprietary algorithm, is the only source that can provide data mining from thirteen separate systems, including FPDS-NG, FBO, Grants.gov, and GAO's protest database. The required Fedmine FD GovPro software is not available through resellers. This data mining system is currently being utilized by OSDBU. However, the current software licenses will expire on June 26, 2016. Fedmine's proprietary algorithm sysmem to datamine procurement, past performance, and corporate data and provide customizable reports to VA is currently being utilized by OSDBU for goaling support and market research assistance to contracting and program offices throughout VA. Data is near real time and provides the information necessary to enable contracting and program offices to make accurate decisions about the availability and capability of Service-Disabled Veteran-Owned Small Businesses (SDVOSB's) and VOSB's. It is used by senior management at VA to assist with the small business goaling process. Failure to provide timely decision support data to management may result in the increased risk of VA failing to meet statutory requirements for small business participation in procurements. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. This effort did not yield any additional sources that can meet the Government's requirements. There is no competition anticipated for this acquisition. In accordance with FAR 5.301 and 8.405-6(a)(2), this action will be synopsized at award on the Federal Business Opportunities Page (FBO) and the justification will be made publicly available. 7. Actions to Increase Competition: OSDBU technical experts will continue to monitor the availability of wireless voice and data services that can meet VA's requirements in the future. 8. Market Research: Federal Acquisition Regulation (FAR) 8.004(a)(2) encourages Government agencies to consider satisfying services requirements through GSA FSS if the Government is unable to satisfy the requirement through the mandatory sources at FAR 8.002 and 8.003. GSA FSS 70 (General Purpose Commercial Information Technology Equipment, Software, and Services) is a suitable vehicle for the acquisition of the desired services. Services of this type are available on GSA FSS 70 SIN 132-52 (Electronic Commerce and Subscription Services).The Contract Specialist conducted market research by posting a Request for Information on the GSA FSS eBuy website to Schedule 70 SIN 132-52 contract holders on June 13, 2016. Only one response was was received; from Fedmine. VA's technical experts reviewed the response from Fedmine and determined that it met VA's requirement. Additional market research was conducted by the Contract Specialist in June 2016 utilizing the National Aeronautics and Space Administration Solutions for Enterprise-Wide Procurement V Governmentwide Acquisition Contract Provider Look-up tool. The results of the research found that there are no contract holders to provide the Fedmine FD GovPro software licenses, maintenance and technical support, and unlimited data downloads for report data. The Veterans Technology Services Governmentwide Acquisition Contract was previously researched and not considered appropriate for this acquisition as it is not for the design, development, or maintenance of an information technology system. 9.
