- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>$150K) Acquisition Plan Action ID:_ VA244-15-AP-3191 1.Contracting Activity: Department of Veterans Affairs, VISN 04, (562) Erie VA Medical Center, Erie, Pennsylvania, 16504, Network Contracting Office 4; 542-16-2-063-0001. 2.Nature and/or Description of the Action Being Processed: This is a short term sole source contract follow on to the Regional Cancer Center's (RCC) on-site oncology services contract VA244-P-1647. This bridge contract action will allow for more time to complete the Oncologist physician hiring process which is currently underway and is expected to be completed within the next 90 days. This will be a fixed price contract. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The contractor shall provide board certified Oncologist physician to render patient care and conduct weekly outpatient clinics each Thursday for from 8:00 AM to 4:30 PM. These clinics will include outpatient services such as patient assessment, staging, reassessment, treatment protocols, chemotherapy clinics, and oncology clinics. Anticipated period of performance is July 1, 2016 through September 30, 2016. The total anticipated hours of services to be rendered is 125. The total value of the three month bridge contract is approximately $36,125.00. 4.Statutory Authority Permitting Other than Full and Open Competition: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This contractor is currently providing oncologist physician coverage for the Erie VA Medical Center. The contractor's physicians are the only oncologists credentialed and privileged at the medical center to provide these services. Same physicians have access to the requisite computer systems, and have the necessary user accounts to allow for patient care reporting into the CPRS patient record system. This bridge contract action will allow for more time to complete the Oncologist physician hiring process which is currently underway and is expected to be completed within the next 90 days. Without the services of RCC Oncologist physicians, patient care would be impacted severely, as the Erie VA Medical Center would not be able to provide care on-site and continuity of care would be compromised. Ongoing oncology services to Veterans cannot be interrupted under any circumstances. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Hiring of Oncologist physicians will be completed during this bridge contract. A competitive solicitation for these services is not intended or anticipated. Hiring will remove the need for a contract. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Unit prices under the three month contract are as follows: Outpatient services to include patient assessment, staging, reassessment, treatment protocols, chemotherapy clinics, and oncology clinics - 125 hours @ $289.00 = $36,125.00. Above prices are determined to be fair and reasonable based on them being equal to prices under option year IV of contract VA244-P-1647 which were previously determined to be fair and reasonable by a Contracting Officer based upon market comparisons and prices being submitted under the expectation of competition. Furthermore market research indicates that hourly rates for Oncologists physicians rendering services under the contemplated contract are comparable to hourly rates for Oncologists who work in an academic environment as physician educators whose salaries are surveyed by the Association of American Medical Colleges (AAMC). AAMC salary survey for 2012 showed that the mean average for Professors was $318.90 per hour. Oncologists providing services under the current contract, and the contemplated bridge contract, participate in research and education and are comparable to professors in an academic environment. The contemplated contract rate of $289.00 per hour is then what the general market place could expect to pay for the same or similar services. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research has been conducted. While a competitive solicitation is not intended, the following institutional providers of oncology and related cancer care within the Erie VA Medical Center's catchment area have been identified: "Regional Cancer Center (Incumbent Contractor) (RCC). "University of Pittsburgh Medical Center (UPMC) Hamot, Erie, PA. "St. Vincent Hospital and Infusion Center of the Allegheny Health Network (St. Vincent), Erie, PA. "Meadville Medical Center-Yolanda G. Barco Oncology Institute, Meadville, PA. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: None at this time. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None at this time. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: As noted above, hiring of physicians is underway and no competitive contract effort is planned. This bridge contract will allow for no lapse in service so that patient care will not be compromised.
