Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. Quotes are being requested; a written solicitation will not be issued. Solicitation No. W15QKN-16-Q-1115 is issued as a request for quotation (RFQ) and incorporated provisions and clauses are those in effect through the Federal Acquisition Circular 2005-61. This requirement has been set-aside for small businesses under NAICS code 325920 with a small business size standard of 750. The U.S. Army Contracting Command (ACC-NJ), Picatinny Arsenal, NJ intends to award one (1) firm-fixed-price (FFP) purchase order, on a competitive basis, for pentolite explosive pellets to support impact characterization of energetic materials, in accordance with the following Statement of Work (SOW): Statement of Work For Purchase of Pentolite Pellets 1.0 BACKGROUND / SCOPE. To support the conduct of US Army operations worldwide, the US Army Armaments, Research, Development and Engineering Center (ARDEC) at Picatinny Arsenal uses a variety of test protocols to characterize energetic materials. Among these protocols are a number of impact tests, including the Naval Ordnance Laboratory (NOL) Card Gap Tests. These tests are widely used in the energetics community to determine shock sensitivity. The test requires the use of pentolite explosive pellets. The ARDEC stockpile of pentolite pellets is low due to the ubiquitous use of these tests. 2.0 APPLICABLE DOCUMENTS AMCR 385-100 Army Materiel Command Safety Manual 10 October 2008 JAN-P-408 Pentolite 50/50 8 January 2014 STANAG 4488, Ed 2 Explosives, Shock Sensitivity Tests 27 April 2009 3.0 REQUIREMENTS. During the course of execution of this scope of work, the contractor shall use AMCR 385-100 or equivalent as a guide for his operations. 3.1 The contractor shall manufacture 1500 Pentolite pellets, size 2 inches by 2 inches. The pellets shall be capable of use in NOL large scale card gap test as specified STANAG 4488. 3.3 The contractor shall manufacture 1030 Pentolite pellets, size 3.75 inches by 1.875 inches. The pellets shall be capable of use in NOL large scale card gap test as specified in STANAG 4488. 3.4 The pellets shall conform to the applicable requirements of JAN-P-408 and STANAG 4488. 3.5 A pre-production sample of 10 each pellets of both sizes above (a total of 20 pellets) will be required for inspection at the contractor's production location. The government reserves the right to waive this requirement at its sole option. 3.6 All production pellets shall be delivered FOB Destination. The contractor shall deliver the required quantity of pellets within ninety days of contract award. 3.7 The period of performance for all activities under this scope of work is 12 months. 3.8 The contractor shall report immediately any major accident/incident (including fire) resulting in any one or more of the following: causing one or more fatalities or one or more disabling injuries; any incident involving government personnel or property; damage of government property exceeding $10,000; affecting program planning or production schedules; degrading the safety of equipment under contract, such that personal injury or property damage may be involved; identifying a potential hazard requiring corrective action. The contractor shall prepare the report in accordance with CDRL A001 (DI-SAFT-81563) for each incident. 3.9 The contractor shall supply a Certificate of Compliance in accordance with CDRL A002 (DI-MISC-81356A) for all shipments. 3.10 This purchase is Unclassified. The following Federal Acquisition Regulation (FAR) and Defense FAR Supplement (DFARS) provisions/clauses are applicable and are incorporated by reference: FAR: 52.204-7, 52.204-13, 52.204-18, 52.212-1 (addenda below), 52.212-3, 52.212-4, and 52.246-2. FAR 52.212-5 applies along with the following additional clauses under FAR 52.212-5: 52.219-28, 52.222-3, 52.222-19, 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.222-50, 52.225-13, 52.232-33, 52.233-3, 52.233-4, 52.247-34 and DFARS: 252.203-7002, 252.204-7002, 252.212-7000, 52.215-4005, 252.212-7001, 252-232-7006, 252.236-7006, and 252.232-7010. The following additional DFARS clauses under 252.212-7001 also apply to this acquisition; 252.203-7000, 252.225-7036, 252.232-7003 and 252.247-7023 Alt III. The offerors quote shall be labeled in a consistent manner with this document. All references to the Statement of Work (SOW) shall be clearly labeled with the appropriate SOW paragraph. Offerors are expected to submit a quote in sufficient detail to allow the Government evaluation without the need for further clarifications. The Government does not assume the duty to search for data to cure problems it finds in quotes. The burden of proving acceptability remains with the offerors. General: The quote shall be presented in sufficient detail to allow Government evaluation of the response to the requirements of the request for quote (RFQ). The Government will not assume offerors possess any capability, understanding, or commitment not specified in the quote. All inquiries/questions concerning this procurement, either technical or contractual, must be submitted via email to the Contracting Office, phone call inquiries will NOT be accepted. No direct discussion between the technical representative and a prospective offeror will be conducted. Basis for Award The Government will award one contract for the supplies specified in the Statement of Work. The evaluation of quotes shall be conducted utilizing the lowest priced technically acceptable evaluation approach. Selection of the quote for award will be based on an evaluation of quotes in the areas of Technical and Price, with award being made to the offeror whose quote is the lowest priced and is technically acceptable. Under this evaluation approach, an offeror would not receive any additional credit for exceeding the established minimum defined requirements of technical acceptability. 1.1 Discussions The Government intends to evaluate quotes and award a contract without discussions with offerors. Therefore, the offeror's initial quote should contain the offeror's best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. 2. Areas to be Evaluated: (1) Technical (2) Price 3. Evaluation Approach Careful, complete, and impartial consideration will be given to all quotes received pursuant to this RFQ. A team of Government personnel will evaluate each quote in the areas described below. (1) Technical: The quoter's technical portion of the quote will be rated acceptable or unacceptable based on assessment of the stated minimum requirements below. These items are deemed critical to meet the Government's requirement. If any one of these requirements is rated as unacceptable this will result in an overall technical rating of unacceptable and the quote will not be considered any further. The following adjectival rating will be utilized in the evaluation of Technical: RATING DESCRIPTION Acceptable Proposal clearly meets the minimum requirements of the solicitation Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation In order for a quote to be deemed acceptable it must meet the following minimum criteria: • All characteristics listed in the scope of work must be met, including pentolite assay and other characteristics. • All dimensional characteristics must be met. (2) Price: The quoted unit price will be evaluated for reasonableness. Price Inconsistencies: A quote is presumed to represent an offeror's best effort to respond to the solicitation. Any inconsistency, whether real or apparent, between promised performance and price, shall be explained in the quote. Any significant inconsistencies, if unexplained, raise a fundamental issue of the offeror's understanding of the nature and scope or the work required and their financial ability to perform the contract, and may be grounds for rejection of the quote.
