Description
•1. On page 36 of 122, part E-9, paragraph B., 1., add sub- paragraph at B., 1., as follows: "(a) Any product that is offered to the Government that has been produced using a bulk product or an ingredient product lot(s) that has, at any time, been identified as containing or having contained evidence of insect or rodent activity must be approved by FTR. When product is presented for Government verification, the Government QAR must be informed and provided documentation identifying the evidence of insect or rodent activity and all corrective action taken to render the bulk/ingredient product serviceable." •2. On page 22 of 122, under X. INSPECTION AND ACCEPTANCE REQUIREMENTS delete"DLAD 52.246-9023 is incorporated in full text in this solicitation and resultant contracts(s). In addition, the following procedures will be used for inspection and acceptance. If there is a conflict between the following inspection and acceptance procedures and those stated in DLAD 52.246-9023, then the provisions cited in the following inspection and acceptance procedures shall control." Replace with: "DLAD 52.246-9023 is incorporated by reference in this solicitation and the resultant contract(s). In addition, the following procedures will be used for inspection and acceptance. If there is a conflict between the following inspection and acceptance procedures and those stated in DLAD 52.246-9023, then the provisions cited in the following inspection and acceptance procedures shall control. The inspection and acceptance procedures shall be as follows:" •3. Please refer to Section I, I-4 Surge and Sustainment Plan, specifically page 105 and Section L-5. The solicitation incorrectly references Section L-4, and that will be updated via an amendment. 4. FAR 52.216-19 -- Order Limitations (Oct 1995) (a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than _ one case [insert dollar figure or quantity], the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract. (b) Maximum order. The Contractor is not obligated to honor -- (1) Any order for a single item in excess of 150% of the estimated quantity of that single line item; (2) Any order for a combination of items in excess of 150% of the estimated quantity of the combination of those line items; or (3) A series of orders from the same ordering office within __60_days that together call for quantities exceeding the limitation in subparagraph (b) (1) or (2) of this section. (c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216- 21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section. (d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any ord exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within __60___days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source. * Minimum quantity requirement over 12 months unless S&S is invoked. ** Aggregate minimum quantity requirement of all items over 12 months. 5. On page 50 of 122: Add "52.246-9003 Measuring and Test Equipment (JAN 2014) DLAD" Delete "52.246-9000 Certificate of Quality Compliance (DEC 1994) DLAD" Delete "52.246-9002 Product Certification and Test Report(s) (Metals) (JUL 2008) DLAD" Delete "52.246-9008 Inspection and Acceptance at Origin (NOV 2011) DLAD" 6. On page 43, Section H Special Contract Requirements delete "Terms and conditions of the individual component contract shall prevail in case of a conflict between the individual contracts and one(s) resulting from this solicitation." Replace with "Terms and conditions of the individual component contract (i.e. RNCs) shall prevail in case of a conflict between the individual component contracts and contracts with the three Assemblers.
