- This is a Notice of Proposed Contract Action under FAR Part 12 Acquisition of Commercial Items and FAR Part 13 Simplified Acquisition Procedures. This notice is for information only; a solicitation will not be issued. THIS IS NOT A REQUEST FOR QUOTATION. No contract will be awarded on the basis of offers received in response to this notice. The associated North American Industry Classification System (NAICS) code is 511210 with a small business size standard of $38.5M average annual receipts. AFRL requires five (5) one (1) year licenses of Cobalt Strike software to include electronic delivery, one license key per user (used for updates while valid) and email support for Cobalt Strike products for the duration of the license. The government intends to negotiate a sole source contract with Strategic Cyber, LLC, 1875 Connecticut Ave NW, Washington, DC 20009-5728. The government has determined that there are no third party resellers of this product. Strategic Cyber LLC is the sole authorized provider of the Cobalt Strike software. Strategic Cyber LLC manufacturers the product and provides support to its licensed users. The government requires the Cobalt Strike software due to the capabilities of the beacon -asynchronous software for emulating advanced, malicious communications and the malleable command and control (C2) enabling the communication replication. Using manual capability employment or alternative, degraded threat emulation software would not be cost effective and impact day to day operations as well as an additional 300 man hours to reproduce capabilities offered through the Cobalt Strike software. This is a notice of proposed contract action and not a request for competitive quotes; however, all responsible sources may submit a capability statement and/or market pricing, which shall be considered by the agency. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. Responses received will be evaluated; however a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. The Government anticipates an award date on or before 1 August 2016.
