- NOTICE OF INTENT TO SOLE SOURCE The Centers for Disease Control and Prevention (CDC) is responsible for conducting acquisitions in support of the National Institute for Occupational Safety and Health (NIOSH). NIOSH has a requirement entitled "MSHA approved, permissible ultra-high frequency (UHF) network" which is needed to provide coverage to entire mine for daily use as well as in emergencies. Per the MINER Act, NIOSH is required to procure a MSHA approved, permissible, node-based, UHF wireless communications and tracking network system for the Safety Research coal mine. The CDC intends to award on a sole source basis to the manufacturer which previously installed a permissible node-based communications system. At this time, no other UHF manufacturer has a network that can be integrated with the existing system. The CDC intends to award a sole-source firm fixed price order to Innovative Wireless Technologies in order to satisfy the requirement. The authority for this action is Federal Acquisition Regulation (FAR) Subsection 13.106-1; in particular, only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). This notice of intent is not a request for competitive offers / quotations. This is only an opportunity to provide specific and convincing information that the requirement should instead be competed and the respective capabilities of the responder. All such responses received by the closing date / time of this notice will be considered by the government. A determination by the government whether or not to compete this proposed acquisition based upon responses to this notice is solely within the discretion of the government.
