- On July 6, 2016, the Technology Acquisition Center awarded Delivery Order VA118-16-F-1118 under the terms and conditions of General Services Administration (GSA) Schedule 70 Contract GS-35F-0170K with Executive Information Systems (EIS), located at 6901 Rockledge Drive, Suite 600, Bethesda, MD 20827-0076. EIS will be providing Statistical Analysis Software (SAS), Inc. maintenance and support. The total order value is $566,338.28. ? LIMITED-SOURCES JUSTIFICATION 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724 2. Description of Action: The proposed action is for a firm fixed price task order for the renewal of software maintenance for Statistical Analysis Software (SAS) Institute Incorporated software. This effort will be awarded as a task order under General Services Administration (GSA) Federal Supply Schedule (FSS) Information Technology 70 contract number GS-35F-0170K with Executive Information Systems LLC, (EIS). 3. Description of the Supplies or Services: VA, Office of Information and Technology, Service Delivery and Engineering, Field Operations Region 5, in support of Veterans Benefits Administration (VBA) Office of Performance Analysis and Integrity (OPA&I), has a requirement for annual software maintenance for its 30 SAS software licenses. VA previously procured the licenses and requires annual maintenance so that the latest software version updates, security patches, and troubleshooting support are available to ensure mission success. The SAS software is already installed on a SAS pre-production and production server used throughout VBA for development and testing predictive analytics, simulation, optimization studies, and ad hoc reporting capabilities of current claims processing functions. SAS is a proprietary product, and as such, technical software support and maintenance is required from SAS for software updates, patches, phone and email support, and on-line self-help. The period of performance of the task order shall be from August 31, 2016 through August 30, 2017. 4. Statutory Authority: This acquisition will be conducted under the authority of the Multiple-Award Schedules Program. The specific authority providing for a limited source award is Federal Acquisition Regulation (FAR) 8.405-6(a)(1)(i)(B), "Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized." 5. Rationale Supporting Use of Authority Cited Above: The proposed source for this action is EIS, LLC, 6901 Rockledge Drive, Suite 600, Post Office Box 34076, Bethesda, Maryland, 20827-0076. The proposed action is to procure software maintenance for SAS licenses currently installed at VBA OPA&I. The software currently in use is proprietary to SAS, therefore, only SAS through its exclusive can provide the requisite software maintenance as no other vendor has the ability or data rights to access the software source code in order to develop and push software updates and patches or provide technical support on its products. Since the software is proprietary, a restriction is placed on access to the software code that is required in order to develop updates and patches to the software. Without this access it is impossible to modify the software code as necessary for these patches and updates. SAS provides the maintenance to the Government exclusively through EIS, as SAS does not sell its software maintenance through any other resellers. Therefore, only maintenance procured through EIS, is able to satisfy the Government's requirements. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in section eight of this justification. This effort did not yield any additional sources that can meet the Government's requirements. There is no competition anticipated for this acquisition. The ordering activity will post this justification along with the request for quote to the GSA E-Buy website in accordance with FAR 8.405-6(b)(3). Additionally, in accordance with FAR 5.301, the resulting notice of award of this action will be synopsized on the Federal Business Opportunities web page within 14 days after award and this justification will be made publicly available. 7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed. Presently, EIS has exclusive rights to sell and support all SAS software licenses and maintenance to Government customers, but the Government shall continue to monitor the market to determine whether SAS permits other sources to sell its products, or whether SAS provides its software code in open source, which would allow other vendors to provide the requisite maintenance. 8. Market Research: Market research was conducted in March 2016 by performing an internet search to determine if there were other software maintenance service providers that could maintain OPA&I's current production environment which consists of SAS software. Though there are other software developers that have software products that offer data visualization and simulation, such as Boulette Moores Cloer, International Business Machines, and Hewlett Packard, these companies do not and cannot provide software maintenance, updates, and support for SAS software products due to the proprietary nature of SAS software. The technical experts confirmed that since the source code required to perform the required software maintenance and issue the updates and releases is proprietary, EIS, the exclusive maintenance provider for SAS software, is the only source capable of providing the required maintenance updates and releases for the existing SAS software. No other source has the capability of developing and issuing software updates and fixes for SAS software necessary to support VBA OPA&I's requirements. Additionally, VA performed further market research in April 2016 by conducting a search on the GSA e-Library. Market research indicated only EIS has exclusive rights to sell and support all SAS software licenses and maintenance to Government customers. 9. Other Facts: None.
