- Exhibit 9 Exhibits 1-8 Notice to Offerors: Funds are not presently available for this project. No award will be made under this solicitation until funds are available. The Government reserves the right to cancel this solicitation, either before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an offeror for any costs incurred as a result of this request for proposal. This Request for Information (RFI) is intended to identify sources interested in providing the services specified in the Statement of Work (SOW). This RFI does not constitute an invitation to bid or a Request for Quote, nor should it be considered as a commitment on the part of the Government. Information received will not obligate the Government in any manner nor will the Government reimburse companies for any costs associated with responding to this RFI. PERFORMANCE WORK STATEMENT STRUCTURE PREVENTIVE MAINTENANCE LOWER RIO GRANDE FLOOD CONTROL PROJECT I. GENERAL INFORMATION The United States International Boundary and Water Commission (USIBWC), has a requirement a for a preventive maintenance contract on the Lower Rio Grande Flood Control Project (LRGFCP) Structures. The Lower Rio Grande Field Office estimates that approximately 425 flood control structures need preventive maintenance such as weed trimming, painting grills, installing wooden marker posts, and retracing identification numbers on structures. The Contractor shall provide all labor, material, equipment, subcontract, supervision, and management to perform the requirements of this Performance Work Statement (PWS). II. BACKGOUND The LRGFCP Structures play a vital role in controlling and containing flood waters inside the floodplain and preventive maintenance operations are essential to maintain flood conveyance capacity. III. AREAS TO BE TARGETED The flood control structures are located throughout the LRGFCP and will include Hidalgo and Cameron County River Levee, Banker Floodway Levee, Main Floodway Levee, North Floodway Levee and the Arroyo Colorado Levee. IV. SCOPE A. Paint the existing grills on approximately 273 structures. B. Install the wooden marker post and paint them as specified on approximately 316 structures. C. Stencil the number accordingly on approximately 294 structures. D. Weed eat around the structures and apply herbicide on approximately 396 structures. V. OBJECTIVES A. The Lower Rio Grande Field Office has determined to implement preventive maintenance Flood Control Structures. VI. REFERENCES A. See "EXHIBITS 1 - 8" for the structure locations. B. See "EXHIBIT 9" for Structure Stenciling. VII. REQUIREMENTS AND TASKS A. GENERAL: The Contractor shall implement preventive maintenance on the USIBWC Flood Control Structures. B. MATERIALS: The Contractor shall use materials that conform to USIBWC requirements listed below: • 8 ft. treated (i.e. wolmanized) wood marker post. • Yellow, black and white industrial paint that will adhere to concrete, steel and wood. • The Contractor shall supply a no drip lubricant that adheres to vertical surfaces, moving parts, gears, rollers and bearings, and resists temperature ranges from 10 F to 120F. • The Contractor shall trim overgrow vegetation within 5ft. around the Flood Control Structures with a gasoline trimmer and/or edger. After trimming apply herbicide to control new growth. Use environmentally safe options such as glyphosate, imazapyr with a surfactant like vegetable oil or biofuel may be used. C. INSTALLATION • Install 8 ft. treated wood Marker Posts, 3 ft. away from the upstream corner; 2 ft. below and 6 ft. above the existing ground elevation. Apply black paint 1ft. from the top of each Marker Post and stencil in yellow the corresponding structure number. The remaining portion of the Marker Post will be painted yellow. • The Contractor shall clean and remove rust from the existing grills prior to applying yellow paint. The Contractor shall follow the paint manufacture's recommendations before application of paint. • Once the yellow paint dries, the Contractor will stencil corresponding structure number as shown on Exhibit 9. The Contractor shall follow the paint manufacture's recommendations when applying the paint to the concrete structure. • The Contractor shall weed 5' (feet) around the Flood Control Structures and apply a herbicide mixture for weed control. The Contractor will follow the chemical label before applying and herbicide. • The Contractor shall remove and clean any debris from the structure stem, gear assembly and guides. The Contractor shall follow the lubricant manufacture's recommendations before applying the lubricant to the steel components of the structure. D. PROTECTION • All completed work sustaining damage and requiring touch-ups or repairs will be the responsibility of the Contactor during the duration of the project until the entire project is substantially complete and accepted. VIII. SCHEDULE AND PERFORMANCE 1. The Contractor shall provide a Weekly Plan and Progress Report by Friday of each week. 2. At a minimum, the Weekly Plan and Progress Report shall include: a. Days/Hours worked b Flood Control Structures Completed c Any weather delays e Outlook for next week 3. The period of performance shall not exceed one hundred fifty (150) calendar days. XIII. SITE VISIT o OFFERORS WILL BE HIGHLY ENCOURAGED TO ATTEND A SITE VISIT PRIOR TO SUBMISSION OF A QUOTE. o XIV. PRICING o The Contractor shall perform the services in accordance with this Performance Work Statement at a Firm Fixed Price (FFP). XV. RESERVED XVI. ADDITIONAL CONTRACTOR'S RESPONSIBILITIES o The Contractor shall appoint a coordinator or manager and an alternate to serve as a single point of contact and liaison between the Contractor and the Contract Administrator and/or Technical Representative for the actual work required under this Contract. The coordinator or manager shall be responsible for the coordination of the work provided under this scope of work and shall respond to discrepancies and questions regarding this Contract. o The Contractor shall provide all necessary personnel, supervision, quality control, equipment, tools, services, supplies, and other items necessary to perform all operations in connection with the Preventive Maintenance project of the LRGFCP Structures. o The Contractor and its subcontractors must provide their own transportation and equipment to perform the duties mentioned in this Performance Work Statement (PWS). The Contract work shall be performed between September 1 and February 28. The Contractor will be responsible for performing bird surveys in accordance with the Migratory Bird Treaty Act (MBTA), if any work is performed between March 1 and August 31. In addition, as per the MBTA, when an active bird nest (nest with eggs or a bird present) is encountered during the performance of this Contract, the nest shall not be disturbed and a 35 ft. buffer of vegetation shall remain around the nest. o The Contractor is responsible for taking the proper measures to safeguard equipment during periods of high flows or flood operations. Time extensions may be approved by USIBWC due to severe weather and high flows during flood operations. The Contractor is responsible for providing interruption of work notice within 48 hours of assurance. o Any work not performed will be reduced from the Contract in a percentage basis. o The contractor's work hours shall be from 8 A.M. to 4:30 P.M. Central Time Monday through Friday, unless otherwise negotiated with USIBWC. o Impacts to naturally occurring herbaceous plants and grasses shall be minimized by the use of existing roads and trails to access woody vegetation. If new trails must be established, limit the width to the minimum needed for safe transportation of equipment. o The Contractor shall comply with safe working practices, training, personal protective equipment and any other requirement under federal DOL/OSHA standards; and state and or/or local standards as required by law.
