- Authority and Introduction: Under authority of the Federal Acquisition Regulation (FAR) Part 13.106-1(b). The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis, with GATAN INC, (GATAN), 5794 W Las Positas Blvd, Pleasanton, CA 94588-4073, as the only capable source that can provide a unique software package to enable the automated collection of electron tomography data using the NIST's FEI Titan 80-300 TEM/STEM system, which is a Transmission Electron Microscope (TEM). Correspondingly, based on the foregoing authority under the FAR, the NIST intends to award on a sole source basis. The intended procurement will be classified under North American Industry Classification System (NAICS) 511210-Software Publisher, Business Size Standard: $38.5 Million. Government's Requirements: - Unique software package in order to enable the automated acquisition of electron tomography data within the GATAN Microscopy Suite (GMS) version 2: The software package must be fully integrated with a newly acquired data collection system manufactured by GATAN, and must enable collection of data in three imaging modes: 1. Conventional Transmission Electron Microscope (TEM). 2. Scanning (S) Transmission Electron Microscope (TEM). 3. Energy-Filtered (EF) Transmission Electron Microscope (TEM). Sole Source Rationale: The software package offered by GATAN is uniquely designed to operate the NIST's FEI Titan 80-300 TEM/STEM system. Correspondingly, the data acquisition system manufacturer (GATAN) is the only source which offers a unique software package to enable the automated collection of electron tomography data using the NIST's FEI Titan 80-300 TEM/STEM system, as required. Also, the software package offered by GATAN is uniquely designed and capable of automatically acquiring data in all three image modes; and, the software package offered by GATAN is uniquely fully integrated with the NIST's existing data collection system as described in the Government's Requirements above. No other appropriate sources were identified, and therefore a sole source solicitation is required with GATAN. The NIST is required to constantly and accurately maintain its research and only GATAN provides a unique software package for the needed continuity research. Thus, GATAN is the sole provider of the unique software package. General Information and Responses to this Notice: This notice of intent is not a request for competitive proposals or quotes and no solicitation document will exist for this requirement. However, companies interested in responding to this notice shall submit technical data, including price and sufficient documentation to determine capabilities and qualifications in meeting or exceeding the Government's Requirements. All statements received by the closing date of this notice will be considered by the Government. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Companies interested in responding to this notice: 1. May submit their capabilities and qualifications to meet or exceed the Government's requirements, in writing via e-mail, to Mario Gray using e-mail address: mario.gray@nist.gov, with the solicitation number referenced in the subject line of the e-mail. 2.
