- The requirement to prepare a written justification IAW FAR 6.303 does not apply to Federal Supply Schedules. The identified equipment is sole source; therefore, consideration of the number of contractors is precluded for the reasons indicated below. With all FSS sources queried and in lieu of an open market commercial procurement; it is advantageous to the Government to procure IAW FAR 8.4; CICA requirements have been met and all pricing under FSS contract V797D-50430 have been determined fair and reasonable. This acquisition is conducted under the authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6(a)(1)(i)(B) -- Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. Requesting four (4) Arjohuntleigh "Maxi Sky ® 2" ceiling-mounted patient lifts for the new VA Palo Alto Radiology Consolidated Project - Bldg. 100 (G1-305, 307, 101, 202b). The equipment to be purchased is manufactured and installed by Arjohuntleigh, Inc., a Getting group. It is advantageous to the Government to procure the subject equipment from the VA FSS schedule to ensure the equipment and structural installation will be performed in accordance with the manufacturer's warranty guidelines. CICA requirements have been met and all pricing under FSS contract V797D-50430 has been determined fair and reasonable IAW FAR Subpart 8.4 procedures.
