LIMITED SOURCES JUSTIFICATION ORDER >$150,000 FAR PART 8.405-6 Acquisition Plan Action ID: VA262-16-AP-3976 This acquisition is conducted under the authority of the Multiple Award Schedule Program. The material or service listed in par. 3 below is sole source, therefore, consideration of the number of contractors required by FAR Subpart 8.4 - Federal Supply Schedules, is precluded for the reasons indicated below. Restricted to the following source: Contractor: Mabbett & Associates, Inc. Contractor POC & phone number: Christopher L. Mabbett 781-275-6050 Ext. 311 Mfgr/Contractor Address: 5 Alfred Circle, Bedford, MA 01730-2318 The requested material or service represents the minimum requirements of the Government. (1) Agency And Contracting Activity:Department of Veterans Affairs 4811 Airport Plaza Drive, Suite 600 Long Beach, CA 90815 VISN: 22 (2) Nature and/or Description of Action Being Approved: The Contractor shall provide s comprehensive asbestos and lead survey for VA Loma Linda Healthcare System (VALLHS). (3)A Description of the Supplies or Services Required to Meet the Agency's Need: The Contractor shall furnish all labor, materials, supplies, equipment and transportation necessary to conduct the survey, collect samples, perform lab analysis and produce required deliverables to conduct a comprehensive survey at the VA Loma Linda Healthcare System (VALLHS) for the presence of asbestos-containing materials (ACM) and a determination inspection for those surfaces coated with suspect lead-based paint (LBP). Work will be required to be conducted in each of the specified buildings (Buildings 1 & 2) located at the VALLHS. Period of performance is July 1, 2016-November 30, 2016. (b)Estimated Dollar Value: $294,000.00 (c)Required Delivery Date: November 30, 2016 (4)Identification of the Justification Rationale (See FAR 8.405-6), and if Applicable, A Demonstration of the Proposed Contractor's Unique Qualifications to Provide the Required Supply or Service. (Check All That Apply and Complete) 1Specific characteristics of the material or service that limit the availability to a sole source (unique features, function of the item, etc.). Describe in detail why only this suggested source can furnish the requirements to the exclusion of other sources. Solicitation number VA262-16-Q-0683 was posted from April 19, 2016-May 16, 2016 open market set aside for small business and only one company responded. The company that responsed did not provide all of the requested technical documents from the solicitation, therefore the contracting officer requested a Certificate of Compency (COC) from the Small Business Administration (SBA). The company declined the COC process (withdrew their proposal-according to SBA), and SBA closed the file. The requesting service with collaboration with the contracting officer, researched other VA facilities nationwide and found Mabbett & Associates, Inc., a Service Disabled Veteran Owned Business (SDVOSB) who is also on the General Service Administration (GSA) Schedule was interested and is capable of providing the work. VALLHS has been waiting over three months for this service, and if not completed can be fined by the State of California, therefore, this procurement is now considered urgent and compelling. 0A patent, copyright or proprietary data limits competition. The proprietary data is: (If FAR 8.405-6(a)(2)iii before posting. Do not include specific proprietary data. Only mention the type of equipment, procedure, etc. to show that proprietary supplies or services are being procured.) NA 0These are "direct replacements" parts/components for existing equipment. _NA__________________________________________________________________________ 0The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing. Describe the equipment/function you have now and how the new item/service must coordinate, connect, or interface with the existing system. NA 0The new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures. NA 1An urgent and compelling need exists, and following the ordering procedures would result in unacceptable delays. FAR 6.302-2Unusual and Compelling Urgency applies to this procurement. Due to the nature of the requirement and the urgency of the asbestos survey, this procurement is vital for VALLHS to keep patients, visitors and employees safe from hazardous materials therefore it is critical that this service is procured. Mabbett & Associates, Inc., a SDVOSB and is on GSA Schedule was interested and is capable of providing the work has been providing this service at other VA Healthcare Facilities nationwide is capable of fulfilling this requirement. (5) Describe Why You Believe The Order Represents the Best Value Consistent With FAR 8.4 to Aid the Contracting Officer in Making This Best Value Determination: The anticipated cost does not exceed the current established GSA rates. (6) Describe the Market Research Conducted Among Schedule Holders and the Results or a Statement of the Reason Market Research was not Conducted: Market research was conducted by posting a previous solicitation, and by calling several VA Healthcare Facilities nationwide to identify a contractor. (7) Any Other Facts Supporting the Justification: Due to the urgent need (as this requirement was needed three months ago), VALLHS is currently overdue for their triennial facility asbestos survey, therefore this procurement must be completed as soon as possible. Furthermore, this is a requirement per VHA Directive 2010-036 & Asbestos School Hazard Abatement Reauthorization Act (ASHARA) 40 CFR763 Appendix E Supart E. (8) A Statement of the Actions, if any, the Agency May Take to Remove or Overcome Any Barriers That Led to the Restricted Consideration Before Any Subsequent Acquisition for the Supplies or Services is Made: The are no actions to remove barriers at this time, as the previous solicitation received no responsible contractors who were capable of completing the work. (9) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
