Description

The National Oceanic & Atmospheric Administration's (NOAA) Acquisition & Grants Office, Western Acquisition Division-Boulder, intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b)(1) along with Statutory Exception 41 USC 253 (C) (1) only one responsible source, with the Proton Energy Systems, Inc. dba Proton OnSite in Wallingford, CT for the purchase of emergency spare part inventory and yearly maintenance kits in support of the ten Proton Hydogen Genrators (Hogen) in the National Weather Service/Pacific Region (NWS/PR). The sole source determination is based on the NOAA's, NWS/PR need for the proprietary brand products only provided through Proton Energy Systems, Inc. dba Proton OnSite. "Proton Energy Systems is the sole manufacturer of ten hydrogen generators in the Pacific region. Only cell stacks, parts and kits fabricated by and/or tested and selected by Proton can be installed in the Hogen generator to meet specifications for proper and safe generation of hydrogen. Compatibility issues, equipment failures, and threat to health and safety of staff and operators due to the use of unapproved materials is a large concern." The emergency spare part inventory is due by 8/7/2016 for the Base and will have two Option Years. This notice of intent is not a request for competitive proposals and no solicitation package is available. However, firms that believe they can fully meet the Government's requirements may submit substantiating documentation in writing to the identified point of contact within 15 days after publication of this synopsis. Such documentation will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to conduct a competitive procurement, based upon responses to this notice, is solely within the discretion of the government. Oral communications are not acceptable in response to this notice.
