JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION In accordance with the authority granted under FAR Part 13, this request for a noncompetitive acquisition is hereby submitted for consideration for acquisition approval. 1. IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY: Requesting Agency: USDA, APHIS, MRPBS, EMSSD, SHEPB 4700 River Road, Unit 124 Riverdale, MD 20737 Attn: Daniel Weissman Contracting Activity: USDA, APHIS, MRPBS, ASD Minneapolis Procurement Branch Butler Square, Fifth Floor 100 North 6th Street Minneapolis, MN 55403 Vendor Information: Summit Training Source 2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED: The APHIS, MRPBS EMSSD Safety Health and Environmental Protection Branch (SHEPB) provides health and safety training for operating units throughout APHIS. Due to the ongoing High Path Avian Influenza (HPAI) emergency, APHIS has immediate need to provide emergency responders with online health and safety training prior to their emergency deployment. APHIS has an existing training platform through Summit's proprietary system. The only option to quickly implement the necessary training is to purchase course licenses compatible with Summit's system, which are only available from Summit itself. 3. A DESCRIPTION OF THE SUPPLIES, EQUIPMENT, OR SERVICES REQUIRED TO MEET AGENCY NEEDS (INCLUDING THE ESTIMATED VALUE OF THE ACQUISITION INCLUSIVE OF OPTIONS): We need to procure online health and safety training for emergency responders who are being deployed to the field in response the HPAI emergency. Course titles and quantities are in the Table below. IDENTIFICATION OF THE STATUATORY AUTHORITY PERMITTING NONCOMPETITIVE ACQUISITIONS: FAR 6.302-2 Unusual and Compelling Urgency. HPAI deployment occurs on an emergency basis and personnel must receive this safety and health training prior to deployment. 5. A DEMONSTRATION THAT THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED: APHIS' existing training platform is proprietary and additional courses can only be obtained through Summit. 6. A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A NOTICE WAS, OR WILL BE, PUBLICIZED AS REQUIRED BY FEDERAL ACQUISITION REGULATION (FAR) SUBPART 5.2, AND IF NOT, WHICH EXCEPTION UNDER FAR 5.202 APPLIES: Due to the need for immediate deployment, a new training platform cannot be implemented in time needed for emergency responders to be trained. 7. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE, AND THE BASIS FOR THAT DETERMINATION: 8. A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED (FAR PART 10) AND THE RESULTS, OR AN EXPLANATION OF THE REASON MARKET RESEARCH WAS NOT PERFORMED: The company does not have any distributors as this is a proprietary system. 9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION - FAR 6.303-2(a)(9): NA 10. A LISTING OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE ACQUISITON: NA 11. A STATEMENT OF THE ACTIONS, IF ANY. THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES, EQUIPMENT, OR SERVICES REQUIRED: SHEPB has a long term plan to implement a new safety and health training platform under full and open competition. 12.
