NON-COMPETITIVE COMBINED SYNOPSIS / SOLICITATION Title: Manufacture and Test of High Pressure Freeze-Substitution Apparatus (HPFS) (i)This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii)The solicitation number is HHS-NIH-NIDA-SSSA-NOII-2016-420 and the solicitation is issued as an Request for Quatation (RFQ). This acquisition is for a commercial item or service and is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures; FAR Subpart 13.5-Simplified Procedures for Certain Commercial Items; and FAR Part 12-Acquisition of Commercial Items, and is not expected to exceed the simplified acquisition threshold. THIS IS A NON-COMPETITIVE (NOTICE OF INTENT) COMBINED SYNOPSIS SOLICITATION TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute on Drug Abuse (NIDA), Station Support Contracts and Simplified Acquisitions Branch (SS/SA) on behalf of the National Institute on Neurological Disorders and Stroke intends to negotiate and award a purchase order without providing for full and open competition (Including brand-name) to; Woods Hole Oceanographic Institution 266 Woods Hole Road Woods Hole, MA 02543-1536 For a High Pressure Freeze-Substitution Apparatus (HPFS). The high pressure freeze substitution apparatus was recently successfully designed by the Woods Hole Oceanographic Institution (WHOI) under purchase order number HHSN271201600097P. Manufacture and test of the designed device is now required. This acquisition is conducted as non-competitive for a commercial item or service and is conducted under the authority of the FAR Subpart 13.5-Simplified Procedures for Certain Commercial Items and 13.501 Special documentation requirements and the authority of 41 U.S.C. 1901 and the statutory authority of FAR Part 6.302-1(a)(2)(ii)(A). Pursuant to FAR Subpart 13.501 (a) (1) (iii) the justification (excluding brand name) will be made available within 14 days after contract award or in the case of unusual and compelling urgency within 30 days after contract award. (iii)The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-88-1 dated 06-15-2016 (iv)The associated NAICS code 541712 and the small business size standard 500 employees This requirement is full and open with no set aside considerations. (v)The National Institute of Neurological Disorders and Stroke (NINDS) Laboratory of Neurobiology works to characterize the organization of neural connections in the brain using advanced structural techniques when needed. The structural techniques depend heavily on the ability to utilize high pressure freezing techniques for freeze-substitution to prepare brain tissues for electron tomography. The Laboratory of Neurobiology has determined that performing freeze-substitution under high pressure can overcome current limitations in the freeze substitution technique that limit the size of the brain tissue. To advance this novel approach to a long-standing problem, the laboratory began by having a high pressure freeze-substitution apparatus designed as this approach requires pressures far higher than those safe for normal laboratory use and no off-the-shelf equipment is available. The purpose of this requirement is to manufacture and test a high pressure freeze substitution device which was previously designed by Woods Hole Oceanographic Institution based on Government specifications. The NINDS Laboratory of Neurobiology requires manufacture, test, and delivery of one (1) high pressure freeze substitution device. The device shall be tested at WHOI to assure that it can safely reach the required maximum pressures and temperature. The device shall be manufactured in accordance with the pre-approved design and the following requirements: 1.The device must be able to remain submerged and sealed within a bath of liquid nitrogen 2.The device must operate at an internal pressure of 3000 atmospheres with a minimum safety factor of 1.5. 3.The device must hold internal pressure of 3000 atmospheres at a temperature of -200 to 25C for approximately one week. 4.The device must provide a continuous read out of pressures at an accuracy of +/- 100 atmospheres. 5.The device must be able to warm to 25C while safely holding internal pressure of 3000 atmospheres. 6.The device must be made of materials and parts that are impervious to organic solvents such as acetone, strong cross-linkers such as acrolein, and strong oxidants such as OsO4. 7.The device must be able to retain full function in at pressures up to 3000 atmospheres and temperatures down to -195°C. 8.The device must safely vent internal pressure of up to 3000 atmospheres down to less than 2 atmospheres during variable adjustment intervals of minutes to days. (vi)Delivery is to be four (4) Months after receipt of award (ARO) and delivery is to be to: The device shall be delivered to the NIH Main Campus, NINDS, Laboratory of Neurobiology, Building 49, Room 3A60, Bethesda, MD 20892. (vii)The provision at FAR clause 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition. (viii)The provision at FAR clause 52.212-2, Evaluation - Commercial Items, applies to this acquisition. (a)The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Factor 1: Device Manufacture and Test The Government shall evaluate the proposed manufacturing and test methods for understanding of the requirement and anticipated effectiveness. The methods proposed shall be evaluated for the level of ability to ensure that each of the project requirements are met or exceeded. Factor 2: Delivery The Government shall evaluate the proposed delivery method and lead time for ability to meet or exceed the stated delivery requirements. Ability to exceed requirements shall be viewed favorably. Quotations must include a delivery lead time. Technical and past performance, when combined, are (1) significantly more important than cost or price; (b)A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (ix)The Offerors to include a completed copy of the provision at FAR clause 52.212-3, Offeror Representations and Certifications-Commercial Items, with its offer. (x)The FAR clause at 52.212-4, Contract Terms and Conditions - Commercial Items, applies to this acquisition. (xi)FAR clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition (xii)The following additional contract requirement(s) or terms and conditions as determined by the contracting officer are necessary for this acquisition and consistent with customary commercial practices. There are no additional terms and conditions applicable to this requirement. (xiii)The Defense Priorities and Allocations System (DPAS) are not applicable to this requirement. (xiv)Responses to this solicitation must include sufficient information to establish the interested parties' bona-fide capabilities of providing the product or service. The price quote shall include: unit price, list price, shipping and handling costs, delivery days after contract award, delivery terms, prompt payment discount terms, F.O.B. Point (Destination or Origin), product or catalog number(s); product description; and any other information or factors that may be considered in the award decision. Such factors may include: past performance; special features required for effective program performance; trade-in considerations; probable life of the item selected as compared with that of a comparable item; warranty considerations; maintenance availability; and environmental and energy efficiency considerations. In addition the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size must be included in the response. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov."
