MATLAB TOTAL ACADEMIC HEADCOUNT SOFTWARE LICENSE Notice of Intent The 10th Contracting Squadron, United States Air Force Academy (USAFA), Colorado has received a SOLE SOURCE justification for the acquisition of the MatLab Total Academic Headcount (TAH) software license. The sole provider is MathWorks, Inc. of 3 Apple Hill Drive, Natick, MA 01760-2098. MathWorks is a large business for NAICS 511210. This notice of intent services as the public notice required by FAR 5.101(a) in the format prescribed by FAR 5.207 (c)(15). The government intends to award a firm, fixed-price contract using the commercial procurement procedures found in FAR Part 13. The North American Industry Classification System Code (NAICS) is 511120 and the size standard is 500 employees. The justification given is the following: This software/tool is prescribed by the United States Air Force Academy's (USAFA) curriculum committee. It is specifically called out for use in 5 courses in the curriculum handbook and used in dozens more. It is a key tool for USAFA research. Matlab is a primary engineering and science tool used broadly in industry and research. One of the primary goals of the courses that use this tool is to train future engineers and scientists the specific Matlab coding syntax. As such Matlab is the only hands on tool that can perform this training. While there are many quality tools for specific mathematical analysis, Matlab provides the broadest set of libraries and is by far the most recognized tool for engineers in the world. Learning Matlab is the de facto standard in engineering community. While Matlab is not directly endorsed by ABET, the Engineering Accreditation Authority, it is widely recognized as the key tool meeting the accreditation criteria. Other tools including Mathematica, JMP and STATA have some features that overlap with Matlab, but none of these tools contain the Matlab coding syntax or have the vast diversity of capabilities for engineering analysis. While each of these tools offer some strengths over some parts of Matlab none provide full coverage of the application space. Moreover, The Air Force Academy has invested tens of thousands of hours developing curriculum and doing research with Matlab. Converting classes from Matlab to another tool would take 2 or more years of effort and more than 5000 hours of work. Some research projects simply could not proceed due to the collaborative use of Matlab with partners such as AFRL. Each year the Air Force Academy department heads are polled to verify the sets of toolboxes required for classes and research. The vast number of available toolboxes is a key strength of Matlab over every other product. This year 13 departments/labs responded requesting the 52 toolboxes for their work. Including these toolboxes in our academic license provides the most capability possible. USAFA would have to buy 10's of separate specialty tools to match the functionality available in the Matlab toolbox license. Therefore, the best value for the government is the purchase of the Matlab licenses. To purchase individual licenses from a variety of other software publishers would be very time consuming and very expensive. The skill-set acquired from other multiple software packages would not match the skills learned from MatLab. The cadets would be denied familiarity to the engineering standard. MATLAB TAH can only be purchased through the MathWorks, Inc. There are no authorized resellers. A sole-source letter has been received from the software publisher. This synopsis is for notification purposes only and does not constitute a solicitation for bids or proposals. DO NOT submit a bid/quote at this time. Any offerors believing they can provide the required renewal subscription to MatLab TAH license requirement described above may provide evidence for consideration. Evidence must support the offeror's claim they can provide this license. All qualified sources may submit a response, which if timely received, will be considered by this agency. Information received will be considered solely for the purpose of determining whether a competitive procurement can be conducted. A determination not to compete this proposed procurement based on responses to this notice is solely within the discretion of the government. Responses must be received NLT 1:00 p.m. MST on 27 Jul 2016. The Government does not intend to pay for any information provided under this announcement. OMBUDSMAN (APR 2014) (a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 (http://www.whitehouse.gov/omb/circulars_a076_a76_incl_tech_correction/ ) competition performance decisions).
