Senior Justice Advisor Baku, Azerbaijan Issuance Date: 07/13/2016 Closing Date: 08/03/2016 SOLICITATION NUMBER: PSC-16-047-INL SUBJECT A solicitation for a Personal Services Contractor (PSC), Department of State (DOS), Bureau for International Narcotics and Law Enforcement Affairs (INL) The United States Government (USG), represented by the DOS, seeks applications from US citizens interested in providing PSC services as described in this solicitation. PRE-AWARD ETHICAL RESPONSIBILITIES OF PSC (JUN 2011) This solicitation may result in the award of one or more personal services contracts as defined in FAR 2.101. Prior to contract award, all offerors or quotes must advise the cognizant Contracting Officer if they have a personal conflict of interest, such as a financial conflict, that would prevent them from either meeting the requirements of the clause entitled, "Post-Award Ethical Responsibilities of Personal Services Contractors," or otherwise objectively performing their contractual duties upon contract award. HOW TO APPLY Offerors proposal shall be in accordance with the requirements stated in this solicitation at the place and time specified. A proposal will be determined non-responsive and ineligible for consideration unless all required documents and information are included in the submission. JOB DESCRIPTION: See below GENERAL STATEMENT OF THE PURPOSE OF THIS CONTRACT The Department of State (DOS) Bureau of International Narcotics and Law Enforcement Affairs (INL) is the Bureau charged with foreign policy development relating to international crime, drug trafficking, anti-corruption, criminal justice reform, post-conflict/civilian policing, and related issues. The principal goal of the INL program in Azerbaijan is to develop and administer technical and developmental assistance designed to enhance the capabilities of Azerbaijan's justice sector institutions and their law enforcement personnel. The Baku INL section seeks to implement justice sector development and technical assistance programs and support the development of key democratic institutions of government and civil society to promote public participation, combat corruption and strengthen the rule of law. This assistance is administered in order to enable those institutions and their personnel to more effectively combat terrorism, trafficking in persons, corruption, financial crimes, money laundering and other types of crime in a manner consistent with the rule of law. The assistance is also administered to enable those institutions and their personnel to more effectively cooperate regionally and with the United States in combating such crime. The purpose of this personal service contract is to provide a Senior Justice Advisor to U.S. Embassy Baku who will fulfill the central role in developing INL programs to support Azerbaijan's judicial reforms and other rule-of-law initiatives. Also, the advisor will help in assessing the possibility of designing and implementing such programs in an environment in which host-nation commitment to the design and implementation of rule of law-related programs is still developing. The selected Senior Justice Advisor will work closely with senior Azerbaijani government officials in the executive, legislative and judicial branches of government, including national and local officials to implement programs, develop legal reform strategies, and to build justice sector capacity in a wide range of areas including anti-corruption, anti-terrorism, anti-money laundering, anti-trafficking in persons, prosecutorial development, criminal procedure code implementation, and in promoting a professional and independent judiciary. The Senior Justice Advisor will also work closely with officials of the U.S. Department of State, U.S. Agency for International Development (USAID), and in-country U.S. and foreign authorities to ensure that such assistance meets the needs of Azerbaijan while supporting Departmental and U.S. policy objectives. The Senior Justice Advisor will be responsible for assistance programs that focus on a range of justice sector development issues involving prosecutors, judges, law enforcement agents, lawyers and legislators. Work with prosecutors is centered on increasing their capacity, including improving their ability to marshal evidence and present persuasive cases in court as well as improving their cooperation with investigators. B. DUTIES AND RESPONSIBILTIES: a. Develop and maintain a comprehensive knowledge of the Azerbaijani legal system b. Review host country justice sector needs and assess justice sector reform efforts. c. Furnish assistance to the Government of Azerbaijan (GOAJ) and the legal and law enforcement community in establishing comprehensive legislative and enforcement regimes in the areas of terrorism, money laundering, corruption, and trafficking in persons (TIP) in line with the country's international commitments. d. Improve judicial independence through training in ethical standards, deliberation of judgments in criminal cases, opinion writing, and criminal law training curricula as well as increasing judges' knowledge on discrete areas of criminal law. e. Provide guidance to GOAJ on the implementation of the reformed Criminal Procedure Code, primarily through trial advocacy and other skills development training seminars for prosecutors and judges. f. Evaluate legislation in order to identify and help to correct deficiencies in the laws of the country, including the Criminal Code, Criminal Procedure Code, and Administrative Code. g. Monitor, analyze, and report on a broad range of legal, political and economic developments, focusing on, but not limited to, legislation, debate and current events involving corruption, crime, law enforcement, and criminal justice administration in Azerbaijan. h. Develop a working knowledge of relevant Azerbaijani laws, European Convention on Human Rights and the applicable EU and UN conventions. He/she will also be responsible for developing a working knowledge of Azerbaijani and regional protocols as well as maintaining a current directory of government and law enforcement officials in Azerbaijan and the region. i. Work with Azerbaijani government officials and other international reform assistant providers in developing implementing legislation for the Council of Europe and United Nations conventions and protocols j. Provide policy analysis and program guidance to INL, Embassy Baku, and other U.S. government entities on effective mechanisms for, progress in, and impediments to, achieving reform objectives in Azerbaijan. k. Develop a prosecution assistance program which focuses on the organization and operation of a prosecutor's office, including assisting with creating the appropriate supervisory structure, exercise of professional discretion, ethics and internal oversight and accountability. Provide mentoring and technical assistance to prosecutors on a range of issues such as plea bargaining and prosecutor-led investigations. l. Ensure that the program and administrative budgets are monitored routinely and that the projects fall within program guidelines notified to Congress and OMB. m. Coordinate with other components of the host country's justice system to ensure system-wide integration and functionality. n. Ensure program activities develop local capacity. Activities should include a broad range of justice sector actors. o. Establish and maintain relationships with Azerbaijani justice sector and other government officials, including prosecutors, investigators, judges, defense attorneys, civil society, parliamentarians, and other rule of law actors. Ensure adequate follow up with study groups and training (train-the-trainer, alumni conferences). p. Develop and maintain relationships with other donors, members of the international community, non-governmental organizations, and Azerbaijani justice sector officials to ensure justice sector programs are complementary and not duplicative. q. Liaise with U.S government agency representatives involved in criminal justice reform, including but not limited to, the Department of Justice, the Department of Homeland Security, and the U.S. Agency for International Development. r. Serve as a trainer for INL-funded programs. Identify outside experts, when appropriate, to serve as trainers. s. Draft and provide advice and assistance in the preparation of required reports, including to the U.S. Congress, INL, and other U.S. federal agencies. t. Participate in visits by senior officials and serve as an escort or control officer. Arrange itineraries and logistical support for official visitors. u. Brief DOS, Congressional, Embassy staff, and other visiting officials on the INL's role and the status of U.S.-Azerbaijani law enforcement projects and related initiatives. v. Provide assistance in the preparation of Embassy Baku Front Office correspondence which refer to relevant legal matters. C. RELATIONSHIP The Senior Justice Advisor will report to the Deputy Chief of Mission (DCM). The Senior Justice Advisor also works closely with the INL/EA program officer responsible for developing and implementing foreign assistance programs in Azerbaijan. The Contracting Officer's Representative (COR) is delegated the authority to act for the Contracting Officer in matters concerning technical clarification, inspection and, after concurrence by the Contracting Officer, acceptance of Contractor performance under the contract, including preparation of receiving reports, and the authorization of progress payments when appropriate. The COR will coordinate all work with the Contractor and review Contractor's performance at significant stages of its development. In no instance, however, shall the COR be authorized to alter or modify the specifications or the contract terms and the conditions or waive the government's requirement, price, delivery, or other terms and conditions. Such changes must be authorized, in writing, to the Contracting Officer. D. DELIVERABLES/REPORTS Deliverables are required under this PSC and shall include; monthly status reports, monthly evaluation of contractor performance, special reports when required and a "completion of assignment report," which shall be a compressive review of the projects in which the contractor was involved. Each report shall include a critique of and recommendations for the various projects. The completions of assignment reports are due no later than fifteen (15) days prior to the expiration of this contract. The Personal Service Contractor shall submit two (2) copies of each report as required to the following; 1. Deputy Chief of Mission and; 2. INL/EA Program Officer Per FAR Part 4, the above referenced documents shall be incorporated and copies stored in the PSC's hard file under Section V.; Tab E - Receiving Reports. The Contractor shall prepare and submit two copies of each technical report required by the schedule of this contract (e.g., progress reports, final reports, etc.), to the DCM and to the Program Officer, Bureau of International Narcotics and Law Enforcement Affairs (INL), Department of State, Washington, DC. The title page of all reports forwarded pursuant to this paragraph shall include a descriptive title, the author's name(s), contract number, project number, and title, contractor's name, name of the State Department project office, and the publication or issuance date of the report. When preparing reports, the Contractor shall refrain from using elaborate artwork, multicolor printing, and expensive paper/binding, unless it is specifically authorized in the Contract Schedule. Wherever possible, pages should be printed on both sides using single spaced type. E. COMPLEXITY The work involves planning, organizing, and managing day-to-day administration and oversight of a large number of organizational initiatives and training details. The ability to effectively manage large quantities of ever evolving data is essential. The duties of the position are further complicated by the fact that they are being performed in an environment in which host-nation commitment to the design and implementation of such programs is still developing. F. SCOPE AND EFFECTIVENESS The Advisor performs a broad range of tasks related to a complex foreign assistance program in the Republic of Azerbaijan. INL programs have a significant impact on embassy operations, including those of other USG agencies. G. MINIMUM QUALIFICATIONS a. Citizenship: U.S. citizen; and able to obtain/maintain a Department of State Secret security and medical clearance. b. Education: Bachelors and J.D. degree from an accredited institution. c. Foreign Language: demonstrated ability to work effectively with a translator. d. Computer Skills: Microsoft Office Suite. e. Work Experience: Demonstrated ten years of professional-level experience as a U.S. attorney and at least two years of experience working overseas. f. Communication: Excellent oral and written English communication skills. Demonstrated ability to write for senior officials. g. Leadership and Management: Must have a minimum of five years of successful supervisory and leadership experience in a multicultural environment. Also, a minimum of two years of program management experience. H. PREFERRED QUALIFICATIONS h. Familiarity with project design and development, program evaluations, strategic planning and performance metrics. i. Experience in rule-of-law development in an international environment. j. Experience serving as a trainer in an international context. k. Experience working for or coordinating with other relevant USG agencies (e.g., INL, Department of Justice, and USAID) or international donors (OSCE, European Commission, etc). l. Knowledge of civil law system. m. Ability to integrate projects into the broader goals of an organization without confliction. I. GOVERNMENT-FURNISHED EQUIPMENT The PSC shall be able to use a furnished with office space, a computer, office telephone, and other supplies needed for job requirements. This property will be owned and maintained by the DOS. J. TRAVEL Occasional travel to rural locations will be required. Occasional travel to other countries in the region, or travel to training sites outside Baku, and travel to the U.S. may also be required. K. PREDEPLOYMENT REQUIREMENTS If applicable - Consultations with the INL Program Office may be required. L. PHYSICAL DEMANDS AND WORK ENVIRONMENTS Normal routine will involve meeting with GoA officials, organizing training activities and workshops, and overseeing criminal justice reform initiatives. The Advisor will be based at U.S. Embassy facilities in Baku. M. GUIDELINES The Advisor will be guided by the INL Program and Policy Guide. Supplementary guidance will be provided by the Foreign Affairs Manuals for Financial Management (4 FAM), General Services (6 FAM) and Logistics Management (14 FAM), and associated Foreign Affairs Handbooks (FAH). N. EVALUATION CRITERIA Factor 1 Knowledge and Experience (35 points) Applicant demonstrates the ability to provide expert justice subject matter and policy recommendations based on professional legal experience. Expertise should include field, institutional, line, and management operations, organizational development, planning, and training. Factor 2 Leadership and Management (35 points) Applicant demonstrates the ability to make sound decisions in a timely manner and bear responsibility for several simultaneous projects while keeping the overall program goals in perspective. Previous management experience should include managing staff from diverse backgrounds (preferably international); making decisions about resource allocations; and familiarity with project design, development, implementation and evaluation. Factor 3 Communication (15 points) Applicant demonstrates the ability to communicate complex issues in a timely and concise manner, both orally and in writing. Factor 4 Interpersonal skills (10 points) Applicant demonstrates a proven record of accomplishment working in a team environment; with a diverse group of stakeholders. Factor 5 Past Performance (5 points) Past performance evaluation of applicant's ability to perform under the contract. In conducting the evaluation, the Government reserves the right to utilize all evaluation information available at the time of evaluation, whether provided by the applicant or obtained from other sources. COMPENSATION (BASE PAY) For award, INL will negotiate for this contract based on the market value as outlined above and overall experience relevant to the solicitation requirements.
