- INTRODUCTION This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This acquisition is being conducted in accordance with the procedures of FAR Part 13--Simplified Acquisition Procedures and FAR Part 12--Acquisition of Commercial Items. The solicitation number is HHS-NIH-NIDA-SSSA-NOI-2016-379 and the solicitation is issued as a Combined Synopsis Solicitation, Notice of Intent, to award a contract on a noncompetitive basis to Kamtek, Inc 7858 60 Beechcraft Ave., Gaithersburg, MD 20879. REGULATORY & STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13--Simplified Acquisition Procedures, Subpart 13.106-1, only one responsible source and no other supplies or services will satisfy agency requirements, and FAR Part 12--Acquisition of Commercial Items and is NOT expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13--Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6--Competition Requirements. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-89, dated July 14, 2016. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The associated NAICS code for this requirement is 493120 with size standard of $27.5 million. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The non-competitive determination is based upon the market research conducted as prescribed in FAR Part 10--Market Research. A Sources Sought Notice was posted to FedBizOpps referencing the detailed requirements and no responses were received from other vendors. The results of market research concluded that only Kamtek, Inc is capable of meeting the needs of this requirement for the purposes of continuity of science. The freezers require 24/7 monitoring by state of the art Centron Monitoring System (CMS) from Rees Scientific, real-time data on the environmental conditions (temperature, flooding) of the repository facility itself, and an uninterrupted power supply and liquid nitrogen in case of an emergency. Therefore, to allow for continuity of science, the same monitoring standards shall be used. In addition they must be stored at a location not more than one hour/ 30 miles from the NIH facility that allows for around the clock access. This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. DESCRIPTION OF REQUIREMENT Purpose and Objectives NCGC requires installation of three new freezers, storage and 24/7 monitoring of ten ultra low temperature freezers and annual preventative maintenance in an offsite storage facility. Space is an ongoing issue in NCGC Biology laboratory and keeping these large freezers in the lab is no longer feasible. NCATS lacks the space on site in any other building to store these freezers and the contents are not required on site for daily operations. Seven of our freezers are currently located at this storage facility, which provides 24/7 REES monitoring to ensure that the contents are kept at -80C temperature. The facility also ensures that a yearly preventative maintenance inspection and calibration is completed. Project Description Contractor Requirements: 1.The vendor shall install 3 new freezers at the Kamtek facility in Frederick, MD 2.The vendor shall store a total of ten ultra-low temperature freezers (-80C) 3.The vendor shall monitor the temperature and conditions of each freezer 24 hours a day 4.The vendor shall complete preventative maintenance and calibration of each freezer every year Preventive Maintenance: Performed by validated vendor Airflow Environmental and the Temperature probe calibration provided by a certified technician of Rees Scientific. This includes: 1.Check the following and clean if needed: a.condenser b.door gasket, note if replacement needed c.air filter 2.Lubricate condenser, evaporator fans if needed 3.Check for unusual noise or vibration 4.Check for refrigerant/oil leaks 5.Verify temperature control 6.Check electrical connections, cord and plug for wear 7.For High & Low stage compressors, note the rated amps, and the actual amps 8.Check in freezer compartment for ice buildup. Does it need defrosted? 9.Note if any items need replaced or serviced so NCATS can have this completed The personnel to perform maintenance and qualifications are KTI Validated vendors. Emergency Service: Repair cost to be covered by contract and vendor is not responsible for any parts. Vendor will arrange for freezer diagnosis and get quote for repair and parts. (Empty freezer available as back-up freezer for emergency transfers). Danielle Bougie at NCATS will be notified immediately if it happens during normal business hours or by next business day if freezer break down happens after business hours. Accessibility: Access to the storage facility is required during normal business hours, M-F. NIH will provide notification to the contractor of required access to the facility at least 24 hours in advance. Records are sent within 3-5 business days once received and reviewed. Delivery/Period of Performance One year contract; POP one year from date of award Contract Type A firm fixed price purchase order within the Simplified Acquisition threshold is anticipated. Payment shall be remitted using Electronic Funds Transfer on a NET30 basis. RESPONSE INSTRUCTIONS Responses to this solicitation must include sufficient information to establish the interested parties' bona-fide capabilities of providing the product or service. Offerors must provide both 1) a technical response and 2) a separate price quote. The price quote shall include: unit price, list price, shipping and handling costs, delivery days after contract award, delivery terms, prompt payment discount terms, F.O.B. Point (Destination or Origin), product or catalog number(s); product description; and any other information or factors that may be considered in the award decision. Such factors may include: past performance; special features required for effective program performance; trade-in considerations; probable life of the item selected as compared with that of a comparable item; warranty considerations; and maintenance availability. APPLICABLE TERMS AND CONDITIONS INCORPORATED BY REFERENCE The following FAR clauses and provisions shall apply to this solicitation: 1.All Offerors MUST be actively registered in the System for Award Management (SAM) www.sam.gov. 2.FAR clauses 52.212-4, Contract Terms and Conditions - Commercial Items (May 2015) and 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items (March 2016) apply to this acquisition. In addition, the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size must be included in the response.
