- Description
- The Office of Acquisition and Agreements Management (OAAM), of the National Institute of Standards and Technology (NIST), on behalf of the Material Measurement Laboratory (MML), intends to negotiate on a sole source basis with EDAX, Inc. of Mahwah, NJ, for a service agreement for a NIST-owned Team Pegasus integrated microanalysis system with Octane Plus X-ray Detector and Hikari XP Electron Backscatter Diffraction Detector. The EDAX microanalysis system is a complex and proprietary piece of equipment that must be maintained and tested according to the manufacturer specifications. The period of performance for the maintenance agreement shall be a base period of one year with four one-year option periods. The NAICS code for this requirement is 811219 and the small business size standard is $20.5M. Sole source determination is based on the following: EDAX is the manufacturer and sole distributor of the equipment. All technology is owned by EDAX and is proprietary to EDAX. Technology is not accessible to any other party. EDAX does not sell detector components to third party vendors. Therefore, a third party source could not provide replacement parts. Software updates are provided through the service engineers or through direct email or download link to customers with service agreements for off-line analysis products. Software updates are not available on-line or through any source other than EDAX. Because the software is intimately tied to the detector performance, each software update requires service engineer to perform calibration and performance tests. Service manuals are provided to the service engineers and are not available for the customers. All service level functions including the calibration and performance testing utilities are only accessible to EDAX service engineers. Users or third party vendors do not have access to these tools. EDAX does not have authorized service partners or resellers. Troubleshooting, calibration, and testing as well as technical details for the detector and software are only available through EDAX service engineers. Without access to this type of information, it is not possible to maintain the EDAX equipment. No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, responses received by August 8, 2016, will be considered by the Government. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
