- JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity: Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724 2. Description of Action: This proposed action is for a firm-fixed-price delivery order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC). 3. Description of the Supplies or Services: VA, Office of Information and Technology, Service, Delivery, and Engineering, Cooperative Studies Program (CSP) Clinical Research Pharmacy Coordinating Center has a requirement for brand name Hewlett-Packard (HP) hardware warranty and software maintenance renewal for all hardware and software components that comprise the storage area network (SAN). The HP hardware warranty subscription provides for unlimited hardware problem diagnosis and repair including four hour on-site problem response which is available 24X7. CSP also requires renewal of an HP Data Protector software license maintenance, HP hardware support, and support for a HP C7000 blade system enclosure, associated blade hardware, and all components of the SAN which includes 24x7 coverage. The period of performance shall be August 1, 2016 through July 31, 2017 with four 12-month option periods if exercised. 4. Statutory Authority: The statutory authority permitting this exception to fair opportunity is 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) Subpart 16.505(b)(2)(i)(B) entitled, "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5. Rationale Supporting Use of Authority Cited Above: Based on market research, as described in section 8 of this document, it was determined that limited competition is available among authorized resellers for the aforementioned brand name HP warranty and maintenance support. Only HP brand hardware warranty and software maintenance will fulfill the Government's requirements for HP maintenance services due to the proprietary nature of the software and hardware. A non-HP service provider would be unable to provide the appropriate hardware warranty and software necessary for maintenance activities because only HP or authorized HP reseller service providers are able to acquire the proprietary data necessary to implement specific software upgrades, patches, bug fixes, and revision upgrades. The Government contacted HP in January 2016 to ascertain if this proprietary source code is for sale and was advised that the code is not for sale. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. Limited competition is anticipated for the required HP hardware warranty and software maintenance renewal. In accordance with FAR 5.301 and 16.505(b)(2), this action will be synopsized after award on the Federal Business Opportunities Page and the justification will be made publicly available. This Justification for an Exception to Fair Opportunity will be posted with the solicitation on the NASA SEWP V GWAC website. 7. Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government's technical experts will continue to perform market research to determine if there are changes in the market place that would enable future actions to be competed. 8. Market Research: Market research was conducted in May 2016 consisting of web searches and reviews of Dell product offerings to determine if alternative products were capable of satisfying the Government's requirements. The Government's technical representative contacted Dell directly and confirmed that Dell cannot support an HP brand system or any HP software. Only HP or authorized resellers are capable of providing the required hardware warranty and software maintenance necessary for the existing SAN. In May 2016, the Contract Specialist conducted additional market research utilizing the NASA SEWP V GWAC Provider Look-up tool and identified multiple authorized resellers of HP products and services that hold a current GWAC. 9.
