Description
The Department of Housing and Urban Development (HUD) intends to award a contract on a sole-source bases, in accordance with FAR Part 15, to Lockheed Martine, located at 2275 Research Blvd, Rockville, MD 20850. The sole source justification is issued under the authority of 6.302-2 (a)(2) "Unusual and compelling urgency and No Other Supplies or Services Will Satisfy Agency Requirements" as implemented by FAR 6.302-2. E-Discovery Management System (EDMS) allows the Department to comply with the preservation and production requirements for ESI, paper records, and other evidence imposed by the FRCP. The current contract with Lockheed Martin providing E-Discovery Management System and Program support is in its final option year and will expire on September 29, 2016. These services will be migrated to the HEAT contract that is currently in active procurement with a planned, but not actual award date. Given critical court discovery deadlines, HUD intends to award a sole-source contract to ensure that there is no lapse of E-Discovery support for HUD, and the Secretary is not exposed to the risk of costly sanctions. There is no guarantee that the HEAT contract will be awarded and HUD Network support will be sufficiently transitioned to ensure its ability to seamlessly meet the Department's E-Discovery needs by September 30, 2016. E-Discovery continued support, with no lapse in service, is imperative to protect the Department's interest in effective and successful litigation and to avoid the high costs of noncompliance. Market research shows that Lockheed Martine is the only vendor with the capacity to provide all of the above requirements to support HUD's program needs with no lapse in services or lengthy transition. The anticipated award date is September 29, 2016.
