- This is a NOTICE OF INTENT TO AWARD A SOLE SOURCE PURCHASE ORDER using Federal Acquisition Regulation (FAR) Part 13 Simplified Acquisition Procedures and FAR Part 12 Acquisition of Commercial Items. The Nuclear Regulatory Commission (NRC) intends to make a sole source award to DrugPak, LLC | P.O. Box 51174 | Knoxville, TN 37950-1174. NRC has a requirement for license, annual maintenance and support on the DrugPak software for a base and four option years. DrugPak’s software is proprietary software, which, under a previous NRC contract, DrugPak has customized for application of the NRC drug testing program. As such, no other vendor is allowed to change DrugPak’s software, as DrugPak LLC retains title and ownership. Should the NRC contract to an alternate commercial vendor, the NRC would be duplicating costs that have already been expended for software and hardware set up, data configuration, data conversion and software customization. In addition to duplicating costs, a new vendor’s setup, conversion and customization would impact the deployment, thus jeopardizing disruption of NRC’s ongoing federally mandated drug testing program, causing a serious time delay for the NRC and its ability to meet federal regulations for performing NRC’s drug testing program. The proposed purchase order is for services for which the Government intends to solicit and negotiate with only one source under Simplified Acquisition Procedures (SAP), authorized by FAR Subpart 13.106-1(b)(1)(i). For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available. Interested parties may identify their interest and capability to respond to the requirement Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government in future procurements. TELEPHONE RESPONSES WILL NOT BE ACCEPTED. This notice is not a request for competitive proposals or a solicitation of offers. A determination by the government not to compete this proposed effort on a full and open competition basis, based upon responses to this notice, is solely within the discretion of the government.
