- DETERMINATION AND FINDINGS JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Sclogic, Inc. DETERMINATION In accordance with FAR 6.303, the following justification is offered: 1. The US Small Business Administration Acquisition Division desires to enter into a sole source procurement with Sclogic, LLC for maintenance on mail equipment in the Headquarters mailroom for the Administrative Services Division against REQ #6303030EQ0020. 2. A one year purchase order will be awarded to Sclogic, Inc. for these services. 3. The US Small Business Administration has a requirement for a company to provide maintenance on equipment used to record/track all UPS, Fed Ex and certified mail in the mailroom for an estimated amount of $3,959.00. 4. Statutory Authority 6.302-1, "Only One Responsible Source and No other Supplies or Services Will Satisfy Agency Requirements" is being cited as the authority permitting other than full and open competition. 5. The source itself provided a letter dated June 9, 2016 (found under TAB 9), which confirms the tracking system, Intra, is proprietary and confirm they are the manufacturer and sole source provider of the Intra software product line. Replacement or substitution of this product would result in additional evaluation, implementation cost and training. It would also have an impact on OCFO security operations. In order to maintain the equipment that is currently in the mailroom, Sclogic, LLC must be contract with as they are the only provider of this service. 6. Initially competition was sought for this equipment, with Slogic being the successful offeror. As the award amount is under $25,000.00, this requirement was not advertised in FedBizOps. 7. The anticipated cost is considered fair and reasonable as the price did not fluctuate from last year's award, also for $3,959.00. 8. Market research was not conducted as this is proprietary tracking services only available from Slogic, LLC with the equipment that is in place in the mailroom. 9. As this is a follow-on acquisition, an estimate of a minimum of $8,000.00 in cost to the Government would be duplicated based on arranging to have current equipment removed and new replaced, along with training and familiarity and clearing through OCIO security requirements. 10. No other sources expressed, in writing, an interest in this acquisition. 11. The Agency is not anticipating taking any action to remove or overcome any barriers to competition before any subsequent acquisition for the services required. FINDINGS As a result of the preceding determinations, the undersigned finds that the award amount of $3,959.00 is fair and reasonable and a sole source acquisition shall be awarded to Slogic, LLC against purchase order SBAHQ-16-M-0144.
