- CDRL A001 and A002 SOW Curtains This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation. Quotes are being requested; a written solicitation will not be issued. W15QKN-16-Q-0132 is issued as a Request for Quotation (RFQ) and this solicitation and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-89. This requirement has been set-aside for small businesses under NAICS 314120 with a small business size standard of 750 employees. The U.S. Army Contracting Command (ACC-NJ), Picatinny Arsenal, NJ intends to award one (1) Firm-Fixed Price (FFP) purchase order, on a competitive basis, for stage (theater) curtains for the Lindner Conference Center in accordance with the requirements contained in the attached Statement of Work (SOW) (see attached SOW LCC Curtains PDF), and the attached Contract Data Requirements Lists (CDRLs) (see attached CDRL A001 and A002 PDF). All items shall be delivered F.O.B. Destination (Picatinny Arsenal, NJ). The delivery and installation of the stage curtains and tracks shall be completed within 120 days of purchase order award. FAR provision 52.212-1, Instructions to Offerors - Commercial, and the following addenda applies to this acquisition: Site Visit: All offerors who intend to quote on this solicitation are strongly recommended to attend a site visit of the Lindner Conference Center in Bldg. 93 at Picatinny Arsenal, NJ on Friday, 19 August 2016 between 8:30AM - 3:00PM EST. Offerors shall schedule their site visit at least two (2) business days prior via email to the ACC-NJ POC William Tenz, william.d.tenz.civ@mail.mil, and shall have proper identification when attending the site visit. Please see FAR provision 52.237-1, Site Visit, provided in full text below. The quote shall be labeled in a consistent manner. All references to the Statement of Work (SOW) shall be clearly labeled with the appropriate SOW paragraph. Quotes shall be presented in sufficient detail to allow the Government evaluation to the solicitation requirements without the need for clarifications or discussions. The Government will not assume the offeror possesses any capability, understanding, or commitment not specified in the quote and does not assume the responsibility to search for information to cure inconsistencies identified in quotes. The burden of proving acceptability remains with the offeror. No direct discussion between the technical representative and a prospective offeror shall be conducted. All inquiries/questions and quote submissions for this acquisition, either technical or contractual, shall be submitted via email to the ACC-NJ POC William Tenz, william.d.tenz.civ@mail.mil, phone calls will NOT be accepted. Quotes shall be received no later than 26 August 2016 by 3:00PM EST. FAR provision 52.212-2, Evaluation - Commercial Items, completed as follows is applicable to this acquisition: (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (i) technical capability of the item offered to meet the Government requirement; (ii) past performance (see FAR 15.304); (iii) price. Technical and past performance, when combined, are more important when compared to price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (End of Provision) Offerors shall include a completed copy of FAR provision 52.212-3, Offeror Representations and Certification - Commercial Items, or indicate that your company's representation's and certifications are current and available via the System for Award Management (SAM) at www.sam.gov. FAR clause 52.212-4, Contract Terms and Conditions - Commercial Items is applicable to this acquisition. FAR clause 52.212-5, Contract Terms and Conditions Required To Implement Statutes Or Executive Orders - Commercial Items, with the additional FAR clauses cited are applicable to this acquisition: 52.204-10, 52.209-6, 52.209-10, 52.219-6, 52.219-28, 52.222-3, 52.222-19, 52.222-21, 52.222-26, 52.222-36, 52.222-50, 42.223-18, 52.232-33, 52.233-3, 52.233-4 and 52.247-34. FAR 52.237-1 Site Visit (Apr 1984) Offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award.
