- Statement of Work Pursuant to 41 U.S.C. 1901 as implemented by Federal Acquisition Regulation (FAR) Subpart 13.501 and consistent with the content requirements of FAR 6.303-2. •1. Agency and Contracting Activity. The Department of Homeland Security, U.S. Customs and Border Protection, Procurement Directorate, Border Enforcement Contracting Division, intends to award a sole source contract for development of video production to be used in recruitment and retention purposes. •2. Nature and/or description of the action being approved. •a. Type of action: Firm-fixed price contract •b. Amount: $29,500.00 •c. Type of funding: Annual O&M •d. Year of funding: FY 2016 •e. Other brief descriptive words and phrases: DHS intends to award a sole source contract to Websedge LTD, Two London Bridge, London, UK, SE1 9RA video production. Customs and Border Protection (CBP), U.S. Border Patrol, will be participating in the International Association of Chiefs of Police Annual Meeting (IACP). In preparation for this a video production which will include interviews with client spokespeople and case study material will be developed for presentation during the conference. The IACP has an agreement with Websedge LTD for all production and streaming processes in connection with the annual conference. This action is being taken pursuant to FAR 13.501. •3. Description of Supplies/Services (including the estimated value). Websedge LTD will develop a three to five minute film production, producing a series of news programs at the annual conference to include the client's film in one or more of the following programs: •a. Broadcast the film to attendees of the conference •b. Make copies of the program(s) available to all delegates upon request •c. Stream and host the client's film on-line for 12 months (one year) after the event. •d. Screen the client's film at the event via a dedicated television channel in selected delegate's hotels in the area. •e. Provide the client a link to their film for marketing purposes •f. Pre-production consultation on the client's topic and schedule 45 days in advance of the broadcast event. •g. Two days of filming, with final approval of film before broadcast. Inclusion in any social media activities carried out by IACP TV for the conference. •h. Use of any rushes/B-Roll (including unused footage) for client's own purposes via royalty-free, indefinite license. •i. Delivery of all assets including footage from the shoot, a high quality master digital file plus a file in format suitable to marketing needs. •j. Total cost is $29,500.00 •4. Identification of the authority. This action is being taken under the authority of the FAR 13.501, Simplified Procedures for Certain Commercial Items and 41 U.S.C. 1901. 5. Demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited. The IACP has contracted with Websedge, LTD for broadcasting of conference events, participants of the IACP conference coordinate all film and video productions with Websedge, LTD to be included with conference productions. 6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. N/A IACP works exclusively with Websedge, LTD. 7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable. The contracting officer determined, based on current and historical data (previous contracts) price analysis, that the prices being proposed by Websedge, LTD are fair and reasonable. 8. Description of market research. The market research was gathered from the review of past CBP contracts, current government contracts among other agencies such as FBI, FEMA, ICE and similar agencies. 9. Any other facts supporting the justification. In order to provide video production in time to meet the conference suspense, it is critical that use of Websedge services are available. Recruitment and retention efforts are on-going among CBP agencies, these services and the resulting productions will facilitate recruitment efforts in the months and year(s) to come. 10. A listing of the sources, if any that expressed, in writing, an interest in the acquisition. No other company has expressed, in writing, an interest in the acquisition. 11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for supplies or services required. This procurement is time sensitive, CBP will do additional market research to determine if any alternatives become viable or new services become available to meet our needs. 12. Technical/Requirements Personnel Certification. I certify this requirement meets the Government's minimum need and that the supporting data, which forms a basis for this justification, is complete and accurate.
