Description
Special Notice It is the intent of the National Archives and Records Administration (NARA) to enter into a firm fixed price purchase order with Eastman Kodak to purchase Kodak film stock. The proposed action will be conducted in accordance with FAR Part 12, Acquisition of Commercial Items. The NAICS code is 325992. The proposed action is for supplies for which the Government intends to solicit and negotiate under the authority of FAR 6.302, only one responsible source and no other supplies or services will satisfy agency requirements. Interested persons may identify their interest and capability to respond to the requirement or submit quotations no later than 4:00 p.m. eastern time August 31, 2016. This notice of intent is not a request for competitive quotations. However, all quotations received after the date of publication of this synopsis and prior to 4:00 p.m. eastern time August 31, 2016, will be considered by the Government. A determination by the Government not to compete this proposed purchase order based upon responses to this notice is solely within the discretion of the Government. This purchase order will be awarded using simplified acquisition procedures in accordance with FAR Part 13. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs incurred in responding to this notice. IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY, AND SPECIFIC IDENTIFICATION OF THE DOCUMENT AS A "JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION" See Page 1 II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED We are requesting to purchase Eastman Kodak Film Stock for the preservation of the Motion Picture Collection. Purchasing this film stock will not only make it possible to preserve the records, but also to make them accessible for individual researchers and the public at large. Eastman Kodak is the only supplier of this particular duplicating positive and panchromatic negative film required to work in conjunction with old originals. Fuji no longer creates motion picture film stock. AGFA manufactures sound stock and color stock, however, we have a contract in place with Colorlab to process (i.e. develop our color film) and Colorlab has confirmed that they are only capable of processing Kodak film stock at this time. There are no other local vendors able to process film. NARA's requirement for the film collection is that labs must be within a 50 mile radius and be able to pick up/ deliver film within one working day. The next closest geographical location is NYC. Also, Colorlab is the only company on GSA schedule. Our printers and color analyzer are calibrated within specification of Colorlab's processors. All three pieces need to be symbiotic to maintain consistent quality when creating new film copies. We do semi-annual tests with Colorlab to ensure that we're within specifications. All of our equipment is calibrated to Kodak standards. Our Laboratory Aim Density patches are Kodak stock calibrated which is what we use to ensure that the gamma/ color correction adjustments we make on the Color Analyzer are accurately represented during the printing process. III. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS (INCLUDING THE ESTIMATED VALUE) The NARA Motion Picture Preservation Laboratory requires specialized film stock for its preservation operations related to old, deteriorated motion picture film. This film stock is required for continuing operations in the NARA motion picture preservation laboratory. The following film stock is needed: Kodak 16mm 3378 sound recording film stock, order number 8910663 - 100 reels Kodak 16mm 3273 color internegative film stock, order number 8002743 - 48 reels Kodak 16mm 3383 color print film stock, order number 1524537 - 50 reels Kodak 35mm 2383 color print film stock, order number 8523581 - 38 reels Kodak 35mm 2234 fine grain negative film stock, order number 8436354 - 75 reels Kodak 35mm 2366 fine grain print film stock, order number 1336361 - 100 reels The total estimated value is: $ IV. AN IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION. 41 U.S.C. 3304(a)(1) -"Only One Responsible Source" as implemented by FAR 6.302-1. V. A DEMONSTRATION THAT THE PROPOSED CONTRACTOR'S UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED This acquisition meets the authority of FAR 6.302-1 which states that this authority may be used "when the supplies or services required by the agency are available from only one responsible source, or,...from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for." See above II. VI. A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED AS REQUIRED BY SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION UNDER 5.202 APPLIES. A notice of intent to sole source will be posted on Federal Business Opportunities for 15 days. VII. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE. The cost to NARA is the same cost as that provided to any other user of motion picture film - both in the private sector as well as the federal government (Library of Congress). Based on the information provided, the anticipated cost will be fair and reasonable. VIII.
