- Department of Labor Wage Determination 05-2307 Revision 18, dated 29 December 2015 Solicitation - CLINs, Clauses, Provisions and Guidance Performance Work Standard that includes all standards, specific tasks, Regulations, Rules and Guidance I. This is a combined synopsis/solicitation for commercial services prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested for a Best Value Source Selection and proposals will be evaluated using the Lowest Priced Technically Acceptable approach II. This solicitation, for Full Food Service at Fort Leavenworth, Kansas, is issued as a request for quotation. III. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-58, effective 18 May 2012. IV. The NAICS codes for this requirement is 722310 Food Service Contractors, Size Standard $38,500,000. This is a Total Small Business Set Aside, under Far Part 19.502-2 with RSA priority. V. This combined synopsis/solicitation is for the following services: Firm Fixed Price Contract for Full Food Service at Fort Leavenworth, Kansas Dining Facility, Base year plus 4 Option Years. Please see attached Performance Work Statement. VI. Location: Building 638, Fort Leavenworth, Kansas, 66027. VII. "Randolph-Sheppard Act Applies to this Full Food Service Requirement - All offerors are hereby notified that this solicitation is subject to the Randolph-Sheppard Act and the priority it affords to blind vendors for operation of military dining facilities. - The blind have a priority right to operate dining facilities on federal property. This applies to the solicitation of Full Food Services (FFS) as defined in Army Regulation 30-22. - The Army applies this priority in accordance with Army Regulation 210-25 (which is incorporated into this solicitation and resulting contract). A proposal from a qualified offeror (State Licensing Agency on behalf of a blind vendor), whose evaluated proposal is included in the agency's competitive range determination may be awarded the FFS contract without further consideration of other highly rated proposals. - This notice is not designed to discourage competition; rather, it sets out the priority established by the RSA for proposals received from State Licensing Agencies and their blind vendors." VIII. Please see attached solicitation for all required provisions and clauses. IX. NOTE: Following information regarding quotations is provided: Competition will be sought to the fullest extent practicable by receipt of competitive proposals with priority being given to the SLA in accordance with the RSA. If the SLA's proposal, after initial evaluation, is determined to be in the competitive range, then the Contracting Officer shall initiate discussions solely with the SLA consistent with AR 210-25. Legal Effect of Quotations A quotation is not an offer and, consequently, cannot be accepted by the Government to form a binding contract. Therefore, issuance by the Government of an order in response to a supplier's quotation does not establish a contract. The order is an offer by the Government to the supplier to buy certain supplies or services upon specified terms and conditions. A contract is established when the supplier accepts the offer. When appropriate, the contracting officer may ask the supplier to indicate acceptance of an order by notification to the Government, preferably in writing. In other circumstances, the supplier may indicate acceptance by furnishing the supplies or services ordered or by proceeding with the work to the point where substantial performance has occurred. If the Government issues an order resulting from a quotation, the Government may (by written notice to the supplier, at any time before acceptance occurs) withdraw, amend, or cancel its offer.
