Description

JUSTIFICATION FOR SINGLE SOURCE AWARDS IAW FAR 13.106-1 (OVER MICRO-PURCHASE THRESHOLD($3K) BUT NOT EXCEEDING THE SAT ($150K)) IAW FAR13.104, COs must promote competition to the maximum extent practicable to obtain supplies and services from the source whose offer is the most advantageous to the Government, considering the administrative cost of the purchase. When competition is not practicable, IAW FAR13.106-1(b), COs solicit from a single source for purchases not exceeding the simplified acquisition threshold. COs may solicit from one source if the CO determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). IAW FAR13.106-3(b)(3),COs are required to include additional statements explaining the absence of competition (see 13.106-1 for brand name purchases) if only one source is solicited and the acquisition does not exceed the simplified acquisition threshold (does not apply to an acquisition of utility services available from only one source) or supporting the award decision if other than price-related factors were considered in selecting the supplier. This template when completed can be used to document single source awards IAW FAR13.106-3(b)(3). Note: Statements such as "only known source" or "only source which can meet the required delivery date" are inadequate to support a sole source purchase. 1. PURCHASE REQUEST OR REQUISITION NUMBER: 605-16-3-6027-05471A. PROJECT/TASK NUMBER NONE1B. ESTIMATED AMOUNT: $65,970.00 2. BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE: The Contractor shall perform on-site preventive maintenance and intervening repair services for equipment listed in the schedule of supplies/services for the VA Loma Linda Healthcare System (VALLHS). A firm fixed price contract is contemplated for award to Riverain Technologies, 3020 S. Tech Blvd., Miamisburg, OH 45342. 3. UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED: Riverain is the original equipment manufacturer and is the owner of proprietary software and parts. Riverain Technologies ClearRead Bone Suppression is a highly specialized x-ray bone suppression system and failure to have a service support could result to unacceptable downtimes that would compromise patient care. The Contractor is required to install and upgrade the software, replace and calibrate the equipment, replace defective parts, and ensure the equipment is in optimum working condition. This contract is vital to VALLHS and if not awarded could risk patients health. A firm fixed price contract is needed to maintain the equipment to and to provide healthcare to veteran beneficiaries. The estimated cost for the contract (base period with the Government option to extend up to three additional years) is $65,970. The period of performance is September 1, 2016 through August 31, 2020. 4. REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE, WHICH CAN PROVIDE THE SUPPLIES OR SERVICES: Riverain Technologies is the original manufacturer of the ClearRead Bone Suppression and holds the proprietary rights for the equipment, parts, and software. A third party vendor would not be able to compete with this requirement, as access to the software and parts are proprietary and restricted by Riverain Technologies. Additionally, Riverain Technologies doesn't provide third party vendors authorization to repair and maintain the equipment. Furthermore, another ClearRead Bone Suppression system may exist but it would be expensive for a replacement system, would take up to twelve (12) months to install and more time to train staff. Furthermore, improper maintenance or repair by an unauthorized vendor may impact patient care. 5. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND RESULTS OR STATEMENT WHY IT WAS NOT CONDUCTED: A sources sought notice was posted on FedBizOpps from August 8, 2016 through August 12, 2016 there no responses. An intent to sole source notice was published on FedBizOpps from August 13, 2016 through August 17, 2016 and there were no responses. 6. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b).
