Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity: Department of Veterans Affairs, NCO 12, Great Lakes Acquisition Center, 115 South 84th Street, Milwaukee, WI 53214. This requirement is for the Oscar G. Johnson VAMC, (Iron Mountain, MI) 2237 #585-16-4-6997-0937. 2.Nature and/or Description of the Action Being Processed: This document is for the justification and approval for other than full and open competition for emergency construction services acquired to renovate and upgrade Pharmacy Clean Rooms 1233, 1233A and 1233B at the Oscar G. Johnson VAMC, Iron Mountain, MI. This is a sole source request for proposal to one SDVOSB contractor for a new project that will be awarded as a firm-fixed price contract. 3.Description of Supplies/Services Required to Meet the Agency's Needs: Renovate and upgrade Pharmacy Clean Rooms 1233, 1233A and 1233B at the Oscar G. Johnson VAMC, Iron Mountain. This is an emergency requirement to ensure continued availability of suitable facilities for Chemotherapy and Oncology services to patients after September 30, 2016. 4.Statutory Authority Permitting Other than Full and Open Competition: In accordance with 41 USC §253(c)(2), as implemented by FAR 6.302-2 (2) Unusual and Compelling Urgency. The agency's need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This urgent and compelling requirements Request For Proposal will be sent to MBM Construction, Inc., a SDVOSB CVE certified contractor. Based upon our previous experience with MBM Construction, they have demonstrated having the qualifications and technical expertise to perform and satisfy the requirements of this urgent acquisition. The contractor is currently mobilized on site completing other associated projects. MBM Construction has completed several other similar projects at the facility and provided exceptional service at a fair and reasonable price. MBM Construction is registered as a CVE verified SDVOSB in the VetBizRegistry. They have performed well on previous and ongoing contracts at Oscar G. Johnson VAMC and have extensive knowledge of Oscar G. Johnson VAMC's infrastructure and can meet the timeline (NLT 30 SEP 16) requirement for this project. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: MBM Construction Inc. is a Service Disabled Veteran Owned Small Business located in Kingsford, MI. They have completed multiple successful projects at the Oscar G. Johnson VAMC, are familiar with both the building and contracting with the Department of Veterans Affairs and are currently mobilized in the local area. They were immediately available for a site visit tour and were able to return a proposal on the same day of the site visit. Because of this demonstrated competence, current status as a SDVOSB, and the particular urgency of this project, further competition was deemed impractical for this particular requirement. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: An Independent Government Estimate (IGE) of $123,200.00 was developed. This estimate will be used in determining the contractors' proposal price to be fair and reasonable. A detailed price breakdown will be provided by the contractor in reply to the Request for Proposal solicitation. The Government will perform price analysis and pricing will be evaluated against the Government IGE to determine that the proposed price is fair and reasonable and reflects reasonable value. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The VetBiz Registry results for NAICS Code 238220 found 53 matches for SDVOSB firms in Michigan. Therefore, competition would exist if the project is set aside for service disabled veteran owned small business (SDVOSB) and solicited IAW FAR Part 14. However, due to the urgency of this projects completion and the lengthy process time involved for a full and open competition, it is the contracting officer's determination that it is in the best interest of the Government to procure construction services as limited source procurement. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: The contractor is currently mobilized on site completing other associated projects. MBM Construction, Inc. has completed other projects at the facility and provided exceptional service at a fair and reasonable price. The contractor will self-perform by utilizing in house employees and their project labor agreement with other SDVOSB subcontractors to fulfill the SDVOSB performance requirement. 10Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: The intent to solicit as a sole source project will be posted on FBO. Upon approval of this request, I will post my intent to solicit as a sole source for project number 585-16-124. No other sources have expressed an interest in this procurement at this time as it has not been posted to FBO yet. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The need for the replacement had become urgent due to the expedited deterioration of the existing system. Steps will be taken to address concerns in an attempt to preclude the need for urgency, allowing for greater competition for subsequent acquisitions. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief. ______________________________________ Clifford SmithDate Associate Director Oscar G.
