- Preparing Technical and Price Proposal OPM Specific Clauses Statement of Work (SOW) OPM-10-16-Q-0001: Online Legislative Subscription - CLIA The purpose of this procurement is to establish a contract for an online subscription service for legislative database, tracking, and analysis services. Services starting 11 September 2016. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The subject Request for Quote (RFQ), OPM-10-16-Q-0001, incorporates provisions and clauses that are in effect through Federal Acquisition Circular 2005-85 (15 August 2016). This requirement is full and open competition. The North American Industry Classification Standard (NAICS) code is 511120 (Periodical Publishers) and the small business size standard is 500. Market research was conducted and it was determined that this acquisition could be fulfilled by Small Business. The closing date and time for this solicitation is 2 September 2016 (Tuesday) at 12:00 PM local time. Questions must be submitted no later than 31 August 2016 (Wednesday) at 10:00 AM EST local time; to allow time to post responses. Submit proposals and questions to Ms. Jamila Z. Vendors not registered in the System for Award Management (SAM) database by time of award; will not be considered for award. Vendors may register with SAM by accessing www.sam.gov. (8) Acknowledgement of Solicitation and any amendments (9) Past Performance Information: To include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information) (10) A statement that states: Agreement with all terms, conditions, and provisions included in the solicitation (11) Price in offer will be good for 45 calendar days from the date specified of receipt of proposal; unless in an addendum to the solicitation. Evaluation: The provision at FAR 52.212-2, Evaluation - Commercial Items shall apply to this acquisition. A contract will be awarded to the responsible vendor who is the lowest priced and technically acceptable (LPTA). The Government will evaluate vendor submissions to determine its technical capability to meet or exceed the requirements contained in the Statement of Work (Attachment A). Vendors who do not meet those criteria in listed in the SOW; will not be considered eligible for award. Vendor proposals will be evaluated as either "acceptable" or "unacceptable." The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: (1) Technical capability of the item offered to meet the Government requirement (2) Price Past performance will not be evaluated as an individual factor. Instead, the Contracting Officer will consider past performance as part of the required responsibility determination for the awardee. The Government intends to evaluate proposals and award a contract without discussions with vendors. Therefore, the offeror's initial proposal should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received. FAR Clause Information/Documentation: The vendor shall complete only paragraphs (b) of FAR provision 52.212-3 if the vendor has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site accessed through http://www.sam.gov. FAR 52.212-3, Offeror Representations and Certifications-Commercial Items, have been entered or updated in the last 12 months, are current, accurate, complete, and applicable to this solicitation (including the business size standard applicable to the NAICS code referenced for this solicitation), as of the date of this offer and are incorporated in this offer by reference (see FAR 4.1201), except for paragraphs ____________ {Offeror Fill-In as required}. If the vendor has not completed the annual representations and certifications electronically, the vendor shall complete only paragraphs (c) through (p) of the subject provision (FAR 52.212-3). The provision at FAR 52.212-4, Contract Terms and Conditions - Commercial Items (May 2015) applies to this acquisition. There is no separate addendum to the clause provided. The provision at FAR 52.212-5(a) and FAR 52.212-5(b), Contract Terms and Conditions - Commercial Items (Dec 2015) applies to this acquisition. There is no separate addendum to the clause provided. The following factors shall be used to evaluate offers: • Technical capability of the item offered to meet the Government requirement • Price (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. 52.217-8 -- Option to Extend Services. As prescribed in 17.208(f), insert a clause substantially the same as the following: Option to Extend Services (Nov 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within ______ [insert the period of time within which the Contracting Officer may exercise the option]. (End of Clause) 52.217-9 -- Option to Extend the Term of the Contract. As prescribed in 17.208(g), insert a clause substantially the same as the following: Option to Extend the Term of the Contract (Mar 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within _60 days__; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least _60_ days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed _3 Yrs / 00 Mths_ (months)(years).
