Description
The Department of Justice (DoJ), Office of the Inspector General (OIG), Washington D.C. intends to issue a sole source purchase order in accordance with FAR 6.302-1. The purchase order will be issued to Data Security, Inc. for a multi-media destruction device. The description of the product to be ordered: The DoJ OIG Office of Security Programs (OSP) requires a device to properly destroy IT removable media and storage devices. The device must be listed on the NSA/CSS Evaluated Products List for High Security Solid State Destruction Devices as passing evaluation by the NSA for the physical destruction of solid state media, such as memory cards, thumb drives, solid state drives, cell phones, and tablets, as well as optical media such as CDs and DVDs. This particular device is able to destroy media to a particle size of no more than 2 mm in any direction. It has an internal brain to sense overload and momentarily reverse automatically to clear and prevent jams, and has a small size for space considerations. The device's blades, grinders, and screens are easily reused, adjusted, and replaced. After extensive market research, no other device is able to meet those unique qualities that will allow the OSP to carry out its duties in keeping information produced by the DoJ safe. The statutory authority permitting other than full and open competition is 41 U.S.C 253 (c)(1) as cited in FAR 6.302-1, 'Only one responsible source and no other supplies or services will satisfy agency requirements.' Data Security, Inc. is the manufacturer and sole provider of the SSMD-2mm destruction device; Data Security Inc. has no authorized distributors in the USA. This purchase order is therefore issued as a sole source to Data Security Inc. to ensure the OSP's data destruction procedures are in compliance with the NSA's requirements, and OSP can also have access to the unique qualities that Data Security's destruction device provides to ensure efficient and effective carrying out of destruction of secure data. This notice of intent is not a request for competitive proposals, as no solicitation package will be issued. However, if a firm believes it can provide a destruction device approved by NSA and with qualities allowing for safe, secure, efficient, and effective destruction of data, it may give notification via e-mail to Christie Deskiewicz, Contracting Officer, at christie.m.deskiewicz@usdoj.gov no later than September 6th, 2016, 11:59 p.m., ET. The Government will review all responses without prejudice, whether or not the Government initially determines that another firm is fully-qualified to fulfill the requirements.
