Description
On August 31, 2016, the Technology Acquisition Center awarded Delivery Order VA118-16-F-1338 under the terms and conditions of National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V contract NNG15SD19B with Alvarez & Associates (Alvarez), located at 8251 Greensboro Drive Suite 230, Tysons Corner, VA 22102. Alvarez will be providing Vocera hardware, software licenses, maintenance, installation and training. The period of performance is August 31, 2016 through August 30, 2017, plus two years of extended warranty from date of installation, the total order value of $399,451.87. ? JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724 2. Description of Action: This proposed action is for the award of a firm-fixed-price task order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC) for the procurement of brand name Vocera hardware, software licenses, maintenance, installation and training. 3. Description of the Supplies or Services: VA, Gulf Coast Veterans Health Care System (GCVHCS) has a requirement for brand name Vocera hardware, software licenses, maintenance, installation and training. GCVHCS requires a solution for integrating the current nurse call and telephony systems with a hands-free portable communication system. The hands-free badges and smart devices must interface with the internal VA Wi-Fi network and be currently Federal Information Processing Standard Publication 140-2 compliant. Also, the system must have an approved Health Level Seven International bi-directional interface to be placed in either the active directory or the medical device operating unit. This will enable a direct line of communication with VA's Computerized Patient Record System. In order to maximize information security, the system requires acceptance of McAfee Anti-Virus software and Windows operating system patches. If a physical and/or virtual server is needed, it must run on at least Windows 2008 R2 operating system and utilize Structured Query Language 2012 R2. Delivery is required within 30 days of award. The period of performance for the standard warranty and Customer Care warranty shall be 2 years from date of installation. The Vocera Premier Support is 12 months from date of installation. Installation is required and shall be completed within 180 days of award. 4. Statutory Authority: The statutory authority permitting this exception to fair opportunity is 41 U.S.C. 4106(c)(2) as implemented by Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5. Rationale Supporting Use of Authority Cited Above: Based on market research, as described in section eight of this justification, the Government has determined that limited competition is available for the required brand name Vocera products. Vocera products are the only products that satisfy VA's requirements, which includes the solution interfacing with the current physiological monitoring systems, the ability to transmit the waveforms from the monitors to a smart device or tablet, and the ability to send text messages through a secure forum that follows the Office of Information Technology and Office of Information Security standards and regulations. The Vocera B3000 hands-free badges and Symbol MC40-HC are FIPS140-2 compliant equipment allowing for the hardware to transmit data safely on the VA-supplied, wireless network. Additionally, the Vocera Clinical Workflow Engine, Clinical Analytics, telephony technology and Patient Monitoring Wave Form Connector have met the HL7 criteria permitting the applications to connect to the VA-network and transmit data to the connected servers. The GCVHCS utilizes both bedside and telemetry monitors in the inpatient wards. The required solution must also have the ability to transmit the waveforms from the monitors to a smart device or tablet. Concurrently, the technology must have the ability to send text messages through a secure forum that follows the Office of Information Technology and Office of Information Security standards and regulations. No other products meet these VA requirements, as noted in section eight of this document. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in section eight of this justification. This effort did not yield any additional sources that can meet the Government's requirements. It was determined that limited competition is viable among authorized resellers for the required brand name Vocera products. In accordance with FAR 5.301 and 16.505(b)(2)(ii)(D), notice of award of this action will be synopsized and this justification will be made publicly available within 14 days of award on the Federal Business Opportunities Page. In accordance with FAR 16.505(a)(4)(iii)(A), this justification will be posted with the request for quotation on the NASA SEWP V GWAC website to notify all interested parties. 7. Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the agency will work with the program office to continue to perform market research to consider and ascertain if any other sources can provide these services in the future. To accomplish this, VA will continue to review industry publications, commercial directories, Government source lists, contacts with other potential or Governmental customers to identify sources known to them. 8. Market Research: The Government's technical experts performed market research during March 2016 by reviewing similar sources to ascertain if alternate brands could meet VA's requirements. Specifically, the Government's technical experts conducted web-based research on web sites of vendors including Extension Healthcare and Cisco Systems Incorporated which provide similar type products. However, none of the products reviewed has the capability to provide all of the required functionality to include a telephony interface with landline phones, an interface with the physiological monitoring systems so the waveforms can be transmitted to a tablet remotely, and secure text messaging between users that meet the FIPS 140-2 guidelines for wireless systems. On June 22, 2016 the Contract Specialist contacted Vocera directly to determine if they had any authorized resellers on either NASA SEWP or General Services Administration (GSA) Federal Supply Schedules. Vocera stated that they currently have one authorized reseller on NASA SEWP. VA conducted additional market research for Vocera resellers through by using the Provider Lookup tool under the NASA SEWP V GWAC, which yielded one reseller of the Vocera products. The NASA SEWP V GWAC has a dynamic catalog where line items can be added based on customer requests; therefore, as long as the required item or service is within scope of the NASA SEWP V GWAC, items and services can be added to the catalog on a daily basis. Based on the results of the market research and NASA SEWP's dynamic catalog, limited competition is expected for this proposed action based upon the identification of brand name requirements. 9.
