Description
THIS IS A NOTICE OF INTENT, NOT A REQUEST FOR PROPOSAL. A SOLICITATION DOCUMENT WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. This notice is being published by the National Institute of Environmental Health Sciences (NIEHS) in accordance with Federal Acquisition Regulation (FAR) Parts 5.201 and 5.204 requiring notice of a proposed contract action. This is a notice of intent to acquire equipment a sole-source basis. This is NOT a request for competitive proposals. The statutory authority for this sole source action is 41U.S.C. 253(c)(1) as implemented by FAR 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements. Inherent duplication of cost to the Government and delays in service make competition impractical for the acquisition. Award is subject to Justification for Other Than Full and Open Competition (JOFOC) approval. This sole source acquisition will ensure research data consistency. Specifically research data, to date has been collected using a Saturn 92 CCD detector that is obsolete. Obtaining a detector from the Original Equipment Manufacturer (OEM) will ensure data integrity and analysis is not compromised. The National Institute of Environmental Health Science (NIEHS) intends to award a Purchase Order to Rigaku Americas Corporation, 9009 New Trails Drive, The Woodlands, Texas, USA 77381-5209 to acquire a Pilatus 200K 2D Area Detector for researchers at NIEHS, Research Triangle Park campus. The North American industry Classification System (NAICS) Code is 334516 and the business size standard is 1,000 employees. NO SOLICITATION OR REQUEST FOR QUOTE (RFQ) IS AVAILABLE. It has been determined that Rigaku Americas Corporation is the only known responsible source capable of providing the required equipment and no other equipment will satisfy the agency's requirements. The purpose of this action is to acquire a newer detector allowing for capabilities beyond our existing system. Obtaining the detector from the same manufacture as the rest of the system will: 1) negate compatibility issues between generator/goniometer and the detector; 2) negate the uncertainty of determining which vendor is accountable for maintaining the interface of the equipment; 3) reduce training time on different software from our existing system; 4) reduce likelihood of user error that could be detrimental to the sample, equipment or safety of the user. Discarding the Saturn 92 and acquiring the Saturn 944, requires that de­ installation/re-installation be done by Rigaku Americas Corporation to continue our existing service contract. This notice of intent is not a solicitation or request for quotes. Notwithstanding, any firm that believes it is capable of meeting NIEHS' requirement, as stated herein, may submit their corporate capabilities, which, if received by the response date of this announcement, may be considered. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Written responses to this synopsis shall contain sufficient documentation to establish capability to fulfill this requirement. NIEHS will not be responsible for any costs incurred by interested parties in responding to this notice. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Responses to this posting must be in writing and emailed to Jimmy Bryant at bryant5@niehs.nih.gov and are due by 4:30PM ET on September 12, 2016. Respondents are responsible for ensuring that "JEB4214860" notice is included in the subject line of all email correspondence.
