Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; offers are being requested and a written solicitation will not be issued. The solicitation number for this acquisition is W912EP-16-T-0017 and it is being issued as a Request for Proposal. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-89. This requirement is being offered as a Small Business Set-Aside. The NAICS code is 453910. The small business size standard is $20.5 million. The U.S. Army Corps of Engineers, Jacksonville, FL District has a need for Custom Animal Cages. The Jacksonville District intends to award from this combined synopsis/solicitation to the responsible offeror whose offer represent the best value after evaluation in accordance with the factors and their relative importance in this solicitation. 1. Description of Requirements: 1.1 General Description: The contractor shall furnish and ship: eight custom individual standalone cages for large animals and one large bank of standard cages with 9 units and include assembly instructions. 1.2 Characteristics of these Items: CLIN0001 -Custom Cages for Large Animals: The contractor shall provide eight (each) custom individual standalone cages for large animals. The cages shall have the following characteristics: Dimensions: 6' High x 6' Wide (Door Side) x 6' Deep Frame: 1" Square Anodized Aluminum configured as bolt together panels Floor: Solid Aluminum Sides and Roof: 1" x 1" Steel wire mesh with extra/replacement fasteners provided Walk-in door Latch: Stainless steel spring loaded bar latch Guillotine (or similar) door: Preferably inset into walk-in door 24" x 14" for transferring problem animals between cages without exposing personnel to injury. Wheels: Steel Casters (swivel with brakes on the two wheels on the walk in door side (front of cage) and straight line non-brake opposite side (back of cage) Spray Shields: 3' high x 6' wide, solid and hangable from the steel wire mesh CLIN0002 - Standard Cages for Small Animals: The contractor shall provide one large bank of nine small cages for small animals. The cages shall have the following characteristics: Dimensions: Overall 6' high x 9' wide x 30" deep - 3 level cage housing 9 units: Each unit 2' high x 3' wide x 30" deep 9 doors with 6 removable solid vertical dividers so that each level can be used as one larger cage instead of two smaller ones. Frame: 1" Square Anodized Aluminum configured as bolt together panels Floors on each level: Solid Aluminum Sides and Roof: 1" x 1" Steel wire mesh with extra/replacement fasteners provided Door Latch: Stainless steel spring loaded bar latch Wheels: Steel Casters (swivel with brakes on the two wheels on one end of the narrow face of the cage (side/end of cage) and straight line non-brake opposite side/end. 1.3 Quantities Needed: The contractor shall provide eight custom individual standalone cages for large animals. The contractor shall provide one large bank of small cages with 9 units for small animals. 1.4 Acceptance: The Government shall inspect 100% of the materials delivered on-site. 2. (d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. (xvii) 52.226-6, Promoting Excess Food Donation to Nonprofit Organizations. (May 2014) (42 U.S.C. 1792). Flow down required in accordance with paragraph (e) of FAR clause 52.226-6. (xviii) 52.247-64, Preference for Privately-Owned U.S. Flag Commercial Vessels (Feb 2006) (46 U.S.C. Appx 1241(b) and 10 U.S.C. 2631). (2) While not required, the contractor May include in its subcontracts for commercial items a minimal number of additional clauses necessary to satisfy its contractual obligations. (End of clause) Addendum to 52.212-1 Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show -- (1) The solicitation number; (2) The time specified in the solicitation for receipt of offers; (3) The name, address, and telephone number of the offeror; (4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary; (5) Terms of any express warranty; (6) Price and any discount terms; (7) "Remit to" address, if different than mailing address; (8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically); (9) Acknowledgment of Solicitation Amendments; (10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and (11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation. 999.213-4001 ELECTRONIC PROPOSALS (a) Definition. Electronic proposal, as used in this provision, means a proposal, revision or modification of a proposal, or withdrawal of a proposal that is transmitted to and received by the Government via email or other means for transmitting electronic data. No flash drives will be accepted. (b) Offerors must submit electronic proposals in responses to this solicitation in order to be considered for award. Electronic proposals are subject to the same rules as paper proposals. (c) The email address to receive email proposals is lisa.l.snead@usace.army.mil. (d) The physical address for submitting proposals via CD or other means for transmitting electronic data, except for flash drives, is 701 San Marco Blvd., Jacksonville, FL 32207. (e) If the Federal Business Opportunities (FBO) posting indicates, the offeror may submit an electronic proposal on the Army Single Face to Industry (ASFI) site. (f) If any portion of proposal received by the Contracting Officer is unreadable to the degree that conformance to the essential requirements of the solicitation cannot be ascertained from the document -- (1) The Contracting Officer shall immediately notify the offeror and permit the offeror to resubmit the proposal if the proposal has been received prior to due date indicated in the solicitation; (2) The method and time for resubmission shall by prescribed by the Contracting Officer after consultation with the offeror. (g) The Government reserves the right to make award solely on the electronic proposal. However, if requested to do so by the Contracting Officer, the apparently successful offeror shall submit the complete original signed proposal. (End of paragraph 999.213-4001) 999.215-1 NOTICE OF INTENT TO INCORPORATE UNIT PRICES The successful offeror's unit price for individual contract line item numbers (CLINs) and sub-CLINs, if the pricing schedule includes sub-CLINs, will be incorporated into the contract; and therefore will not be exempt from public disclosure. See FAR 24.202(a). (End of paragraph 999.215-1) End of Addendum to 52.212-1 52.212-2 EVALUATION--COMMERCIAL ITEMS (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: SEE ADDENDUM 52.212-2 (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (End of clause) Addendum to 52.212-2 Replace Paragraph 52.212-2(a) with the following: The Government will evaluate each proposal strictly in accordance with its contents. A proposal that is unrealistic in terms of technical quality or price will be deemed reflective of an inherent lack of technical competence or indicative of failure to comprehend the complexity and risks of the contractual requirements. Such proposals may be determined unacceptable. Award will be made using the lowest-price, technically-acceptable source selection process. Award will be made to the offeror that presents the proposal that possesses all of the following characteristics: (1) meets the acceptability standards for non-price factors, (2) conforms to the solicitation, (3) determined acceptable to the Government, (4) is from a responsible (as defined in Federal Acquisition Regulation Part 9) offeror, and (5) has the lowest price of those offerors meeting the first four characteristics listed here. The following adjectival ratings will be used in evaluating each offeror's technical proposal. • Acceptable - To receive this rating, the offeror shall present a proposal that clearly and comprehensively addresses each of the factors and its subfactors, if applicable. The offeror shall provide sufficient details for the Government to determine whether the proposal satisfactorily meets the minimum requirements of the Performance Work Statement and this solicitation. The proposal shall clearly demonstrate that the offeror fully understands and is capable of performing the requirement for the total proposed price indicated in its proposal. • Unacceptable - An unacceptable rating will be assessed on any offeror that presents a proposal that demonstrates any of the following: 1. Fails to clearly and comprehensively address each of the factors and subfactors. 2. Fails to provide sufficient detail for the Government to determine whether the proposal satisfactorily meets the minimum requirements of the Performance Work Statement and this solicitation in addressing the factors and subfactors. 3. Fails to clearly demonstrate that the offeror fully understands and is technically capable to perform the requirements at its total proposed price. Note: To receive consideration for award, a rating of acceptable must be achieved in all technical factors and subfactors. 52.212-3 Offeror Representations and Certifications - Commercial Items, with its offer. This provision is included in this combined synopsis/solicitation. If the offeror has up-to-date representations and certifications in the System for Award Management (SAM) website, then this completed provision is not required to be submitted with the offeror's offer. The System for Award Management (SAM) is a Federal Government owned and operated free web site that consolidates the capabilities in CCR, ORCA, you were previously registered in CCR and ORCA, your organizations information is already in SAM. You just need to set up a SAM account and migrate your CCR roles.
