Resident Senior Advisor Abuja, Nigeria Issuance Date: 09/15/2016 Closing Date: 10/20/2016 SOLICITATION NUMBER: PSC-16-060-INL SUBJECT A solicitation for a Personal Services Contractor (PSC), Department of State (DOS), Bureau for International Narcotics and Law Enforcement Affairs (INL) The United States Government (USG), represented by the DOS, seeks applications from US citizens interested in providing PSC services as described in this solicitation. PRE-AWARD ETHICAL RESPONSIBILITIES OF PSC (JUN 2011) This solicitation may result in the award of one or more personal services contracts as defined in FAR 2.101. Prior to contract award, all offerors or quotes must advise the cognizant Contracting Officer if they have a personal conflict of interest, such as a financial conflict, that would prevent them from either meeting the requirements of the clause entitled, "Post-Award Ethical Responsibilities of Personal Services Contractors," or otherwise objectively performing their contractual duties upon contract award. JOB DESCRIPTION: See below BACKGROUND The Bureau of International Narcotics and Law Enforcement Affairs (INL) is part of the Under Secretariat for Civilian Security, Democracy, and Human Rights (J) within the Department of State (DOS). INL's mission is to minimize the impact of international crime and illegal drugs on the United States and its citizens through providing effective foreign assistance and through fostering global cooperation. INL's Office of Africa and the Middle East (AME) develops and manages criminal justice sector reform programs and contributes to policy formation on civilian security issues in both regions. INL/AME and INL personnel in-country administer all U.S. government assistance to the criminal justice sector within the Government of Nigeria (GON), including its police, justice institutions, anti-corruption and prisons service. The goal of this program is to support nascent Nigerian institutions to provide security and justice as public services to the population of Nigeria. The purpose of this Personal Services Contract is to fill the new position of Resident Senior Advisor (RSA), whose incumbent would provide subject matter expertise in the area of anti-corruption programs. This will include providing assistance with training, advising and mentoring within Nigeria. The RSA will work with the Nigerian Economic and Financial Crime Commission (EFCC) Academy, in Abuja, Nigeria. The RSA will work directly with the EFCC to develop and implement an anti-corruption programmatic infrastructure and initiate/or enhance strategic integrity training and/or other programs with the EFCC including other law enforcement partners in furtherance of public integrity programs and initiatives. Actions to be taken by the RSA include: • Consultations with senior EFCC officials to pursue implementation of recommendations delineated in the Strength, Weakness, Opportunities and Threat analysis which was conducted by ICE OPR in 2012. • Guidance on investigative methodologies and strategies, assisting with investigative steps, research and interviews. • Designing courses for law enforcement officers, including representatives from Immigration, Customs, Police, and Revenue Agencies with a basic understanding of corruption, integrity, and general investigations. • Reviewing and assessing the EFCC's current training operations and the content and types of training provided to academy recruits in basic training. The RSA will also assess the content and quality of training provided in-service (on-the-job) or through a post-academy process. As a result of the assessment, the RSA will determine what type(s) of training is needed and in conjunction with the EFCC will develop the required training. • Coordinating training opportunities with the EFCC, DOS, and ICE OPR. Training opportunities could be in the form of initial and basic Anti-Corruption training or more target-specific training (either basic or advanced). The training would be designed and provided to assist the EFCC with employing an effective anti-corruption strategic approach in order to identify, address and properly investigate employee misconduct and corruption allegations. • Other special projects the RSA, with approval from the INL Director at post, deems necessary to build the capacity of the EFCC to investigate and prosecute corruption in a fair, expedient, and accountable manner. The incumbent would also provide internal control and accountability for the delivery of equipment, technical assistance, training, and other assistance to the GON. The RSA must be able to work rapidly, responding promptly to multiple demands and juggle changing priorities in a difficult and demanding environment. The position requires the ability to determine swiftly what needs to be done, when it needs to be done, and how it can be delivered with enough supervision to ensure its effectiveness. DUTIES AND RESPONSIBILITIES Substantive: 1. Assist in assessing EFCC's roles in the Nigerian criminal justice system; identify and prioritize areas for reform; work with EFCC to design and implement needed reforms. 2. Provide expert advice, guidance, and leadership with regard to the design, development, and implementation, of anti-corruption training programs. 3. Aid the Embassy in developing a long-term USG strategy for anti-corruption assistance in Nigeria for bi-lateral implementation. 4. Gather necessary information and assist in planning and coordinating activities across program and organizational lines, reconcile conflicting interests, and resolve complex and sensitive issues. 5. Provide the INL Director with current analyses and the latest information on issues relating to anti-corruption efforts and their integration into international efforts; note problem areas and opportunities that merit Embassy attention; suggest courses of action. 6. Provide expertise, commentary and suggestions as appropriate on such areas as anti-corruption training and institutional reform; assist with donor coordination. 7. Develop and maintain a close working relationship with INL, the Government of Nigeria (GON), the EFCC and INL's implementing partners in order to assist the INL Director in identifying and resolving issues effecting the administration of anti-corruption training and development programs. 8. Assist with keeping anti-corruption training and reform efforts on track amid constantly changing circumstances by facilitating the interaction between the INL Director, and Nigerian and other local officials, EFCC officials, relevant international partners, and representatives from civil society. 9. Remain aware of the personalities involved with the Nigerian counterparts; ensure that INL is working with the most effective players who are most likely to accept, learn and benefit from INL anti-corruption training and development programs. 10. As requested by the INL Director, brief senior U.S. Mission officials, visitors from Washington, NGOs, or international organizations. 11. Attend conferences and multilateral and regional meetings that relate to the assigned areas of responsibility, as requested by the INL Director. 12. Provides a monthly report (short 2-3 page report/update) due on the 1st of each month outlining challenges and achievements of the project. Managerial 13. Ensures that the INL Office is effective in channeling and coordinating INL assistance to anti-corruption entities in Nigeria. Assists the INL Director in maintaining anti-corruption training and programs in Nigeria. 14. Establishes and maintains appropriate internal management control systems. Ensures that INL anti-corruption programs are not subject to waste, fraud, or mismanagement. Helps manage and monitor the use of all U.S.-provided commodities intended for anti-corruption purposes. 15. Provides analysis and guidance in project budget preparation, and program planning for anti-corruption programs with an annual budget of approximately $2-6 Million 16. Conducts senior-level field surveys, evaluations, and special studies, as directed, in connection with anti-corruption programs. 17. Maintains security awareness and properly handles classified and controlled items and information. TRAINING & DISTANCE LEARNING COURSES 1. Completes the Contracting Officer Representative (PA296) distance-learning (DL) course through the Foreign Service Institute (FSI) within 120 days of arriving at Post. 2. Completes the Introduction to Working in an Embassy (PN113) distance-learning (DL) course through the Foreign Service Institute (FSI) within the first six (6) months of arriving at Post. 3. If applicable - Completes the mandatory Foreign Affairs Counter-Threat (FACT) Course (OT610) prior to deployment to Post. RELATIONSHIPS The RSA will report to the INL Director at the U.S. Embassy Abuja. The RSA will focus primarily on the programs related to Nigerian anti-corruption activities. The INL Director will provide general administrative and policy direction concerning overall program priorities and objectives. The RSA will receive general policy guidance and direction from the INL Director, but will work independently to further the mission of INL. The Contracting Officer's Representative (COR) is delegated the authority to act for the Contracting Officer in matters concerning technical clarification, inspection and, after concurrence by the Contracting Officer, acceptance of Contractor performance under the contract, including preparation of receiving reports, and the authorization of progress payments when appropriate. The COR will coordinate all work with the Contractor and review Contractor's performance at significant stages of its development. In no instance, however, shall the COR be authorized to alter or modify the specifications or the contract terms and the conditions or waive the government's requirement, price, delivery, or other terms and conditions. Such changes must be authorized, in writing, to the Contracting Officer. DELIVERABLES/REPORTS Deliverables are required under this PSC and shall include; monthly status reports, monthly evaluation of contractor performance, special reports when required and "Completion of assignment report," which shall be a compressive review of the projects in which the contractor was involved. Each report shall include a critique of and recommendations for the various projects. The completions of assignment reports are due no later than fifteen (15) days prior to the expiration of this contract. The Personal Service Contractor shall submit two (2) copies of each report as required to the following; 1. INL/POST Director(s) and; 2. INL/Program Officer Per FAR Part 4, the above referenced documents shall be incorporated and copies stored in the PSC's hard file under Section V.; Tab E - Receiving Reports. The Contractor shall prepare and submit two copies of each technical report required by the schedule of this contract (e.g., progress reports, final reports, etc.), to the Embassy INL Section and to the Program Officer, Bureau of International Narcotics and Law Enforcement Affairs (INL), Department of State Washington, DC. The title page of all reports forwarded pursuant to this paragraph shall include a descriptive title, the author's name(s), contract number, project number, and title, contractor's name, name of the State Department project office, and the publication or issuance date of the report. When preparing reports, the Contractor shall refrain from using elaborate artwork, multicolor printing, and expensive paper/binding, unless it is specifically authorized in the Contract Schedule. Wherever possible, pages should be printed on both sides using single spaced type. COMPLEXITY: Develops detailed plans, goals and objectives for the long-range implementation and administration of INL policies and programs, and/or develops criteria for evaluating the effectiveness of the program. Coordinating plans with various other groups including international donors and the Government of Nigeria can be complicated. Active planning involves anticipating future events and requirements, deciding or recommending what needs to be done, the people and other resources required, and the timing of the activities. Operating within the country strategy, the RSA will have ongoing opportunities to develop new ideas and approaches that impact existing procedures and methods. The RSA must absorb and understand a large volume of detailed information on policies and procedures for multiple disciplines. Within a loose framework, the RSA will be responsible for meeting a series of mid-to-long term objectives through structuring work and resources. Often breaking new ground, this role will be highly complex and will require a highly developed analytical ability and judgement. The problems encountered in this position will often be unique, highly complex, or conceptual. Covering a wide range of potentially conflicting issues, the RSA must apply the highest analytical skill and judgment to determine the best solution from the range of possible alternatives. The work pattern will be typified by many other overlapping tasks with heavy disruption due to changes in priorities, external events, and other interruptions. A broad range of highly developed oral communication skills are required for this position. The RSA will, at various times, be required to transmit routine information, discuss sensitive matters with tact and diplomacy, provide complex explanations, persuade and influence, give formal presentations, express care and compassion, provide reasoned arguments, and resolve conflicts without compromising the organization's position. Finally, the RSA must exercise leadership in order to achieve objectives and get the job done well, quickly and efficiently without recourse to close supervision or coercion. SCOPE AND EFFECTIVENESS: The RSA performs a broad range of tasks related to organizational control plan, process development, implementation and direction of a management control program encompassing the Bureau's international law enforcement operations. PERSONAL CONTACTS: The RSA will interface primarily with mid and high-level officers within the U.S. Embassy in Abuja and other international representatives in Nigeria. The nature of the contact with embassy officers will be highly demanding, requiring the transfer of complex ideas and concepts. The RSA will interact primarily with high-level GON and international officials, including Ministers and Deputy Ministers. The nature of the contact will normally be routine, although often escalating to complex as competing/conflicting interests and security threats are encountered. MINIMUM REQUIREMENTS: • U.S. citizenship; able to obtain/maintain Department of State Secret and Medical Clearances, and ethics, if applicable. • A minimum of ten years' experience in anti-corruption programs, management, organizational development, planning, and/or training. • A Master's degree from an accredited institution in criminal justice, business administration, organizational development, or other related field or an additional two years of relevant experience in a developing country. • Demonstrated experience in anti-corruption program development/reform overseas or other relevant experience overseas. • Demonstrated ability to explain, promote, and defend USG policies to senior law enforcement officials of other nations and the host country and representatives of international organizations. • Demonstrated experience working or coordinating with USG agencies (e.g., USAID, Justice, State, and/or Defense). • Proven ability to exercise a high degree of professional judgment, diplomacy, and tact at all times in order to build successful relationships with Nigerian partners and the international community. • Strong interpersonal skills; proven ability to work well with others. • Excellent oral and written English communication skills. • Proficient in Microsoft Office Suite, and ability to organize, analyze, prepare, and present information to a variety of audiences. PREFERRED KNOWLEDGE AND SKILLS: • Extensive experience managing and/or directing anti-corruption development programs overseas. • Knowledge of USG contracting practices and experience in contract oversight. • Experience working with the United Nations. GOVERNMENT-FURNISHED EQUIPMENT The PSC shall be able to use a furnished with office space, a computer, office telephone, and other supplies needed for job requirements. This property will be owned and maintained by the Department of State DOS. TRAVEL REQUIREMENTS The incumbent will reside in Abuja and travel and work in the field as circumstances dictate and allow. PRE-DEPLOYMENT REQUIREMENTS 1. If applicable - Consultations with the INL Program Office may be required. EVALUATION CRITERIA: Factor 1 - Program Management (20 points) Demonstrated experience in program management, especially in international programs that may include foreign government entities, non-governmental, and international organizations to include experience involving analytical, planning, management, advisor, operational, or evaluative duties. Demonstrated experience and ability to assess current programs in place and to develop and implement plans for improving the capabilities of the EFCC. Factor 2 - Subject Matter Experience (20 points) Proven ability to provide objective subject matter expertise on police program management to senior level officials within INL and the U.S. Embassy Factor 3 - Management & Communication Experience (40 points) Ability to communicate effectively, both orally and in writing, in a timely and concise manner; interact effectively with others at all levels to prepare, analyze, explain and defend determinations and requirements with respect to conformance to applicable laws, policies and other regulatory guidelines; and advise program officials. Factor 4 - International Experience (10 points) Demonstrated experience in managing programs in foreign, post-conflict environments to include ability to live, work, and travel in difficult conditions with limited support, manage programs in a complex and fluid environment, and show good judgment in challenging security situations. Factor 5 - Past Performance (10 points) Past performance evaluation of applicant's ability to perform under the contract. In conducting the evaluation, the U.S. government reserves the right to utilize all evaluation information available at the time of evaluation, whether provided by the applicant or obtained from other sources. COMPENSATION (BASE PAY) For award, INL will negotiate for this contract based on the market value as outlined above and overall experience relevant to the solicitation requirements.
