Description
This is a Special Notice; Intent to issue a Sole Source Modification and is for INFORMATION PURPOSES ONLY. This IS NOT a REQUEST for PROPOSALS, QUOTATIONS, or BIDS. Responses to this request will not be returned. It is the intent of the Contracting Office to use this information for market research related to limited competition purposes only. The survey is being conducted to determine the interest of industry within NAICS codes #333120 and #333923. The Government WILL NOT pay for the provision of any information, nor will it compensate any respondents for the development of any such information. A formal solicitation will not be released. The Philadelphia District, USACE on behalf of the Marine Design Center and on behalf of the Lakes and Rivers Division, USACE intends to modify Contract Number W912BU-16-C-0010 on a sole source basis to add work determined to be critical for safe operation and which is integral and non-separable from the work being performed presently. It is not possible to defer this work while completing the current scope because rework/additional disassembly would be required to accomplish it and expose areas that will be covered up by work being performed under the current contract. The additional work is necessary to be added in order to make the floating crane operational. The contractor holding the existing contract is the only identified viable source for the subject requirement. The existing current contract is with PAR SYSTEMS Inc. and was awarded on February 22, 2016 in the amount of $7,238,168 pursuant to an approved Justification and Approval for Other Than Full and Open Competition, J&A Control number CENAP-15-10 approved on August 25, 2015 by the USACE Special Competition Advocate. Contract W912BU-16-C-0010 was placed on a sole source basis for repairs following a casualty to the crane, which upon review revealed issues associated with the original design. PAR SYSTEMS Inc. was not the original designer of the crane, but is the current owner of the intellectual property and proprietary design rights for the crane. During current performance of the existing contract, additional work was determined to be necessary to complete the repairs and is the subject of this announcement. The additional work to be performed is integral with the work that is currently under contract and must be performed at the same time and at the same location as the work which is already under contract so that the vessel is returned to safe and functional service in accordance with mission requirements by November 15, 2017. That work must also be integrated into overall responsibility for certification of the crane by PAR SYSTEMS Inc. and be warranted by PAR SYSTEMS Inc. The following repair items represent the majority of the additional work and are directly involved in either: lifting and moving the crane loads, or controlling the crane loads when lifting. The items are as a result critical safety related components. Repair of these items by the crane manufacturer is required to ensure that the repair work and components are fully engineered, integrated and assembled to assure safe crane operation. This notice of intent is not a request for competitive proposals. However, all capability statements received by October 6, 2016 at 5:00 p.m. Eastern time will be considered by the Government.
